A. 
It is unlawful for any person to intentionally expose or knowingly permit exposure of his or her genitals or expose his or her entire buttocks to public view in a county park while sunbathing, and for any female to intentionally expose or knowingly permit exposure of the entirety of her breasts to public view in a county park while sunbathing.
B. 
Sunbathing means the conduct of bathing, basking, or engaging in conduct ancillary thereto, with or without the presence of sunlight, in areas open to public view.

Employees of the Whatcom County parks department, or its successor agency, if any there be, as well as all others who are otherwise authorized to enforce ordinances of this county, are hereby authorized to enforce the provisions of this chapter, consistent with the provisions of RCW Chapter 7.80.

Violation of this chapter shall constitute a Class 2 civil infraction and upon finding of commission or default, violators shall be subject to a penalty of not more than $125.00, pursuant to the provisions of RCW Chapter 7.80.
