Any person who uses a public street or thoroughfare for the purpose of laying pipe or conduits, or for any other reason which necessitates the digging of a hole or trench:
A. 
Shall not cause any street to remain closed for more than thirty-six (36) consecutive hours;
B. 
Shall not allow the hole to remain open for more than eighty-four (84) consecutive hours;
C. 
Shall maintain a sufficient number of red lights adjacent to the hole or trench to give sufficient warning of danger to any persons traveling upon that street;
D. 
Shall, as nearly as possible, restore the street to its original condition;
E. 
Shall keep all holes filled to a level grade with the remainder of the street; and
F. 
Shall, in the event that a hole dug and filled by that person sinks to a level lower than level grade, refill it to a level grade within five days of when the depressed area was reported.

A. 
Street Closure Defined. For purposes of this section a street closure is a temporary closing or restriction of the normal use of a city street by motorized and non-motorized vehicles or by pedestrians. Streets may be closed for only the minimum time required for the particular event submitted by the person or persons requesting the street closure.
B. 
Request to Close Streets. A request to close streets shall be filed with the police department at least ten (10) business days prior to the date the street would be closed. The request shall be provided on a form which includes the name, address and phone number of the person requesting the closure, a description of the activity, the date and time of the closure, services requested of the city, a listing of names and signatures of people living on the street or streets to be closed acknowledging that they know why the closure is requested and that they agree to the closure, and such information that the, police department finds necessary or desirable to evaluate a street closure request. In evaluating a request the police department will notify and obtain concurrence from the Winters fire district.
C. 
Cost of Street Closure. There shall be no charge for filing and obtaining a determination or a request for street closure, however, use of city personnel, equipment and facilities to effect the closure shall be at rates established for such use and payable at such time as approval for the street closure is given by the police department.
D. 
Restricted Streets. There shall be no closure of the following streets without council approval:
1. 
Main Street;
2. 
Railroad Avenue;
3. 
Grant Avenue;
4. 
Valley Oak Drive;
5. 
Abbey Street.
Requests to close these streets shall be processed in manner similar to subsection B except that the request shall be submitted by the police department to the city council for approval. Requests to close the streets herein listed shall be submitted at least thirty (30) business days prior to the street closure.
E. 
Failure to Meet Timelines. Requests for street closures that are not submitted by the minimum time lines established in this section may be granted only by the Winters city council.
F. 
Appeal of Decisions. A person who has received an unfavorable decision concerning a street closure request, or a person who does not agree with a street closing approval, may appeal such decisions pursuant to Chapter 2.44 of the Municipal Code.
