The purpose of this Article is to ensure that there will be proper street development within the Village and that infrastructure is constructed in a manner that is safe and durable, and will effectively serve the increasing populations and land use activities in the Village.

A. 
No infrastructure, as defined herein, shall be constructed or replaced by any private party unless such construction is being performed in conformance with the provisions of this Article.
B. 
Definitions. As used in this Article, the following word shall have the meaning set forth below:
INFRASTRUCTURE
Any street, roadway, sidewalk, water main, or sewer main, located on public right-of-way or on private property intended to be dedicated to the Village.

A. 
All infrastructure constructed after the enactment of this Section (8-6-2025) shall be constructed according to the Village of Kingdom City Design Standards, which are hereby adopted and incorporated herein as Appendix A[1]. The City Administrator is hereby authorized to amend the design standards from time to time as may be required.

B. 
The naming of any new street shall be the privilege of the owner of the street before said street becomes a Village street, subject to the approval of the Board of Trustees.

A. 
For all existing streets that do not have curbs and gutters, the cost of installing curbs and gutters will be borne by the adjacent property owner. The Village reserves the right, before any major street improvements are to be done, to require that curbs and gutters be installed.
B. 
The laying of any utility under the pavement of any street is prohibited without the express written consent of the Village.
C. 
Streets shall intersect one another at as near a right angle as possible, and no intersection angle shall depart from a right angle by more than twenty (20) feet. All intersection shall be rounded with a radius of fifteen (15) feet for right-angle intersections.

A. 
It is the duty of every property owner to keep the sidewalks, curbs, gutters, culverts, and driveway entrances adjacent to his/her property and in the Village in good repair at all times and free from irregularities and offsets in the surface thereof that may render the same unsafe for use and to maintain any vegetation growing in the drainage ditch or between the drainage ditch and the paved surface of any public road. The adjoining property owner shall keep all culverts free of obstructions.
B. 
In addition, the property owner shall be responsible for maintaining and mowing the unpaved portion of the right-of-way adjacent to his/her property.

A. 
Every driveway in the Village which has a culvert or shall have a culvert, required under this Article, which shall be made of sixteen-guage corrugated metal or the equivalent strength high-density polyethylene (HDPE) and shall be installed at the same grade as the drainageway slope and shall conform to the following specifications:
1. 
For drives no wider than twenty (20) feet, the drainage culvert thereunder shall be at least fifteen (15) inches in diameter.
2. 
For drives more than twenty (20) feet wide but less than one hundred (100) feet wide, the culvert shall be at least eighteen (18) inches in diameter.
3. 
All culverts shall be covered with no less than twelve (12) inches of fill material or soil.

A. 
Every culvert shall be kept clear of any obstructions that might interfere with the flow of drainage water, and it shall be the obligation of the property owner to inspect and maintain the culverts.
B. 
If a culvert has an obstruction of any form which interferes with the flow of drainage water and the property owner does not correct the problem within thirty (30) days after notification from the Street Superintendent of the owner's duty to remedy such obstruction, then the Street Superintendent shall have the authority to enter onto such owner's land and use any suitable means necessary to restore the adequate flow of drainage water through such culvert.
C. 
Within thirty (30) days of receipt of an invoice for the actual cost of clearing such obstruction, the owner shall pay to the Village its cost incurred in remedying such obstruction, and if the same is not timely paid, the Board of Trustees may, by ordinance, levy such cost as a special tax bill against the property on which such culvert is located, or that is adjacent to such culvert, which tax shall be collected like other special tax bills and which shall constitute a first lien on the property until paid.

A. 
Permit Required. Prior to the construction of or improvement of any private driveway entering into or exiting from the Village street, road, or alley, the owner, contractor, or other person constructing or improving the private driveway shall first obtain a permit from the Street Superintendent of the Village.
B. 
Number, Distance Allowed. No parcel shall be allowed more than one (1) driveway entrance onto any public street, except that corner lots may have one (1) on each street. No driveway may be added within twenty (20) feet of any intersection nor within twenty (20) feet of any existing driveway.
C. 
Shared Driveways Prohibited. After August 1, 2025, each driveway constructed shall be entirely on the lot where the building it serves is located. Shared driveways will not be allowed.
D. 
Culvert To Be Constructed; Exceptions. No permit shall be issued unless the plans and specifications for the construction or improvement of the driveway call for the placement of a drainage culvert meeting Village construction specifications; provided, however, that the Village Maintenance Superintendent may issue a permit where it is determined by him/her that proper drainage and conservation of Village streets, roads, and alleys do not require the placement of such a culvert under a proposed driveway.
E. 
Permit Fees. All applications for permits hereunder shall be accompanied by an application fee of fifteen dollars ($15.00), payable to the Village.
F. 
Construction Of Driveway Entrances For Residential Properties. Driveway entrances for residential properties, which shall include commercial businesses operating out of residential districts, such as an in-home occupation, shall comply with the following standards:
1. 
All driveway approaches shall be concrete or asphalt.
2. 
The minimum depth of concrete or asphalt shall be six (6) inches.
3. 
The minimum width of driveway entrances shall be twelve (12) feet.
4. 
The maximum width of driveway entrances shall be twenty (20) feet.
5. 
Each driveway entrance shall have two-foot wing approaches, six (6) inches in depth.
6. 
A smooth cut is required on the street where a driveway entrance is connected.
7. 
Curb and gutter requirements (cuts and construction) shall be provided for on all roadways currently having curbs and gutters.
8. 
The minimum depth of a driveway entrance shall be no less than six (6) feet from the edge of the pavement.
G. 
Construction Of Driveway Entrances For Commercial Properties. Driveway entrances for commercial properties shall comply with the following standards:
1. 
All driveway approaches shall be concrete.
2. 
The minimum depth of concrete shall be six (6) inches.
3. 
The minimum width of driveway entrances shall be twenty (20) feet.
4. 
The maximum width of driveway entrances shall be forty (40) feet.
5. 
Each commercial driveway entrance shall have a five-foot radius and be a minimum of six (6) inches in depth.
6. 
A smooth cut is required on the street where a driveway entrance is connected.
7. 
Curb and gutter requirements (cuts and construction) shall be provided for on all roadways currently having curbs and gutters.
8. 
The minimum distance from the edge of the pavement to the back of the approach shall be no less than six (6) feet in length.
H. 
Exceptions. A request for an exception from the requirements of this Section may be filed with the Village Clerk on a form available in the office of the Village Clerk requesting an exception to the driveway entrance specifications. Such a request shall state why it is not feasible to comply with the requirements of this Article and what alternatives are proposed. Upon receipt of such a request, the Village Clerk shall forward and make the same available to the Village Street Superintendent, and the request shall be reviewed by the Village Street Superintendent who shall grant the request if he/she determines that compliance with the strict rules of this Section are not feasible and the alternative suggested achieves the same or better results. A request for an exception must be accompanied by a review fee of fifteen dollars ($15.00).

The provisions of this Article are severable, and if any provision hereof is declared invalid, unconstitutional, or unenforceable, such determination shall not affect the validity of the remainder of this Article.

For the purposes of this Article, the following words shall have the meanings assigned hereto:
DESIGN GUIDELINES
The most current set of design guidelines for residential streets with paved concrete or asphalt surfaces.
PUBLIC ROAD
A street that has been dedicated or deeded to the Village or which is intended to be dedicated or deeded to the Village.
PRIVATE ROAD
A street that serves more than two (2) residences or commercial facilities and which has not been, nor is intended to be, dedicated or deeded to the Village.
STREET
A street, road, lane, court, alley, or other thoroughfare used by, or intended to be used by, vehicular traffic.

A. 
No building permit shall be issued, nor any building constructed, on a property which does not abut a public or private street.
B. 
No building permit shall be issued in any subdivision until all planned roads and sidewalks have been completed, unless permission to do otherwise is granted by the Board of Trustees, which such permission shall be conditioned upon the posting of a cash deposit or letter of credit in an amount sufficient to complete the required infrastructure.

A. 
No private street shall be constructed unless such street is constructed according to the design standards of the Village.
B. 
All private streets shall be maintained by the property owners abutting the street. In the event that the Board of Trustees determines that any private street is not being adequately maintained, such that it creates a hazard, the Board of Trustees shall issue a written order to the property owners requiring that such street be returned to the original design standard within sixty (60) days. Such notice shall be delivered to the owners of U.S. Mail at the address shown in the records of the Callaway County Collector. If the property owners fail to commence repairs within the sixty (60) day period, the road shall be declared to be a public nuisance and the Village shall contract to make such repairs at the expense of the property owners proportionately to the length of the road abutting their property.
