(a)
A business improvement district, entitled "Downtown Pacific Grove business improvement district," is hereby established in accordance with the provisions of Division 18, Part 6 of the Streets and Highways Code of California, Section 36500 et seq. (Parking and Business Improvement Area Law of 1989), having boundaries as described in this chapter. The businesses in the Downtown Pacific Grove business improvement district established by the ordinance codified in this chapter shall be subject to any amendments to said Part 6, Division 18 of the California Streets and Highways Code.
(b)
On February 9, 2000, the Pacific Grove city council adopted Resolution of Intention No. 0-007, entitled "Resolution of the City Council of the city of Pacific Grove Stating the City's Intention to Form Downtown Pacific Grove Business Improvement District," and scheduled a public hearing on March 1, 2000, at 6:00 p.m. to establish the business improvement district.
(c)
The public hearing to establish the business improvement district was held at 6:00 p.m. on March 1, 2000, before the Pacific Grove city council, in the Pacific Grove Community Center, 515 Junipero Avenue, Pacific Grove, California.
(d)
At said public hearing, testimony of all interested persons for or against the establishment of the district, the extent of the district or the furnishing of specified types of improvements or activities was heard. The city did not receive a majority protest regarding the establishment of the district, the extent of the district or the furnishing of specified types of improvements or activities. A "majority protest" is defined as written protests from owners of businesses in the district which will pay 50 percent or more of the proposed assessments.
(e)
General Findings. The council of the city of Pacific Grove hereby finds that the businesses and the property within the Downtown Pacific Grove business improvement district will be benefitted by the improvements and activities funded by the assessments levied in this chapter.
