(a) 
A business improvement district, entitled "Downtown Pacific Grove business improvement district," is hereby established in accordance with the provisions of Division 18, Part 6 of the Streets and Highways Code of California, Section 36500 et seq. (Parking and Business Improvement Area Law of 1989), having boundaries as described in this chapter. The businesses in the Downtown Pacific Grove business improvement district established by the ordinance codified in this chapter shall be subject to any amendments to said Part 6, Division 18 of the California Streets and Highways Code.
(b) 
On February 9, 2000, the Pacific Grove city council adopted Resolution of Intention No. 0-007, entitled "Resolution of the City Council of the city of Pacific Grove Stating the City's Intention to Form Downtown Pacific Grove Business Improvement District," and scheduled a public hearing on March 1, 2000, at 6:00 p.m. to establish the business improvement district.
(c) 
The public hearing to establish the business improvement district was held at 6:00 p.m. on March 1, 2000, before the Pacific Grove city council, in the Pacific Grove Community Center, 515 Junipero Avenue, Pacific Grove, California.
(d) 
At said public hearing, testimony of all interested persons for or against the establishment of the district, the extent of the district or the furnishing of specified types of improvements or activities was heard. The city did not receive a majority protest regarding the establishment of the district, the extent of the district or the furnishing of specified types of improvements or activities. A "majority protest" is defined as written protests from owners of businesses in the district which will pay 50 percent or more of the proposed assessments.
(e) 
General Findings. The council of the city of Pacific Grove hereby finds that the businesses and the property within the Downtown Pacific Grove business improvement district will be benefitted by the improvements and activities funded by the assessments levied in this chapter.

The boundaries of the Downtown Pacific Grove business district are as shown on the map referred to as "boundaries of the Downtown Pacific Grove business improvement district," on file with the city clerk, and as specified herein, including both sides of every street except Pine Avenue:
Central Avenue from 505 Central (Medical Building) to 530 Central (Christian Science Church) up to Caledonia Park and the back of the Post Office.
Lighthouse Avenue from 472 Lighthouse (The Grove Homescape) and 477 Lighthouse (Petra's) to 728 Lighthouse (Moon's Salon) and 721 Lighthouse (International Design-Matthams).
Laurel Avenue from 521 Laurel (residence) across from city's parking lot to 631 Laurel (residence) at the corner of 18th and Laurel.
Pine Avenue only on the north side (police/fire department side) from 546 Pine (Stuart Dong State Farm Insurance) to 644 Pine (Soft Tissue Clinic).
Fifteenth Street from 135 Fifteenth Street (Lynne Haller, DDS) to 223 Fifteenth Street (Winning Wheels).
Fountain Avenue from 156 Fountain (Piano Warehouse) to 157 Fountain (Chatterbaux Children's Shoppe) to 314 Fountain (residence).
Grand Avenue from 157 Grand (Grand Central Station) and backside of PG Museum of Natural History to 315 Grand (Ed Bredthauer) and 318 Grand (Martial Arts America).
Forest Avenue from 165 Forest (Museum) to 164 Forest (Brian Gill Law Office) to 264 Forest (Mum's Place) and 311 Forest (EMDR).
Sixteenth Street from 172 Sixteenth Street (residence) to 207 Sixteenth Street (Wally Getz property).
Seventeenth Street from 153 Seventeenth Street (Rudas Building) to 231 Seventeenth Street (Corner House Ceramics) and 232 Seventeenth Street (Peninsula Counseling Center).
Eighteenth Street from Central Avenue which includes 160 Eighteenth Street (Paul's Drapery) to Laurel Avenue. At this time, Paul's Drapery is the only business on Eighteenth Street.
Nineteenth Street and Congress between Central Avenue and Lighthouse Avenue. There currently are no businesses on either street.

Each business owner in the district established in this chapter, except for catalogue sales establishments, shall pay to the city of Pacific Grove an annual assessment equal to 35 percent of its annual business license tax.

(a) 
Each business owner in the district subject to the assessment established by this chapter shall pay its annual assessment to the city on July 1st of each year, when the business license tax is paid.
(b) 
The amount of any assessment imposed by this chapter shall be deemed a debt to the city. An action may be commenced in the name of the city in any court of competent jurisdiction, for the amount of any delinquent assessment.

The assessments levied under this chapter shall be used solely for the promotion, marketing and advertising of professional and retail businesses located in the Downtown Pacific Grove business improvement district. The assessments levied under this chapter shall not be used to provide improvements or activities outside of the Downtown Pacific Grove business improvement district or for any purpose other than the purposes specified in the Resolution of Intention Number 0-007, adopted February 9, 2000, or as modified by the city council at its public hearing on March 1, 2000.
