Proceedings for the vacation of any easement for a public street, lane, alley, court, or other place shall be taken pursuant to the provisions of Part 3, Division 9 of the Streets and Highways Code of the state.

In any vacation proceeding taken pursuant to the provisions of Part 3, Division 9 of the Streets and Highways Code of the state, the council shall find and determine that the public necessity, convenience, safety, health and welfare require such vacation.

No resolution of intention to vacate any street, lane, alley, court or other place shall be presented to the council unless and until the person requesting such vacation shall have paid to the city a fee in an amount not less than one hundred dollars which, in the judgment of the city engineer, shall be sufficient to compensate the city for the cost of such vacation proceedings; provided, however, in the event such vacation is initiated by the council, the fee may be waived in whole or in part by the council.
