The City of Mountlake Terrace accepts the responsibility for expanding the public's experience with visual art. Artists capable of creating art for public places must be encouraged. A policy is established, therefore, to direct the inclusion of visual art in the public works of the City.

A. 
"Commission"
means the Mountlake Terrace Arts Advisory Commission.
B. 
"Municipal construction project"
means any project, paid for wholly or in part by the City of Mountlake Terrace, to construct any building, decorative or commemorative structure, park, or any portion thereof, within the limits of the City of Mountlake Terrace.
C. 
"Eligible funds"
means a source fund for construction projects from which art is not precluded as an object of expenditure.

A. 
All authorizations and/or appropriations for municipal construction projects shall include an amount equal to at least one percent of the total project cost (as estimated by the city in the year in which the project is actually initiated) to be used for selection, acquisition, and/or installation of works of art to be placed in, on, or about public facilities. If the law establishing a source of funds for a particular project excludes art as one of the items for which such funds may be expended, the amount of funds from that source shall be excluded from the "total project cost" in making said calculations.
B. 
The funds authorized and/or appropriated pursuant to this section shall be held in the Municipal Arts Fund. Out of such funds, the City Council, on the advice of the Arts Advisory Commission, shall budget the amount to be allocated for selection, acquisition, and/or installation for individual works of art to be placed either as an integral part of the municipal construction project or attached thereto, or detached within or outside such project, or to be placed in, on, or about other public facilities.
C. 
Funds authorized and/or appropriated pursuant to this section for municipal construction projects, but not spent on the project, shall be placed in the Municipal Arts Fund. If the transfer to the Municipal Arts Fund is prohibited by applicable law, funds authorized and/or appropriated pursuant to this section as a part of one such project shall be spent either on that project, or for another project assigned to the fund or department which is the source of the funds, whichever is permissible by law, for selection, acquisition, and/or installation of works of art.
D. 
Any unexpended funds of the Municipal Arts Fund shall be carried over automatically for an indefinite period when designated for a given project and for a period of three years, when no project has been designated. Upon request of the Arts Advisory Commission, funds may be carried over for an additional two years. Any funds carried over for three years, or upon special request for five years, and still unexpended at the expiration of such period, shall be transferred to the Current Expense Fund for general art purposes only; provided, that funds derived from revenue or general obligation bond issues or from utility revenue or other special purpose or dedicated funds, shall revert to the funds from which appropriated at the expiration of said three- or five-year period.

A. 
The Arts Advisory Commission shall be responsible for determining the method of selection and commissioning of artists; and for reviewing the design of, execution, placement of, and acceptance of works of art funded by this chapter, subject to final approval by the City Council of the project contract. Procedures for these responsibilities shall be developed by the Commission and shall become the policy of the Commission, and available to the public upon request.
B. 
The Commission shall make an annual review of all capital improvement projects, as adopted by the City Council, to determine which projects are appropriate for inclusion of works of art, and to anticipate the source and amount of funds to be provided for works of art. If the inclusion of works of art as part of a particular project is determined not to be appropriate, the funds allocated shall be handled pursuant to MTMC § 3.55.030(C).

There is hereby established a special fund designated "Municipal Arts Fund" into which shall be deposited funds appropriated as contemplated by this chapter, together with such other funds as the City Council shall appropriate for works of art, and any contributions for works of art, and from which expenditures may be made for specific works of art. Separate accounts shall be established within the Municipal Arts Fund to segregate receipts by source or, when so directed by the City Council, for specific works of art. Disbursements from such funds shall be made in connection with projects recommended by the Commission and approved by the City Council.
