Receptacles for the collection of paper, metal, and glass shall be allowed to be placed and operated on properties within Mountlake Terrace, when in accordance with this chapter.

Prior to the placement or operation of any recycling receptacle on any property, a drawing of the proposed receptacle and a site plan indicating the proposed location of the receptacle shall be submitted to the Planning Commission for their review and approval.

The Planning Commission may impose whatever conditions it feels necessary for the proper location and operation of recycling receptacles. Conditions may pertain to on-site location, setbacks from surrounding properties, sight-screening, receptacle design, size, and construction materials, types of materials collected, hours and days of operation, maintenance, number of receptacles, and termination of operation. Where the Planning Commission determines that a proposed recycling receptacle is not compatible with other land uses in the immediate vicinity, or not in the public interest, the Commission may deny the request to locate such receptacle.

Recycling receptacles may be permitted in any BA, BN, BC, CG, LI, or RM zone. Recycling receptacles may, subject to Planning Commission approval, be permitted in an RS zone where the primary use of the site is a school, church, or other public-oriented facility.

No recycling receptacle may be located in any area used to satisfy requirements of Mountlake Terrace development codes, including, but not limited to, required driveways, parking stalls, landscape areas, or sight triangle areas.

Activities conducted in conjunction with recycling receptacles shall be limited to the collection, sorting, loading, and transport of materials, and maintenance of the recycling area. No processing of materials shall occur at the collection site.

All receptacles shall be constructed to be watertight, including a cover for the protection against rain. Receptacles shall be designed to discourage entry by animals and small children. Each receptacle shall be visibly labeled to identify the type of material collected, as well as the name, address, and telephone number and the party responsible for the maintenance and operation of the receptacle.

All recycling receptacles and the grounds appurtenant thereto shall be maintained in a safe and sanitary condition. All materials to be recycled shall be kept inside the receptacles, with the surrounding premises kept free of debris.

The provisions of this chapter shall apply to all recycling receptacles within the Mountlake Terrace City limits, whether or not those receptacles existed prior to the enactment of the ordinance codified in this chapter. Persons responsible for receptacles existing prior to the enactment of the ordinance codified in this chapter shall apply for Planning Commission approval of the continued existence of the receptacle within 30 days of the effective date of the ordinance codified in this chapter.

Any recycling receptacle located or operated in violation of this chapter or conditions established by the Planning Commission shall be grounds for taking corrective action. Corrective action may include either removal of the violation or removal of the receptacle. Failure to correct the violation within five days of the date of notice of violation shall constitute a misdemeanor punishable by a fine not to exceed $500.00.
