The provisions of this article shall apply to the waters of North Two Lake (also known as Two Lakes North), Water Body Identification Code (WBIC) number 1007500, located entirely within the Town of Lake Tomahawk. This article shall be enforced by the Oneida County Sheriff's Department, state game wardens, and any other authorized law enforcement officers.
The intent of this article is to provide safe and healthful conditions for the enjoyment of aquatic recreation consistent with public rights and interests, and the capability of the water resources.
As used in this article, the following terms shall have the meanings indicated:
SLOW-NO-WAKE
That speed at which a boat moves as slowly as possible while still maintaining steerage control.
No person shall operate a boat faster than slow-no-wake in the Northeast Bay of the waters of North Two Lake, lying north and east of a line extending from the southernmost point of Lot LT-184-3 (Radloff lot) to the northwesternmost point of Lot LT-181-7 (McKinney lot), located in Sections 10 and 15, T38N, R8E.
Purchase, placement and maintenance of waterway markers shall be as authorized by the Town Chairperson. All waterway markers shall comply with the Department of Natural Resources rules and regulations.
The Town of Lake Tomahawk shall place and maintain a copy or synopsis of this article at all public access points on North Two Lake pursuant to § NR 5.15, Wis. Adm. Code.
A. 
The Town Board adopts and authorizes the use of a citation to be issued for violations of this article. The form of a citation shall provide for those items listed in § 66.0113, Wis. Stats.
B. 
Wisconsin State boating penalties as found in § 30.80, Wis. Stats. and the schedule of cash deposits for violations of state boating and water safety regulations as provided by the State Revised Uniform Deposit and Bail Schedule for Conservation, Environmental Protection, Boating and DNR rules and regulations are adopted by reference, except that all references to fines are amended to forfeitures and references to imprisonment are deleted.
C. 
In addition to the deposit required above, the deposit shall include a penalty assessment if required by § 165.87, Wis. Stats., a jail assessment if required by § 53.46, Wis. Stats.,[1] and any applicable fees and court costs prescribed in Ch. 814, Wis. Stats.

D. 
Cash deposits are to be made with the Clerk of Circuit Court for Oneida County, and the Clerk shall give a receipt for any cash deposits that are made in person unless the deposit amount is mailed in, and, in that case, the canceled check shall serve as the receipt.

A. 
The provisions of this article shall apply to:
(1) 
Alva Lake and Birch Lake, border lakes, each of which has a portion of its shoreline in the Town of Cassian and the entire remainder of its shoreline in the Town of Lake Tomahawk; and
(2) 
Bearskin Lake, a border lake, the entirety of its shoreline contained within the Towns of Cassian, Hazelhurst and Lake Tomahawk.
B. 
This article shall be enforced by all officers of Lake Tomahawk and all other individuals empowered to enforce ordinances in this Town.
A. 
Prohibited equipment. No person may use or employ ballast tanks, ballast bags or fins to cause a boat to operate in a bow-high manner, or which increases or enhances a boat's wake.
B. 
Prohibited operation. No person may operate a boat in an artificially bow-high manner having the effect of increasing the boat's wake. Such prohibited operation shall include wake enhancement by use of ballast tanks, or ballast bags or fins, or continuous operation at transition speed (the speed below planing speed in which a boat is operating in plowing mode). For the purpose of this provision, "continuous operation" shall mean operation that is not acceleration for the purpose of achieving a state of planing.
C. 
Certain operations excluded. In no event shall any of the following operations be deemed a violation of this article, provided such operations do not use or employ ballast tanks, ballast bags or wake-enhancing fins:
(1) 
Water skiing;
(2) 
Tubing;
(3) 
Wake boarding employing a tow rope;
(4) 
Brief transition operation to empty a boat of bilge water; or
(5) 
Brief transition operation of a boat accelerating into a planing condition.
A. 
Wisconsin state boating penalties as found in § 30.80, Wis. Stats., and deposits established in the Uniform Deposit and Bail Schedule established by the Wisconsin Judicial Conferences, are hereby adopted by reference, except all references to fines are amended to forfeitures and all references to imprisonment are deleted.
B. 
To the extent that the penalty for any violation of this article is not provided under Wisconsin state boating penalties as found in § 30.80, Wis. Stats., any person violating this article shall forfeit $500 for the first offense and shall forfeit $1,000 for the second and subsequent offenses within one year. Deposits established in the Wisconsin Circuit Court Fee, Forfeiture, Fine and Surcharge Tables shall also apply to any violation.
Should any portion of this article or the affected Code section(s) be held invalid by a court of competent jurisdiction, the remainder shall not be affected.
Upon adoption, this article shall take effect the day after publication or posting and shall become effective for the affected lakes as follows:
A. 
For Alva Lake and Birch Lake: This article shall take effect upon the date on which both the Town of Cassian and the Town of Lake Tomahawk have enacted an ordinance covering Alva Lake and Birch Lake, the ordinances being identical as regards and §§ 160-10 through 160-12 above; and
B. 
For Bearskin Lake: This article shall take effect upon the date on which all three of the Town of Cassian, the Town of Hazelhurst and the Town of Lake Tomahawk have enacted an ordinance covering Bearskin Lake, the ordinances being identical as regards §§ 160-10 through 160-12 above.
