A. 
Whereas, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq., as amended and supplemented (the "Redevelopment Law"), provides a process for municipalities to participate in the redevelopment and improvement of areas designated by the municipality as areas in need of redevelopment and/or rehabilitation; and
B. 
Whereas, on June 17, 2003, the City enacted Resolution A-4359, which established Block 136, Lot 1, Block 136, Lot 1.01, Block 125.03, Lot 10, and Block 125.03, Lot 11, on the Tax Map of the City as an area in need of redevelopment (the "Redevelopment Area"); and
C. 
Whereas, on September 18, 2018, the City enacted Ordinance 18-09-04, establishing the James R. Hurley Industrial Park Redevelopment Plan (as amended from time to time, the "Redevelopment Plan") for the Redevelopment Area; and
D. 
Whereas, pursuant to the Redevelopment Law, the City prepared an amendment to the Redevelopment Plan dated August 2025 related to Block 136, Lot 1 (the "Amended Redevelopment Plan") attached hereto as Exhibit A;[1] and

E. 
Whereas, on September 2, 2025, the City enacted Resolution No. 242-2025, referring the Amended Redevelopment Plan to the Planning Board for its review and recommendation pursuant to the Redevelopment Law; and
F. 
Whereas, the Planning Board reviewed the Amended Redevelopment Plan at a duly noticed and constituted public meeting held on September 8, 2025; and
G. 
Whereas, after extensive discussions and testimony at its meeting on September 8, 2025, the Planning Board memorialized a Resolution dated September 8, 2025, which found that the Redevelopment Plan was "substantially consistent with the Master Plan of the City of Millville."
The Amended Redevelopment Plan, attached hereto as Exhibit A, is hereby adopted pursuant to the terms of the Redevelopment Law.
The Zoning District Map and the Zoning Ordinance of the City are hereby amended to incorporate and reflect the Amended Redevelopment Plan, and, to the extent provided in the Amended Redevelopment Plan, are superseded thereby.
If any part of this chapter shall be deemed invalid, such parts shall be severed and the invalidity thereby shall not affect the remaining parts of this chapter.
A copy of this chapter and the Amended Redevelopment Plan shall be available for public inspection at the office of the City Clerk during regular business hours.
