A.
Any drain or conveyance, whether on the surface or subsurface, that allows any non-stormwater discharge including sewage, process wastewater, and wash water to enter a regulated small MS4 or to enter the surface waters of this Commonwealth is prohibited.
B.
No person in the municipality shall allow or cause to allow stormwater discharges into the municipality's separate storm sewer system which are not composed entirely of stormwater except as provided in § 247-46C below or as allowed under a state or federal permit.
C.
Discharges that may be allowed based on the municipality finding that the discharge(s) do not significantly contribute pollution to surface waters of the commonwealth are listed below.
(1)
Discharges or flows from firefighting activities.
(2)
Discharges form potable water sources including water line flushing and fire hydrant flushing, if such discharges do not contain detectable concentrations of Total Residual Chlorine (TRC).
(3)
Non-contaminated irrigation drainage, water, water from lawn maintenance, landscape drainage and flows from riparian habitats and wetlands.
(4)
Routine external building washdown which does not use detergents or other compounds.
(5)
Non-contaminated HVAC condensation and water from geothermal systems.
(6)
Water from individual residential (i.e. not commercial) vehicle wash water where cleaning agents are not utilized, car washing.
(7)
Diverted stream flows and springs.
(8)
Dechlorinated swimming pool discharges.
(9)
Non-contaminated hydrostatic test water discharges, if such discharges do not contain detectable concentrations of TRC.
(10)
In the event that the municipality determines that any of the discharges identified in § 247-50 significantly contribute to pollution of waters of the commonwealth or is so notified by DEP, the municipality will notify the responsible person to cease the discharge.
(11)
Upon notice provided by the municipality under § 247-50, the discharger will have a reasonable time, as determined by the municipality, to cease the discharge consistent with the degree of pollution caused by the discharge.
(12)
Nothing in this section shall affect a discharger's responsibilities under state law.
