(A) 
Except in designated areas, it shall be unlawful for any person to camp in any public place.
(B) 
In this section, the term "public place" means an outdoor area to which the public has access and includes, but is not limited to, streets, highways, parks, parking lots, alleyways, pedestrian ways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, and shops.
(C) 
In this section, the term "camp" means to use a public place for living or sleeping accommodation purposes such as, but not limited to any of the following:
(1) 
Storing personal belongings;
(2) 
Making a campfire;
(3) 
Using any tent, shelter, furniture, box, refuse, vehicle, tarp or other structure for living accommodation;
(4) 
Carrying on cooking activities;
(5) 
Doing any digging or earth breaking; or
(6) 
Sleeping outdoors.
(D) 
The activities listed in division (C) above shall constitute camping when it reasonably appears, in light of all the circumstances, that the participants, in conducting these activities, are in fact using the area for living accommodation purposes regardless of the intent of the participants or the nature of any other activities in which they may also be engaging.
(E) 
It shall be an affirmative defense to prosecution that a person is the person who owns the property or has secured the permission of the property owner to camp in a public area.
(F) 
This section does not apply to camping or cooking in a city park in compliance with park regulations.

(A) 
For the purposes of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
AGGRESSIVE MANNER.
(1) 
Intentionally or recklessly making any physical contact with or touching another person in the course of the solicitation without the person’s consent;
(2) 
Following the person being solicited, if that conduct is:
(a) 
Intended to or likely to cause a reasonable person to fear imminent bodily harm or the commission of a criminal act upon property in the person’s possession; or
(b) 
Intended to or reasonably likely to intimidate the person being solicited into responding affirmatively to the solicitation;
(3) 
Continuing to solicit a person within five feet of the person being solicited after the person has made a negative response;
(4) 
Intentionally or recklessly blocking the safe or free passage of the person being solicited or requiring the person, or the driver of a vehicle, to take evasive action to avoid physical contact with the person making the solicitation;
(5) 
Using obscene or abusive language or gestures toward the person being solicited;
(6) 
Approaching the person being solicited in a manner that:
(a) 
Is intended to or is likely to cause a reasonable person to fear imminent bodily harm or the commission of a criminal act upon property in the person’ possession; or
(b) 
Is intended to or is reasonably likely to intimidate the person being solicited into responding affirmatively to the solicitation.
AUTOMATED TELLER FACILITY.
The area comprised of one or more automatic teller machines, and any adjacent space that is made available to banking customers.
AUTOMATED TELLER MACHINE.
A device, linked to a bank’s account records, which is able to carry out banking transactions.
BANK.
Includes a bank, savings bank, savings and loan association, credit union, trust company, or similar financial institution.
BUS.
A vehicle operated by a transit authority for public transportation.
CHECK CASHING BUSINESS.
A person in the business of cashing checks, drafts, or money orders for consideration.
MEDIAN.
That area of a divided street, road or highway within the city separating lanes of traffic of said street, road or highway. A "median" may be raised, depressed or flush with the road surface. The term includes the curb, if any, at edge of the area.
PUBLIC AREA.
An outdoor area to which the public has access and includes, but is not limited to, a sidewalk, street, highway, park, parking lot, alley way, pedestrian way, or the common area of a school, hospital, apartment house, office building, transport facility, or shop.
SOLICIT.
To request, by the spoken, written, or printed word, or by other means of communication (1) a donation or transfer of money or another thing of value from another person, regardless of the solicitor’s purpose or intended use of the money or other thing of value, and regardless of whether consideration is offered, or (2) support of a cause, project or program.
(B) 
A person commits an offense if the person solicits:
(1) 
In an aggressive manner in a public area;
(2) 
On, in or from the median of a divided street, road or highway;
(3) 
Within 25 feet of:
(a) 
An automated teller facility;
(b) 
The entrance or exit of a bank;
(c) 
The entrance or exit of a check cashing business; or
(d) 
The entrance or exit of a restaurant or food service establishment or the service area of an outdoor eating establishment.
(4) 
At a marked crosswalk;
(5) 
On either side of the street on a block where a school attended by minors, or a childcare facility has an entrance or exit;
(6) 
Within the boundaries of the city between 7:00 p.m. and 9:00 a.m.
(C) 
A culpable mental state is not required, and need not be proved, for an offense under this division.
(D) 
A person commits an offense if the person solicits contributions between 7:00 p.m. and 9:00 a.m. by going to the door of a residence. Solicitation at a residence is prohibited if such residence displays a “No solicitation” or similar sign.
(E) 
This section is not intended to proscribe a demand for payment for services rendered or goods delivered.

(A) 
A person commits an offense if the person urinates or defecates:
(1) 
In or on a public street, alley, sidewalk, yard, park, building, structure, plaza, or utility right-of-way or other public place; or
(2) 
In public view.
(B) 
It is an affirmative defense to prosecution under this section if the person is in a restroom.

(A) 
A person commits an offense if, after having been notified by a law enforcement officer that the conduct violates this section, the person continues to sit or lie down in the right-of-way between a roadway and the abutting property line or structure, in a manner that would:
(1) 
Hinder the unobstructed passage of a person;
(2) 
Require a person to take evasive action to avoid physical contact;
(3) 
Block the passage of a person entering or leaving a building; or
(4) 
Require a person entering or leaving a building to take evasive action to avoid physical contact.
(B) 
This section does not apply to a person who:
(1) 
Sits or lies down because of a medical emergency;
(2) 
As the result of a disability, uses a wheelchair or similar device to move about;
(3) 
Operates or patronizes a commercial establishment that conducts business on the sidewalk in compliance with the ordinances of the city;
(4) 
Participates in or views a parade, festival, performance, rally, demonstration, or similar event;
(5) 
Sits on a chair or bench that is supplied by a public agency or by the abutting private property owner; or
(6) 
Sits within a bus stop zone while waiting for public or private transportation.
(C) 
Culpable mental state is not required, and need not be proven, for an offense under this section.

(A) 
It shall be unlawful for any person to intentionally break or cause to be broken, any glass, window, sash, blind, door, gate or fence, or in any manner to mar, deface or injure any house, building or other property on premises within the city, not his or her own.
(B) 
It shall be unlawful for any person to intentionally:
(1) 
Injure, remove, destroy, deface or interfere with any fence, wall, gate or turnstile bounding or enclosing any park, square, schoolhouse or other public building; or
(2) 
Remove, injure, mar or deface any street sign, traffic signal controller box, signal pole, street or sidewalk attached emblem, marker, raised button divider, street and sidewalk painted logo, or painted sign, lane divider other traffic aid marker, or any public or private building or other property to include public utilities.

(A) 
It shall be unlawful for any person to deposit or discharge, or cause the deposit or discharge, of paper, glass, metal, litter, rubbish, waste, garbage, refuse or trash of any description on or in the right-of-way between a roadway and the abutting property line, except in receptacles provided for that purpose.

Any violation of any provision of this chapter is punishable in accordance with the general penalty provisions of § 10.99 of this code of ordinances.
