The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.

A. 
There shall be no parking, stopping or standing within 30 feet of every intersection throughout the City of Beacon. The Traffic Safety Committee shall be authorized to recommend to the City Council the appropriate location of signage at each intersection. The City Council shall review the recommendation of the Traffic Safety Committee and authorize the Street Superintendent to erect the necessary signage not to exceed the distance of 30 feet from said intersection. The provisions of this section shall be effective upon the posting of the appropriate signage by the Street Superintendent pursuant to §§ 1680 and 1683 of the Vehicle and Traffic Law.
B.

A. 
The following rules are hereby enacted to apply at the Municipal Center:
(1) 
Parking shall be allowed in designated spaces only and is limited to four hours except for employees of the City of Beacon.
(2) 
The four reserved, sign-posted spaces marked "Reserved Parking - Tow Away Zone" are hereby reserved for use as assigned by the City Administrator. Any vehicle parked without authorization in any of the marked parking spaces shall be towed at the vehicle owner's expense. The towing expenses shall be in addition to the penalties contained in § 211-20.
(3) 
The spaces marked "Two hour parking" shall be enforced so that any vehicle parked in said space for more than two hours shall be subject to the penalties in § 211-20.
B. 
The following rules are hereby enacted to apply at the Recreation Center:
(1) 
Parking shall be allowed for Recreation Center business only.
(2) 
It shall be unlawful to park any vehicle overnight at the Recreation Center except for employees of the City of Beacon and other authorized vehicles.
(3) 
Any vehicle in violation of this subsection shall be subject to the penalties contained in § 211-20.

A.

No person shall park in a parking space in any location set forth at § 211-17.1 of this chapter or as indicated by signage identifying the parking space as handicapped parking in any municipal parking lot, public right-of-way, public property or other location where there is signage restricting the parking space to handicapped parking.

A. 
No commercial vehicles as set forth in § 211-13.1 having a total gross weight in excess of 10,000 pounds shall park on private property in a residential district.

B. 
It shall be unlawful to leave any trailer of a tractor-trailer unit unattended on any public street or any public parking lot in the City of Beacon, except as allowed by temporary permit for a special event.
C. 
For the purpose of this section, "commercial vehicles" shall include tractors, road tractor-trailers, rollers, tractor and truck cranes, power shovels, road-building machines, snow plows having a total gross weight in excess of 10,000 pounds, road sweepers, sand spreaders, tank trailers, and buses and any other vehicles used for commercial purposes as described in Subsection A above.
D. 
A violation of this section shall constitute an offense and shall be punishable by a fine not to exceed $250 and/or 15 days in jail. The Police Department is authorized to remove said vehicle from the City street or public parking lot at the expense of the registered owner of said vehicle. Each day said violation occurs shall constitute a separate offense.

A. 
It is unlawful to park any commercial vehicle or recreational vehicle overnight on any public street or in any municipal parking lot in the City of Beacon unless a permit is first obtained from the City Administrator, or his or her designee. For purposes of this section, "commercial vehicle" shall have the same meaning as in § 211-15.1 of this chapter. This section shall not apply to:
(1) 
Any police, fire or emergency service vehicle;
(2) 
Any vehicle owned by the City;
(3) 
Any vehicle owned by an entity engaged in repairs to City improvements, such as streets, sidewalks, parking lots or utilities;
(4) 
Any commercial vehicle which is engaged in the process of picking up or delivering merchandise or other property, provided such pickup or delivery is being performed at hours permitted by the City Code; or
(5) 
The temporary parking of any vehicle on a City street or in a municipal lot for no longer than two nights while the driveway where said vehicle is normally parked is being repaved.
B. 
The definition of "recreational vehicle" shall include, but is not limited to, RVs, trailers, mobile homes, all-terrain vehicles and boats. The City Administrator shall prescribe the duration for each permit issued pursuant to this section, taking into account the physical layout and typical level of traffic at the proposed location in addition to any other factors relevant to the application. A first offense of this section shall result in a written warning affixed to the offending vehicle, which shall include the following statement: "A permit is required to park any commercial or recreational vehicle overnight on a City street or in a municipal parking lot in the City of Beacon. The application for a permit is available in the office of the City Administrator, One Municipal Plaza, Beacon, New York." A summons shall be issued for a second and all subsequent violations of this section.
A. 
It shall be unlawful to place, park or leave any automobile, truck or other vehicle on any public road or street within the corporate limits of the City of Beacon after any fall or accumulation of snow of two or more inches, between the hours of 9:00 p.m. and 7:00 a.m. or when parking on said public road or street obstructs the removal of snow, unless such vehicle is at all times attended by a person legally capable of operating said vehicle. All vehicles left parked in violation of this section may be removed at the owner’s expense. There shall be no parking in municipal lots within 24 hours of posting of same by the City Administrator. The violation of this provision shall constitute a violation and shall be punishable by a fine of $100 for the first offense and $250 for the second and subsequent offenses committed within 18 months of the first offense.

B. 
No person shall park a vehicle between the hours specified in Schedule XI below of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XI.
C.

A. 
There shall be no parking of automobiles or other vehicles in the following no-parking zones:
(1) 
Within 10 feet of a fire hydrant.
(2) 
In front of any public or private driveway.
(3) 
On a crossing or extended beyond the building line at a crossing.
(4) 
On any bridge or elevated structure or within a highway tunnel.
(5) 
On a roadway side of any vehicle stopped or parked at the curb or street (double parking).
B. 
There shall be no parking of automobiles or other vehicles in Henry Street Parking Lot No. 1, located at the intersection of Henry Street and South Chestnut Street, on Sundays between April 1 and November 30 during the hours of 6:00 a.m. through 5:00 p.m. Unauthorized vehicles may be ticketed and/or removed by order of the Beacon City Police Department.
C. 
There shall be no parking of automobiles or other vehicles in the Beacon Center Lot, located at the intersection of Main Street and South Elm Street, on Sundays between 8:00 a.m. and 4:00 p.m. This restriction shall not apply to permittees expressly authorized to park in said lot by Dutchess County, all other vehicles may be ticketed and/or removed by order of the Beacon City Police Department.
D. 
The penalty for violating the provisions of § 211-16 or 211-16.1 shall be as set forth in § 211- 20.

It shall be unlawful for any person to blow or place snow or ice onto City of Beacon public streets or roads by mechanical or physical means. The violation of this provision shall constitute a violation and shall be punishable by a fine of $100 for the first offense and $250 for the second and subsequent offenses committed within 18 months of the first offense.

A. 
Clear, unobstructed roadways shall be maintained in areas established by the Building Inspector and/or Fire Chief or their designated representatives in areas necessary for access to places of public assembly, structures of public access, office buildings and parking lots of 10 or more spaces and residential subdivisions of 10 or more units of housing, or as may be additionally required by the Planning Board's site plan approval. Such roadways shall be designated as "fire lanes" by the Building Inspector and/or the Fire Chief or their designated representatives.
B. 
Types of fire lanes.
(1) 
Fire Lane A: Emergency access area, located in the immediate vicinity of structures and fire hydrants for emergency vehicle use only.
(2) 
Fire Lane B: Emergency routes, streets, roads or driveways on private property customarily used by emergency apparatus that lead to emergency vehicle access areas and fire hydrants.
C. 
Markings.
(1) 
Fire Lane A:
(a) 
Curb side and top shall be painted traffic yellow and paved area crosshatched out four feet from curbs. Crosshatching shall have six-inch-wide lines at an angle of 45° to the curb extending outward in the direction of oncoming traffic. Lines shall be two feet apart.
(b) 
Standard NO PARKING-FIRE LANE signs shall be placed every 50 feet. They shall be no more than two feet from the curb and no lower than six feet and no higher than eight feet from the street grade to the bottom edge of the sign. Signs should be at an angle of 30° to 45° to oncoming traffic, where practicable.
(2) 
Fire Lane B:
(a) 
Designated emergency route. Curb side and top shall be painted traffic yellow on the side of the street leading to the structure and Fire Lane A.
(b) 
Standard NO PARKING-FIRE LANE signs shall be placed every 100 feet. Signs shall be no lower than six feet and no higher than eight feet from the street grade to the bottom edge of the sign.
D. 
Signage. In residential areas, designated Fire Lane B signs spaced every 50 feet to 75 feet can be substituted for yellow curbs with the written approval of the Building Inspector and/or Fire Chief.
E. 
Modifications. The Building Inspector, or their designated representative, after consultation with the Fire Chief, shall have the right to modify all the requirements set forth in Subsection B and the painting and crosshatching requirements set forth in Subsection C herein and/or substitute therefor alternative markings and designation requirements for curbs and pavement in fire lanes and/or on emergency routes. Said modifications shall be made in the exercise of the Building Inspector's discretion, on a case-by-case basis, when such modifications are deemed appropriate for the particular facts and circumstances. Any such modifications shall be established in writing by the Building Inspector and shall be applicable only to the particular premises, lot, or building as set forth in the written modification. The Building Inspector, or designee, may, in writing, further amend or terminate such modifications.
F. 
Compliance. Any individual or company who owns or manages a place of public assembly or public access or an office building shall complete the markings required herein within 15 days of receiving written notice of the designated fire lanes from the Building Inspector and/or the Fire Chief or their designated representatives and shall be required to keep and maintain the designated roadways and fire lanes free and clear from any obstructions, including, but not limited to, motor vehicles.
G. 
Penalties.
(1) 
Parking in a fire lane shall be a violation of this section and shall be punishable by a fine not to exceed $250 per offense or by imprisonment not to exceed 15 days, or both. Officers of the City of Beacon Police Department and City of Beacon Code Enforcement Officers are authorized to issue appearance tickets for the unlawful parking, stopping, or standing of vehicles within the boundaries of fire lanes.
(2) 
Any individual or company who owns or manages a place of public assembly or public access or an office building who fails to keep appropriate markings on the designated fire lanes or who fails to keep and maintain the designated roadways and fire lanes free and clear from any obstructions, including but not limited to motor vehicles, shall be guilty of a violation of this section and subject to the general penalty per § 1-3A of this Code, for each and every day which the fire lanes remain unmarked or obstructed.
A. 
No person shall park a vehicle for longer than the time limit shown in Schedule XII below at any time between the hours listed in said Schedule XII of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XII.
B.

No person shall park any vehicle on any public street, public highway, or any property owned by, leased by, or in the possession and control, of the City of Beacon except in designated parking spaces and within the painted lines indicating where such vehicle shall be parked. No person shall park a vehicle as to occupy or use more than one such marked parking space.
A.

In an emergency and when necessary to maintain orderly traffic, the Chief of Police is hereby authorized to designate additional no-parking zones for the duration of such emergency, but no longer than one day; such period may be extended upon written approval of the Administrator. B. 
In the event that the Administrator or, in his/her absence, the Mayor, shall deem that the public health and safety, or either of them, are endangered by accumulations of snow on the public streets and highways of the City, he or she may, by written proclamation, declare that snow parking restrictions are in effect and he or she may order that all motor vehicles be removed by the owners or operators thereof from such streets and highways or from such of the streets and highways as he or she may specify by proclamation, on or before a time to be specified by him or her in such proclamation, but not less than one hour from the public promulgation thereof.

C. 
Such proclamation shall be promulgated by such means as the Administrator or, in his/her absence, the Mayor, in his or her absolute discretion, may deem to be most effective in apprising the owners and operators of such motor vehicles of such proclamation. When the Administrator or, in his/her absence, the Mayor, shall deem that such snow parking restrictions are no longer in effect, he or she shall forthwith promulgate a proclamation declaring the same to be terminated, which proclamation shall be promulgated by such means as the Administrator or, in his/her absence, the Mayor, in his or her absolute discretion, may deem advisable.

D. 
The Administrator or, in his/her absence, the Mayor is hereby authorized and empowered during the period when snow parking restrictions are in effect to make and enforce such rules and regulations as he or she may deem advisable to regulate, prohibit, limit and control the movement, parking and stopping of all motor vehicles on any and all of the streets and highways of the City. Such rules and regulations shall remain in effect only during the period when snow parking restrictions are in effect, and they shall terminate immediately upon the promulgation of the Administrator's or, in his/her absence, the Mayor's proclamation declaring the termination of such snow parking restrictions.

E. 
It shall be unlawful for any person to park, stop or leave standing or to operate any vehicle on any street of the City in violation of the Administrator's proclamation or in violation of any of the rules and regulations of the Administrator or to permit any person under his control to do so.
F. 
In the event that any motor vehicle shall be left parked or standing on any of such public streets and highways in violation of such proclamation, rules and regulations, a police officer may cause the motor vehicle to be removed from such streets and highways and the cost of such removal, as set forth in the towing contract effective at the time of the removal, shall be a charge against the owner of such motor vehicle, to be paid to the City Clerk at the time of delivery of such motor vehicle to the owner thereof.

The Building Department may issue up to three parking permits in conjunction with the issuance of a building permit for the construction/renovation of a building in order to allow vehicles needed for the construction of said building to park in the vicinity of said building and not be subject to time limit parking.

The public shall be permitted to park passenger vehicles in reserved employee parking spaces only between 6:00 p.m. to 6:00 a.m. Monday through Friday, and at all times on Saturday and on holidays recognized by Dutchess County, however, public parking on Sundays shall be further subject to the regulations of § 211-16.1C.
B. 
Public parking in non-employee parking spaces shall not exceed two hours between the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday, excluding holidays recognized by Dutchess County.
C. 
Only electric vehicles may park or stand in the parking spaces specifically designated for electric vehicle charging. Electric vehicles shall only utilize the parking spaces specifically designated for electric vehicle charging while actually charging such vehicle. Parking or standing in electric vehicle parking spaces shall not exceed four hours.
D. 
The restrictions of § 211-15C concerning parking in handicap spaces shall apply to the Beacon Center Lot.
E. 
The restrictions of § 211-15.1 concerning parking of commercial vehicles shall apply to the Beacon Center Lot, excluding vehicles owned by or authorized by Dutchess County.
F. 
The restrictions of § 211-16A concerning the parking of vehicles when no parking signs are posted in municipal lots shall apply to the Beacon Center Lot, excluding vehicles owned by or authorized by Dutchess County.
G. 
The restrictions of § 211-16.1 concerning no parking zones shall apply to the Beacon Center Lot.
H. 
The restrictions of § 211-19.5 concerning a twenty-four-hour maximum parking limit shall apply to the Beacon Center Lot, excluding vehicles owned by or authorized by Dutchess County.
I. 
The restrictions of this section shall not apply to vehicles or persons expressly authorized by the City of Beacon or Dutchess County to park in the Beacon Center Lot provided that the vehicle is parked in accordance with such authorization.
J. 
Any vehicle found in violation of this section shall be subject to the penalties set forth in § 211-20.
