In conjunction with the approval of a residential development project or subdivision, the establishment of a landscaping and lighting maintenance district or community facilities district shall be required to provide funding for the development's proportionate share of the cost of the maintenance of the neighborhood park that serves or is planned to serve the subject area.
A.
The decision maker may approve an exception to the requirement for maintenance of public parks for a residential development project or subdivision which is permanently restricted to occupancy by senior citizens subject to the following findings:
1.
That there are no public park facilities existing or planned to serve the area of the subject development project or subdivision.
2.
That the project incorporates private recreational facilities that functionally serve the need for recreational facilities within the development project or subdivision.
