The purpose of these provisions is to establish the criteria, define the permissible locations, and identify the acceptable sponsors for advertisements on Township property and in Township facilities as a revenue-generating measure.
A. 
Advertisements on Township-owned property and facilities are authorized pursuant to the terms of this chapter and as authorized by state law and regulations, including, but not limited to, N.J.S.A. 40A:12-1, et seq.
B. 
Advertisements shall be permitted at locations and facilities at the Township's election by a designee appointed by the Mayor and Commissioners by resolution.
A. 
All advertisers shall file an application for the advertisement on a form approved by the Municipal Clerk and require sufficient information for review of the proposed advertisement for compliance with this chapter.
B. 
The scope and nature of the advertisement, including, but not limited to, the type, size, and frequency, shall be set by the designee and set forth in the application. The size, content, and format of the advertisement must be approved by the designee or his/her designee.
C. 
All advertisements accepted or approved must satisfy the following criteria.
(1) 
No advertisement may promote or reference any cannabis or tobacco products.
(2) 
No advertisement may promote activities or conduct that is violent, criminal, or otherwise illegal.
(3) 
No advertisement may express or depict language, gestures, conduct, or graphical representations that are obscene, pornographic, vulgar, profane, or scatological.
(4) 
No advertisement may express or advocate a message that is clearly defamatory, slanderous, or likely to scorn or ridicule certain individuals or groups.
(5) 
No advertisement may promote or reference the sale or use of guns or other weapons.
(6) 
No advertisement may advocate political parties or the election or reelection of any candidates for public office.
(7) 
No advertisement may express or advocate an opinion, position, or viewpoint on matters of public debate on social or religious issues. No advertisement may engage in religious proselytizing; however, advertisements promoting the secular educational, humanitarian, charitable, and social welfare activities and programs of churches and other religiously affiliated institutions are permitted.
(8) 
No advertisement may interfere with or detract from the general public's enjoyment of, or the activities taking place in, the permitted location.
(9) 
No advertisement may compromise the health, safety, and welfare of the public.
(10) 
No advertisement may jeopardize the security, safety, comfort, or convenience of operations.
(11) 
No advertisement may express message that is demeaning, disparaging, or threatening.
(12) 
No advertisement may express or depict a message, slogan, or graphical representation that is trademarked, copyrighted, or constitutes other protected intellectual property unless authorized by the legal owner thereof.
(13) 
The size, content, and format of all advertisements must conform with all applicable federal, state, and local laws and regulations.
A. 
The Township shall publicly advertise the locations offered for advertising on its website and by at least one advertisement in the official newspaper.
B. 
The Township shall set the price for each advertisement pursuant to N.J.A.C. 5:34- 9.4 or by resolution in accordance with applicable law.
C. 
The application shall be reviewed and approved or rejected by the designee. In the event of a rejection, the applicant may appeal to the Board of Commissioners, which appeal shall be made within 10 days of the date of the rejected application. The Board of Commissioners shall consider the appeal at the next scheduled regular meeting.
A. 
The terms of the advertisements at each location shall be set by resolution. If no resolution is adopted which sets forth the aforesaid terms, the terms shall be for a period including the remainder of the calendar year in which the application is approved and the following calendar year.
B. 
The Township reserves the sole and exclusive right to remove any advertisement without refund. The advertisement may be removed by resolution or at the discretion of the designee.
