In situations where physical conditions render full compliance with the provisions of this title impracticable, the city may issue a special permit for installation of a side sewer requiring compliance with special provisions insofar as reasonably possible; however, such permit shall be issued only upon the condition that the property owner execute and deliver to the city an instrument, in the form furnished by or acceptable to the city, whereby the owner agrees to indemnify and hold the city harmless for any damage or injury resulting from such installation or construction.
