The Town hereby adopts its Engineering Design Standards, as may be amended from time to time, and said Engineering Design Standards dated, as amended, is hereby adopted as the engineering standards governing plans and specifications for improvement upon subdivisions of land within the jurisdiction of the Town. A true and correct copy of the Engineering Design Standards adopted by this section 10.05.001 is on file in the Town offices. Copies of the Engineering Design Standards and the Construction Standards may be acquired, upon payment of any fee(s) established therefor, from the Town.

(a) 
The Town Administrator, in consultation with the Town Engineer, may from time to time make amendments to the Engineering Design Standards to address technological advances, changes and improvements to sound engineering practices, and to conform to applicable best management practices. Any and all such amendments to the Engineering Design Standards shall be enforced as if included in and adopted with the original adoption of this Subdivision Ordinance and from time to time may be submitted to the Town Council for ratification and approval.
(b) 
The fact that any part or portion of the Engineering Design Standards has been revised or amended under this section shall not affect any other portion or provision of the Engineering Design Standards. Any challenge to any amendment shall be raised promptly by the party challenging such amendment at which time the amendment in question shall be presented to the Town Council for its review and consideration and, if appropriate, ratification and approval. Any such ratification and approval shall relate back to the date of the amendment or other modification and shall be as binding as if initially adopted by the Town Council on such date.

(a) 
All platted lots within the Town or its extraterritorial jurisdiction shall have frontage on a public street, private driveway to a public street or a private street constructed to Town standards.
(b) 
All frontages on a public street shall have a minimum width as prescribed by the Town's Zoning Ordinance, Exhibit 14A, unless waived by Town Council.

(a) 
Property owners extending power lines from a principal dwelling to an accessory structure located on the same lot, may do so by using a separate instrument without the need to plat or replat the property. The accessory structure must be legally permitted and serve a function ancillary to the primary residence and the proposed structure complies with Sections 4-103 and 4-104 of the Zoning Ordinance (Exhibit 14A) of the Town of Copper Canyon regarding Accessory Buildings, as that section may be amended.
(b) 
Unplatted property that is five acres or more in size is not subject to the platting requirement solely for the purpose of constructing a driveway access to serve four or fewer dwelling units. Prior to the issuance of any building permit for such property, the proposed driveway design must be reviewed and approved by the Town Engineer and shall comply with all applicable Town engineering design standards.
(c) 
When plat approval with the dedication of public easements is required for development under this Ordinance, all existing on-site overhead utilities, save and except transmission facilities as identified by a utility company, and all new on-site utility extensions shall be placed underground in conjunction with the development or redevelopment of any property, subject to the following provisions:
(1) 
Each of the utility companies shall be responsible for developing administrative policies and cost reimbursement procedures for the installation and extension of their utilities. Nothing in this section shall prohibit or restrict any utility company from recovering the difference in cost of overhead facilities and underground facilities in accordance with the provisions of such utility company's approved tariff. No utility company shall be required to begin construction of underground facilities unless and until the customer, owner, developer, and/or party requesting such facilities has made arrangements satisfactory to the specific utility company for the payment of such difference between the cost of overhead utilities and underground facilities.
(2) 
In those cases where temporary overhead service is necessary (e.g., emergency repairs, construction field offices, etc.) these installations shall not be in service for a period exceeding six months.
(3) 
Waivers or exceptions to the standards contained in this section may be granted by the Town Council upon request of the owner, developer, or subdivider, pursuant to section 10.06.001 of this Subdivision Ordinance.
