It shall be unlawful for an owner or property agent of a dwelling unit to allow occupancy of such dwelling unit in excess of two persons per bedroom.

For purposes of this article, the following terms shall have the definitions indicated:
BEDROOM
Means any habitable room or enclosed floor space within a dwelling unit which is regularly used for sleeping purposes, having at least 70 square feet and one window facing directly to the outdoors, and otherwise in compliance with the applicable Building Code, but not including:
(a) 
A room or enclosed floor space used for eating, dining, cooking, congregating or entertaining; or
(b) 
An accessory room or space such as a foyer, hall, pantry, closet, laundry room, utility room, or bathroom.
DWELLING UNIT
Shall have the meaning assigned to such term in the City's Zoning Ordinance.
OCCUPANCY
Means living or sleeping in a dwelling unit.
OWNER
Means any person or entity who or which, alone or jointly with others, has a legal or equitable title to any dwelling unit or to the real estate upon which such dwelling unit is located, with or without the right to immediate possession, or who or which has the right to possession as a tenant of such owner. The term "owner" includes but is not limited to a person or entity who or which holds a fee simple interest, a life estate, a remainder interest, or a reversionary interest, and shall include individuals acting under a "rent to own" contract. Related terms including "own" and "owning" shall have meanings consistent with this definition.
PROPERTY AGENT
Means a person or entity acting on behalf of the owner of a dwelling unit, or the real estate upon which a dwelling unit is located, to manage or otherwise control the occupancy of the dwelling unit.

Whenever the Building Inspector, through third party complaint, personal inspection or other source, has reasonable grounds to believe that a violation of the maximum occupancy restriction exists, he or she may request that the owner or property agent of any dwelling unit submit to him or her the names, ages, and relationships of all persons occupying the property.

Any person or entity in violation of § 14-31 hereof shall be guilty of a misdemeanor punishable as provided in § 1-8 of this Code. Each day a violation continues after the date specified in the notice of violation shall constitute a separate offense.
