The land divider shall construct or agree to construct all of the improvements as specified in this title and such other structures or improvements as may be required by ordinance or deemed by the city to be necessary for the use of the general public, owners in the land division, and local neighborhood. No certificate of use and occupancy will be issued on any structure until all required improvements have been completed or a guarantee has been received by the city for all off-site improvements:
(1)
All of the required fees shall be paid and all of the required improvements shall be constructed or an agreement, along with the appropriate security, shall be entered into with the city for their construction prior to the recordation of the tract map.
(2)
All of the required fees shall be paid prior to the recordation of parcel map. All of the required improvements, within or adjacent to each lot or parcel of the minor land division, shall be constructed as a requirement of the building permit for that lot or parcel.
The city council reserves the right to require a portion or all of the required improvements to be constructed or an agreement, along with the appropriate security, shall be entered into with the city for their construction prior to the recordation of the parcel map.
