A minor between the age of ten (10) and seventeen (17) years of age who exercises treaty fishing rights for commercial purposes unaccompanied by an adult member of the Tribe is guilty of a class D offense.
If a minor under ten (10) years of age exercises treaty fishing rights for commercial or subsistence purposes unaccompanied by an adult member of the Tribe, the parent or guardian of that minor is guilty of a class D offense.
This prohibition does not apply to:
(1)
A minor determined to be a head of household by the Fisheries Committee determined prior to the minor fishing; or
(2)
A minor who has been exempted from this section by the Fisheries Committee prior to the minor fishing due to extreme hardship.
(Res. 94 A 109, 7/12/1994; Res. 15-A-167, 12/9/2015 changed this Section to give the violation to the parent of guardian if the minor is under 10 years old.)
