Any person who fishes with a set net that is not:
(1)
Conspicuously marked at the outermost (seaward) ends with the Tribal Identification Card number of the fisherman operating the gear; and
(2)
Marked in such a way that the fisherman and the tribal affiliation can be identified without removing the gear from the water,
is guilty of a class C offense.
