The ordinance codified in this chapter shall be known as the transfer station ordinance of the city.

The purpose of this chapter is to regulate and provide for the proper use of the city transfer station which may be used by the residents of the city for the proper disposal of trash, garbage and brush; to establish fees for its usage; and to establish an expiration date.

The following definitions shall apply throughout this chapter:
"Brush"
means tree limbs, branches, leaves, shrubs, bushes, or parts thereof, grasses, and other such yard debris.
"Hazardous material"
means those substances defined as such by the Environmental Protection Agency and/or the Washington State Department of Ecology.
"Load"
means a single truck bed, trailer or other such vehicle used to haul brush or garbage to the transfer station. A truck with garbage or brush in its bed pulling a trailer containing garbage or brush would constitute two loads.
"Refrigeration unit"
means any equipment, appliance or machinery which contains freon or other similar coolants or chemicals.
"Resident"
means any person lawfully residing within the city limits of the city of Prosser who can provide proof of the same with utility bills and picture identification.

The following fees shall be collected by the city for use of the transfer station:
A. 
Any resident desiring to dispose of brush at the city transfer station shall pay ten dollars for the first two cubic yards of brush and five dollars for each additional two cubic yards of brush in each load.
B. 
Any resident desiring to dispose of all other garbage, except for brush and refrigeration units, shall pay ten dollars for the first one hundred pounds of garbage and five dollars for each additional one hundred pounds of garbage in each load.
C. 
Any resident desiring to dispose of refrigeration equipment shall pay fifty dollars for each refrigeration unit.

The city employee operating the transfer station shall determine the weight or volume of each load by estimating the same. Should such employee be unable to make a fair estimate of weight, such employee may require the resident to have the load weighed at a state certified scale at the cost of the resident. Should the resident disagree with the estimate of the city employee, the resident may have the load weighed at state certified scale at the resident's expense and bring proof of the same to the city employee.

The city has the right to refuse acceptance of any garbage, brush or other such material, in its sole discretion, based upon but not limited to concerns of the city regarding hazardous material, size, availability of space, concrete or other inert waste, tires, damage to property, difficulty in handling or containing material, or other such reasonable concerns.
