There is adopted and by this reference made a part of this chapter as though fully set forth herein at length that certain code, known as the International Building Code, 2018 Edition, including the Appendix Chapters E, F, G, I and J therein and together with Chapter 11 amendments entitled "Washington State Accessibility Regulations," and the International Residential Code, 2018 Edition, excluding Chapter 11 and excluding Chapters 25 through 42, which are not adopted, including Appendices A, B, C, D, G, H, J, K and L, as the building code and standards of the city.

There is adopted by reference and made part of this chapter as though fully set forth at length, the 2018 Edition of the NFPA 1, Fire Code of the National Fire Protection Association, commonly known as the NFPA 1. Fees for inspections under NFPA 1 may be charged by the city.

The International Fire Code (IFC) as published by the International Code Council as adopted by RCW 19.27.031 and as amended by Chapter 51-54A WAC and as it may be hereafter amended by the state is hereby adopted by reference; provided, that notwithstanding any wording in this code, participants in religious ceremonies shall not be precluded from carrying hand-held candles. Finally, such adoption shall include Appendices A, B, C, D, E, F, and G. The fire code official shall be the city's building official or his or her designee. In addition to the amendments below, the IFC is amended in accordance with the provisions of Chapter 8.20.

The codes adopted in Sections 15.04.010 through 15.04.070 are hereby amended by the following additions, deletions, and exceptions. Section numbers referenced herein are to the codes as adopted by this chapter. Notwithstanding these section numbers referenced from the current codes, all additions, deletions, and exceptions as noted herein shall apply to all future codes adopted by the state of Washington and thence adopted as the building codes of the city of Prosser.
Section 101.1 (IBC) Section R101.1 (IRC) Section 101.1 (IFC)—Title.
These regulations shall be known as the Fire Code of the City of Prosser, hereinafter referred to as "this code."
A.
Wherever the word "jurisdiction" is used in the International Fire Code, it means the City of Prosser.
B.
Wherever the term "corporate counsel" is used in the International Fire Code, it means the attorney for the city.
C.
"Fire Chief," for the purpose of Section 104.11, means the fire chief of the fire jurisdiction serving the City. For all other purposes in the code, "fire chief" means the fire code official.
Section 103.1 (IBC) R103.1 (IRC) Section 103.1 (IFC)—General.
The department of fire prevention, also known as the Building Department, is established within the jurisdiction under the direction of the fire code official. The function of the department shall be the implementation, administration and enforcement of the provisions of this code.
Section 105.1.1(IBC) Section 105.1.6 (IFC)—Annual Permit. Delete this entire subsection. Annual permits shall not be issued in the city of Prosser.
Section 105.1.2(IBC) Section 105.1.6.1 (IFC)—Annual Permit Records. Delete this entire subsection. Annual permit records shall not be valid within the city of Prosser.
Section 105.2(IBC) and R105.2 (IRC). Sections (1) and (2) shall be deleted in their entirety. Fences built in the city of Prosser shall require a building permit. One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided that the floor area is not greater than 200 square feet (18.59 m2).
Electrical. This entire subcategory, including repairs and maintenance, radio and television transmitting devices, and temporary testing systems, is hereby deleted. All electrical permits and permit exemptions shall be as set forth by the state of Washington Department of Labor and Industries.
Plumbing. Items (1) and (2) of this subcategory are hereby deleted. All plumbing permits and plumbing permit exemptions shall be as set forth in the adopted plumbing code.
Section 107.1 (IBC) 106.1 (IRC) 105.4.1 (IFC)—Submittals.
Submittals shall be made to the City of Prosser Building Department. Construction documents shall be submitted in one or more sets and in such form and detail as required by the fire code official. More specifically, for fire alarm systems three sets are required and for automatic sprinkler systems four sets are required. The construction documents shall be prepared by a registered design professional where required by the statutes of the jurisdiction in which the project is to be constructed and have licenses and credentials as required by the state of Washington. All companies installing fire protection systems within the City of Prosser shall have a City of Prosser business license as required by city of Prosser.
R109.2 (IBC) R108.2 (IRC) 106.2 (IFC)—Schedule of permit fees.
All fees shall be paid in accordance with PMC 15.04.130.
Section 501.3 (IFC)—Construction documents.
Construction documents for proposed fire apparatus access, location of fire lanes, security gates across fire apparatus access roads and construction documents and hydraulic calculations for fire hydrant systems shall be submitted to the Fire Code Official who shall route to the Fire Department for comment. The Fire Code Official shall make the final determination.

No building permit shall be issued for a building on a lot, tract or parcel of land unless:
A. 
The abutting street, and the streets connecting to presently surfaced streets, are constructed and improved in accordance with the city's subdivision ordinances and other ordinances of the city of Prosser and in accordance with the city's comprehensive plan and other plans adopted by the city in accordance with the Growth Management Act;
B. 
Water main extensions and distribution systems are constructed and installed in accordance with the city's subdivision ordinances and other ordinances of the city of Prosser and in accordance with the city's comprehensive plan and other plans adopted by the city in accordance with the Growth Management Act;
C. 
Irrigation water main extensions and distribution systems are constructed and installed in accordance with the city's subdivision ordinances and other ordinances of the city of Prosser and in accordance with the city's comprehensive plan and other plans adopted by the city in accordance with the Growth Management Act;
D. 
Sewer main extensions and distribution systems are constructed and installed in accordance with the city's subdivision ordinances and other ordinances of the city of Prosser and in accordance with the city's comprehensive plan and other plans adopted by the city in accordance with the Growth Management Act;
E. 
Electrical and communication facilities are constructed and installed in accordance with the city's subdivision ordinances and other ordinances of the city of Prosser and in accordance with the city's comprehensive plan and other plans adopted by the city in accordance with the Growth Management Act; and
F. 
Street lights are constructed and installed in accordance with the city's subdivision ordinances and other ordinances of the city of Prosser and in accordance with the city's comprehensive plan and other plans adopted by the city in accordance with the Growth Management Act.
G. 
In the event that there is a conflict between an ordinance and a plan adopted in accordance with the Growth Management Act regarding whether an improvement shall be required, then the more recently adopted of the ordinance or plan shall prevail.

In case of conflict of any provisions of the building codes with the zoning ordinance codified in Title 18, and as the zoning ordinance may be hereafter amended, the provisions of such zoning ordinance shall govern over the building codes.

Any person, firm or corporation violating or failing to comply with the requirements of this chapter and the codes adopted herein shall be guilty of a gross misdemeanor, punishable by a fine of not more than five thousand dollars and by imprisonment for not more than three hundred sixty-five days, or both such fine and imprisonment.

All future amendments to the above adopted codes pursuant to RCW 19.27.031, together with amendments as currently enacted or as shall be enacted by the state of Washington, are hereby adopted as and shall be the building code of the city of Prosser subject to the amendments, deletions, and additions thereto made by Sections 15.04.010 through 15.04.110.

Fees as permitted by the codes adopted pursuant to this title shall be paid in accordance with the procedures adopted in Chapter 20.10 in the amount provided for in the city's most recently adopted fee schedule.

The provisions of this chapter are hereby declared to be severable. If any section, subsection, sentence, clause, or phrase of this chapter or its application to any person or circumstance is for any reason held to be invalid or unconstitutional, the remainder of this chapter shall not as a result of said section, subsection, sentence, clause, or phrase be held unconstitutional or invalid.
