A person shall not operate or permit the operation of any train or train of railroad cars in such a manner as to block the movement of traffic upon any public street, highway or street crossing for a period of time longer than ten (10) minutes. A violation of this provision shall constitute a misdemeanor.

This chapter does not apply:
A. 
To any train or train of railroad cars in continuous motion in one direction;
B. 
Where the blocking of the crossing or public street or highway is caused by an unforeseen accident or mechanical failure in connection with such train or train of railroad cars.
