(a) 
For the purposes of controlling noise, promoting the public peace and to protect public safety and tranquility, establishments in the city that service the general public shall only be allowed to conduct business or operate during certain restricted days and hours unless they have first obtained and maintained a license to operate during restricted business days and hours from the city council.
(b) 
The city council may grant, by petition, licenses to operate during restricted business days and hours, as the public good requires and subject to terms and conditions as it sees fit, to such parties deemed appropriate, subject to the provisions of these Revised Ordinances.

(a) 
Any business or property in the city requiring a Lord’s Day license under Massachusetts General Law, Chapter 136 may satisfy such requirement by applying for, obtaining and maintaining a license to operate during restricted business days and hours from the city council.
(b) 
No owner of any property located in whole or in part within the limits of the city shall allow any party to operate a business establishment on said property during restricted business days unless such party has first obtained the required license from the city council or the property owner has obtained the required license for the entire property.
(c) 
Any violations of this section shall be reported to the city clerk. After conferring with the city solicitor and/or the president of the city council, if necessary, the city clerk may:
(1) 
Issue fines in accordance with Section 1-8 to the operator of such establishment; and/or
(2) 
Issue fines in accordance with Section 1-8 to the owner of the property on which such establishment is located; and/or
(3) 
Issue a cease and desist order to the owner of such establishment or property to stop operating during restricted business days.

(a) 
Business establishments with restricted hours of operation, as prescribed in Section 12-2002(a), shall not conduct business during such restricted business hours without first obtaining and then maintaining the required license from the city council.
(b) 
No owner of any property located in whole or in part within the limits of the city shall allow any party to operate a business establishment on said property during restricted business hours unless such party has first obtained the required license from the city council or the property owner has obtained the required license for the entire property.
(c) 
Any violations of this section shall be reported to the city clerk. After conferring with the city solicitor and/or the president of the city council, if necessary, the city clerk may:
(1) 
Issue fines in accordance with Section 1-8 to the operator of such establishment; and/or
(2) 
Issue fines in accordance with Section 1-8 to the owner of the property on which such establishment is located; and/or
(3) 
Issue a cease and desist order to the owner of such establishment or property to stop operating during restricted business hours.

(a) 
All applications for a license to operate during restricted business days and hours pursuant to this division shall be completed, reviewed and processed in accordance with the provisions of Sections 12-303.
(b) 
License Conditions and Restrictions.
(1) 
All licenses to operate during restricted business days and hours shall be subject to the standard license and permit conditions and restrictions for licenses and permits issued under the authority of the city council as specified in Section 12-308(a).
(2) 
The city council may impose other reasonable restrictions and conditions on individual licenses to operate during restricted business days and hours as they deem necessary to protect the public safety and welfare. Such restrictions and conditions may include, but are not limited to, requiring the licensee to have police details during restricted business days and hours.
(c) 
Petitions for licenses to operate during restricted business days and hours shall be considered by the city council in accordance with the provisions of Section 12-309 and the following additional provisions:
(1) 
Petitions for licenses to operate during restricted business days and hours shall only be approved if the city council finds that, in its judgment, all the following requirements are met:
a. 
The proposed site is an appropriate location to operate during restricted business days and hours;
b. 
The operation of any business during restricted business days and hours shall not adversely affect the neighborhood;
c. 
The operation of any business during restricted business days and hours shall not be a nuisance or serious hazard to vehicles or pedestrians; and
d. 
Adequate and appropriate facilities are provided for the proper operation of any business.
(2) 
The city council shall take final action on a petition for a license to operate during restricted business days and hours within 30 days of the first public hearing held on such license.
(d) 
Petitions for approved licenses to operate during restricted business days and hours shall be handled in accordance with the provisions of Section 12-310.
(e) 
Petitions for denied licenses to operate during restricted business days and hours shall be handled in accordance with the provisions of Section 12-311.
(f) 
Renewals of existing licenses to operate during restricted business days and hours shall be handled in accordance with the provisions of Section 12-312.
(g) 
The process used to monitor and ensure compliance with the conditions and restrictions placed on licenses to operate during restricted business days and hours, as well as the possible penalties for such noncompliance are prescribed in Section 12-313.
(h) 
Reviews of existing licenses to operate during restricted business days and hours shall proceed in accordance with the provisions of Section 12-314.
(i) 
The method used to file and process complaints regarding a license to operate during restricted business days and hours is prescribed in Section 12-318.
(j) 
Suspensions of existing licenses to operate during restricted business days and hours shall be handled in accordance with the provisions of Section 12-315.
(k) 
Revocations of existing licenses to operate during restricted business days and hours shall be handled in accordance with the provisions of Section 12-316.
