In order to prevent destruction of the new pavement on road sections built upon unstable foundation soil, it is necessary to limit the weight of vehicles and frequency of heavy vehicle usage.

The municipal engineer is authorized to limit weights of dump trucks as necessary to prevent roadway damage.

When the municipal engineer has imposed weights on dump trucks under SGC § 11.60.020, the municipal engineer is authorized to issue dump truck permits if he or she finds:
A. 
There is no reasonable alternative route available;
B. 
The vehicle weight and frequency of travel will not unduly harm the roadway.

Any person or business allowing a load-carrying dump truck to pass over the sections of road identified by the municipal engineer pursuant to SGC § 11.60.020, without first receiving a permit from the municipal engineer, shall be responsible for paying a fine of no more than $100.00 for each violation.
