This chapter shall be known and may be cited as the "Refuse Enforcement Law of the Town of Woodbury."
The Town Board finds that the improper handling and storage of refuse and bulk items within the Town of Woodbury has become detrimental to the public health, safety, and general welfare of its residents.
The accumulation of bulk refuse and the prolonged placement of containers curbside after collection detracts from the appearance of neighborhoods, creates safety hazards, and attracts vermin and litter.
Accordingly, the purpose of this chapter is to establish clear rules and enforcement authority to ensure compliance with the Town's refuse and recycling guidelines, and to authorize the imposition of penalties for violations.
This chapter is adopted pursuant to the authority granted by New York Municipal Home Rule Law § 10(1)(ii)(a)(12) and Town Law §§ 130(6), (7), and (15), which authorize towns to adopt local laws for the protection of the health, safety and welfare of their inhabitants and to regulate solid waste management and disposal.
As used in this chapter, the following terms shall have the meanings indicated:
BULK REFUSE
Means household furnishings, appliances, or other large items accepted for pickup on scheduled bulk collection days which do not fit in a Refuse Container /Bin/Tote.
COLLECTION DAY
Means the regularly scheduled day designated by the Town or its contractor for collection of refuse or recyclables from a particular property.
CURB or CURBSIDE
Means the area immediately adjacent to the roadway in front of a property where refuse containers or bulk items are placed for pickup.
REFUSE
Shall mean all solid waste, including garbage, rubbish, and recyclable materials, as defined by the Town's Refuse and Recycling Department.
REFUSE CONTAINER or BIN or TOTE
Means any receptacle used for the storage and collection of refuse or recyclables.
It shall be unlawful for any property owner, tenant, or occupant within the Town to:
A. 
Leave refuse containers curbside beyond 24 hours. Refuse containers or bins shall not be placed at the curb earlier than 5:00 p.m. of the day preceding the scheduled collection and shall be removed from the curb within 24 hours after collection has occurred.
B. 
Leave bulk items beyond 72 hours post-scheduled collection. Bulk items shall not be placed curbside earlier than the day prior to the scheduled bulk collection, and any item not collected on the scheduled day shall be removed from the curb and placed back onto the property within three days 72 hours.
C. 
Deposit or allow excessive bulk piles. Bulk collection shall be limited to one large item per week. Excessive piles of bulk refuse placed curbside for collection are prohibited.
A. 
This chapter shall be enforced by the Town of Woodbury Police Department, the Town's Code Enforcement Officer(s), or any other person designated by resolution of the Town Board. Complaints are to be submitted directly to the Refuse Department via email refuse@woodburyny.us or via phone at 845-928-7578, ext. 1242. In turn, the Refuse Department will contact the Police Department.
B. 
Enforcement officers are authorized to issue appearance tickets for violations of this chapter, returnable in the Town of Woodbury Justice Court.
A. 
Refuse container violations.
(1) 
First offense: $50 fine.
(2) 
Second offense: $100 fine.
(3) 
Third and subsequent offenses: $250 fine.
B. 
Bulk refuse violations.
(1) 
First offense: written warning.
(2) 
Second offense: $250 fine.
(3) 
Third offense: $500 fine.
(4) 
Fourth and subsequent offense: $1,000 fine.
C. 
Each day a violation continues shall constitute a separate offense. All unpaid fines imposed pursuant to this chapter shall constitute a lien upon the real property on which the violation occurred and, if not paid within 30 days of notice of such fine, shall be assessed, re-levied, and collected in the same manner and at the same time as other Town charges on the Town and County real property tax roll, pursuant to the Real Property Tax Law and applicable provisions of Town Law.
A. 
The Town Board may, by resolution, adopt supplemental rules or policies to facilitate enforcement, including notice procedures, forms, and fine collection protocols.
B. 
All fines collected pursuant to this chapter shall be payable to the Town of Woodbury Justice Court and credited to the Town's General Fund unless otherwise provided by resolution.
If any clause, sentence, paragraph, or part of this chapter shall be adjudged invalid, such judgment shall not affect or impair the remainder of this chapter but shall be confined in its operation to the clause, sentence, paragraph, or part directly involved in the controversy in which the judgment shall have been rendered.
This chapter shall take effect immediately upon filing with the Secretary of State of the State of New York in accordance with § 27 of the Municipal Home Rule Law.
