The purpose of this Chapter is to establish regulations governing the placement, use, maintenance, and permitting of portable storage containers, roll-off trash containers, commercial storage units, campers, trailers, and related items on private property within the Village of Marlborough. These provisions are enacted to promote public safety, preserve community standards, ensure compliance with nuisance regulations, and protect the general welfare of the community.

For purposes of this Chapter, the following terms shall have the meanings set forth below. Terms not defined herein but defined elsewhere in the Village Code or other duly adopted ordinances shall have the meanings ascribed therein. Terms not otherwise defined shall have their ordinarily accepted meanings as the context requires.
CAMPER
A portable vehicle or trailer designed and equipped for temporary recreational habitation, including but not limited to motor homes, travel trailers, pop-up campers, and truck bed campers, containing sleeping quarters and basic amenities such as kitchen or bathroom facilities. Campers shall not be used for permanent habitation or storage.
COMMERCIAL STORAGE UNIT
A fully enclosed, non-movable structure designed for shipping or long-term storage of goods, materials, or equipment, constructed of metal or other durable materials, including but not limited to shipping containers, prefabricated storage units, and modular storage buildings.
PORTABLE STORAGE CONTAINER
A container designed for moving or temporary storage, either on-site or off-site, of non-hazardous personal property, typically rented or leased, delivered, and removed by truck. Such containers shall not be used for permanent storage or habitation. Portable storage containers are also commonly referred to using the trade name "PODS."
ROLL-OFF TRASH CONTAINER
A large container designed for temporary storage of refuse, rubbish, trash, garbage, debris, or other discarded materials, typically rented or leased, delivered, and removed by truck. This term excludes permanent trash containers or dumpsters stored in enclosed areas or used by apartment complexes with thirty (30) or more units, provided such containers are emptied at least monthly.
TRAILER
A non-motorized vehicle designed to be towed by a motorized vehicle, used for transporting goods, equipment, or recreational vehicles, including but not limited to utility trailers, enclosed cargo trailers, flatbeds, and recreational vehicle (RV) trailers. Trailers shall be duly registered, comply with safety standards, and shall not be used for permanent storage or habitation.
TEMPORARY COMMERCIAL STORAGE CONTAINER
A portable unit designed for temporary storage of building materials, goods, merchandise, or supplies associated with a permitted commercial or manufacturing operation, typically rented for a limited period and removed by truck. Such containers shall not be classified as dumpsters or portable storage containers.

A. 
All portable storage containers, roll-off trash containers, temporary commercial storage containers, or commercial storage units (collectively, "unit" or "units"), shall comply with the following requirements:
1. 
Permit Required. No unit shall be placed or used without a permit issued by the Village, specifying the approved location, duration, and conditions of use. Permit applications shall be reviewed by the Building Commissioner or their designee, who may consult the Board of Trustees or other Village officials as necessary. All residential lots permitted to have a portable storage container or roll-off trash container must display the permit on the inside of a window or door of the residence, which permit shall be visible from the right-of-way.
2. 
Prohibited Uses. No unit shall be used for human habitation or for the storage of flammable, explosive, firearm, or noxious chemical materials.
3. 
Maintenance Standards. All units shall be maintained in good repair, free from rodents, insects, standing water, graffiti, or obscene, vulgar, or pornographic content. No waste shall be kept, stored, or accumulated in the area surrounding any unit. The property owner, lessee, and supplier shall be jointly and severally responsible for compliance with this provision.
4. 
Utilities And Illumination. No unit shall be externally illuminated or connected to utilities, including but not limited to electricity or water, unless expressly authorized by the permit.
5. 
Movement Restrictions. The delivery, removal, loading, or unloading of any unit shall occur only between the hours of 7:30 A.M. and 6:00 P.M., Monday through Saturday, unless otherwise authorized by the Building Commissioner.
6. 
Location. Units may only be located on the same lot as the residence or place of business where they are proposed to be used.

A. 
Portable Storage Containers And Roll-Off Trash Containers.
1. 
Shall be placed on a paved surface or within the front or rear yard of the property, located at least eleven (11) feet from the edge of the street pavement, curb, or alley, or, where no curb exists, the edge of the street pavement or alley.
2. 
Shall not encroach upon adjoining properties, obstruct emergency access or egress, or violate established zoning setbacks.
3. 
Shall not be placed on public property or within the Village's right-of-way without prior written approval from the Building Commissioner. Any damage to the Village's streets or right-of-way shall be reimbursed to the Village by the property owner responsible for the container.
4. 
Roll-off trash containers shall not be placed within five (5) feet of combustible walls, openings, or combustible roof eave lines.
5. 
Exceptions to placement requirements may be granted by the Building Commissioner on a case-by-case basis where site conditions preclude compliance, subject to written approval and any conditions deemed necessary.
B. 
Commercial Storage Units.
1. 
A maximum of two (2) commercial storage units per commercial property may be permitted, subject to Village approval.
2. 
Placement shall require approval of a site plan by the Board of Trustees.
3. 
Shall not encroach upon adjoining properties, obstruct emergency access or egress, or violate established zoning setbacks.
4. 
Shall be painted and maintained in a condition that complements the aesthetic character of the principal building on the property.
5. 
Commercial storage units are prohibited in residential districts.
6. 
Must be securely anchored and comply with Building Codes and safety regulations.
7. 
Are not permitted on single-family residential lots.
C. 
Temporary Commercial Storage Containers.
1. 
Shall be placed generally behind the building line of a commercial lot but in all cases in accordance with permit specifications regarding location and duration.
2. 
Shall not encroach upon adjoining properties, obstruct emergency access or egress, or violate established zoning setbacks.
3. 
Are not permitted on single-family residential lots.
D. 
Campers.
1. 
Shall be stored behind the front building line of the primary residential structure.
2. 
Shall not encroach upon adjoining properties, obstruct emergency access or egress, or violate established zoning setbacks.
3. 
Shall not be parked or stored in such a manner as to create a dangerous or unsafe condition on the property where parked or stored.
4. 
Shall not be used for living or sleeping purposes. Temporary placement for visiting guests shall require a permit specifying the approved location and duration of use. In no case shall any temporary placement exceed seven (7) days within any thirty (30) consecutive day period.
5. 
No campers shall be stored or used on commercial lots.
6. 
Shall be subject to the provisions of Chapter 365 pertaining to stopping, standing, or parking on roadways. No campers shall be parked on any roadway for an uninterrupted period of more than twenty-four (24) hours in any one (1) calendar day, except in an emergency or when in the process of loading or unloading the vehicle.
7. 
No campers shall be stored outdoors on residential property in an inoperative or unregistered condition.
E. 
Trailers.
1. 
Shall be stored behind the front building line of the primary structure or within an enclosed structure.
2. 
Shall not encroach upon adjoining properties, obstruct emergency access or egress, or violate established zoning setbacks.
3. 
A maximum of four (4) trailers per commercial and multi-family residential lot and one (1) trailer per single family residential lot may be stored outdoors, subject to Village approval.
4. 
Shall be subject to the provisions of Chapter 365 pertaining to stopping, standing, or parking on roadways. No trailers shall be parked on any roadway for an uninterrupted period of more than twenty-four (24) hours in any one (1) calendar day, except in an emergency or when in the process of loading or unloading the vehicle.

A. 
Portable Storage Containers.
1. 
May be placed on a property for a maximum of fourteen (14) consecutive days or fifteen (15) non-consecutive days within any thirty (30) consecutive day period.
2. 
Placement shall be limited to three (3) non-consecutive uses per calendar year.
3. 
Exceptions. Extended placement may be permitted, with written approval from the Building Commissioner, for:
a. 
Construction projects authorized by a valid Village-issued building permit. The portable storage container shall be removed no later than ten (10) days after the expiration of the building permit.
b. 
Lot owner has demonstrated that extenuating circumstances exist which justify the extension. Extenuating circumstances, shall include, but are not limited to, disaster such as tornado, fire, flood, or earthquake.
B. 
Roll-Off Trash Containers.
1. 
May be placed on a property for a maximum of thirty (30) consecutive days or thirty-one (31) non-consecutive days within any forty-five (45) consecutive day period.
2. 
Placement shall be limited to three (3) non-consecutive uses per calendar year per lot.
3. 
Exceptions. Extended placement may be permitted for:
a. 
Construction projects authorized by a valid Village-issued building permit.
b. 
Properties within an area declared a disaster by the Village Chairman.
c. 
Uses authorized by an approved conditional use permit.
4. 
The roll-off trash container shall be removed when full and the waste deposited at an appropriate facility.
C. 
Temporary Commercial Storage Containers. Placement duration shall be as specified in the permit, based on the operational needs of the permitted commercial or manufacturing activity.
D. 
Campers For Temporary Use. Placement duration shall be as specified in the permit for visiting guests but in no case shall any placement exceed seven (7) days in any thirty (30) consecutive day period.
E. 
Commercial Storage Units. May remain indefinitely, provided they remain in compliance with all permit conditions, maintenance standards, and other provisions of this Chapter.

Portable storage containers, roll-off trash containers, and temporary commercial storage containers shall not exceed eight (8) feet in height, eight (8) feet in width, or twelve (12) feet in length, unless otherwise authorized by the Village through the permit process.

A. 
Permits for the placement and use of any unit regulated under this Chapter shall be obtained from the Village Hall.
B. 
Permit applications, shall include, at a minimum, the proposed location, duration, and intended use of the unit, the unit's serial/rental number, date of its placement on the lot, date that removal is required, and local telephone number of the provider of the unit.
C. 
The Building Commissioner may impose conditions on permits to ensure compliance with this Chapter and other applicable Village regulations.
D. 
Any permit issued under the provisions of this Section shall be valid for only the name and location specified on the permit. Permits are not transferable.
E. 
All residential lots permitted to have a portable storage container or roll-off trash container must display the permit on the inside of a window or door of the residence, which permit shall be visible from the right-of-way.

A. 
Violations. In addition to other remedial provisions set forth in this Code and to protect, promote and preserve the public health and safety, no person shall cause, permit or maintain the existence of a violation of this Chapter, or shall fail or refuse to abate or remove a violation of this Chapter within the time required. Each day that a violation shall be maintained constitutes a separate offense. Any person found guilty of violating this Section shall be punished as provided in Chapter 100, Article III, Penalty, of this Code. As a condition to any probation granted the Municipal Judge may order such person to reimburse the Village for its costs incurred in removing and storing the offensive property.
B. 
Prohibited Units. Any container, camper, trailer, or similar item not expressly identified in this Chapter or permitted within a specific zoning district under other provisions of the Village Code is hereby prohibited, unless expressly authorized by the Village through a permit or other approval process.

If any provision of this Chapter is declared invalid by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.
