(a) 
Prohibition.
No person shall intentionally cause rubber and/or plastic latex or Mylar balloons inflated with any type of lighter than air gas, including but not limited to helium, to be released into the atmosphere.
(b) 
Disposal.
No person shall dispose of any balloon in any manner, including release into the air, other than being contained in a trash bag and placed into a City-issued trash container.
(c) 
Enforcement.
This section may be enforced by any police officer or by the Animal Control Officer.
(d) 
Fines.
Any person(s) violating this section shall be punished in accordance with the provisions of Section 1-8.

(a) 
No person, except the Director of the Division of Fisheries and Wildlife, or his agent or designee, as authorized pursuant to chapter 131 of the General Laws, shall feed or bait any waterfowl or of the family of Anatidae (including, but not restricted to, ducks, geese and swans) at any place within the city. As used in this section, “feeding” and “baiting” shall mean placing, exposing, depositing, distributing, or scattering, directly or indirectly, of shelled, shucked, or unshucked corn, wheat, or other grain, bread, salt, or any other feed or nutritive substances, in any manner or form, so as to constitute for such birds a lure, attraction, or enticement to, on, or over any such areas where such feed items have been placed, exposed, deposited, distributed, or scattered.
(b) 
Nothing in this section shall be construed to limit the feeding of domesticated waterfowl, as defined by the Division of Marine Fisheries and Wildlife, by a farmer as defined in MGL c.128, §1A on property owned or leased by him, or the feeding of waterfowl or other birds by propagators licensed under MGL c.131, §23 when such waterfowl or other birds are confined in such a manner as may be required pursuant to said §23 and any rules and regulations issued under authority thereof; or the feeding by any person or his agents, invitees or licenses of waterfowl lawfully kept as a pet by that person.
(c) 
Notwithstanding any of the above, the Director of the Division of Fisheries and Wildlife, or his agent or designee, may authorize the emergency feeding of waterfowl and other birds when, in his opinion, such action is necessary in order to alleviate undue losses and suffering of such birds due to unusual weather conditions and other circumstances. The Director may authorize such action by such means as he deems necessary and expedient, but such means shall include the immediate notification of the City Council thereof by first class mail.

Unless otherwise stated, any person who violates any provision of this article shall be subject to a fine of in accordance with Section 1-8.
The police chief and his designee, including the animal control officer, or any city police officer shall have authority to enforce the provisions of this article. Any alleged violation of this article may, in the sole discretion of the enforcing agent, be made the subject matter of noncriminal disposition proceedings commenced by such agent in accordance with MGL c.40, §21D.

No person shall keep any live fowl or other farm animals, except in accordance with regulations promulgated by the board of health.

(a) 
Pest control companies and problem animal control agents operating in the city are hereby required to check roof traps for squirrels and raccoons every six hours from June 1 through September 30.
(b) 
If a squirrel or raccoon is trapped for longer than six hours and wind, environmental, or weather conditions pose an adverse risk to the health or safety of the animal based on the animal's species, age, or physical condition, trapped animals must be released immediately by the problem animal control agent under the supervision of the city's animal control officer.
(c) 
If the problem animal control agent is unavailable, the city's animal control officer has jurisdiction to release animals subject to this section that are at risk after a six-hour period.
(d) 
Violation of this section constitutes an infraction and may be punished as defined under Section 3-7.

(a) 
The animal control officer must be called on an emergency response basis by the immediate supervisor to respond to emergency animal control calls.
(b) 
Emergency calls include and are not limited to:
(1) 
An injured animal in need of emergency medical treatment;
(2) 
Found animals including abandoned animals reported by residents, city departments, or animal organizations for surrender to be picked up, scanned, and transported to kennel;
(3) 
A canine bite or mauling in progress;
(4) 
Animals attacking each other;
(5) 
Animals in traffic flow;
(6) 
Animals in distress in a vehicle;
(7) 
Animals found in home during a fire;
(8) 
Animals found in hoarding situations where the Inspectional Services Department declares an unsafe and unsanitary condition.

Experiments conducted on live animals of any kind are prohibited and therefore completely banned in the City of Everett.
