The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

Unless another fine or penalty is expressly provided elsewhere in this Article II or by New Jersey statute, any person, association or corporation who shall violate the provisions of this Article II, or any supplement or amendment thereto, shall, upon conviction, be subject to a fine of $35.

No person or entity shall stand, park or stop a motor vehicle upon any roadway or public parking lot for the purpose of washing, greasing or repairing said vehicle, except for emergency repairs, or for the purpose of displaying said vehicle for sale.

A. 
No person shall park the following vehicles overnight on any public street in the Township of Hillside:
(1) 
Any tractor truck cabs with or without trailers attached, or any trailer or combination thereof incapable of being moved on its or their own power;
(2) 
Trucks of any type, including but not limited to pickup trucks and vans, loaded or equipped in a manner that would lead a reasonable observer to believe that same was being used for commercial or industrial purposes;
(3) 
Buses of any type; and
(4) 
Jitneys, limousines, and taxi cabs.
B. 
Overnight parking for purposes of this section shall mean and include parking after 11:00 p.m. and before 6:00 a.m. of any day.
C. 
The provisions of this section shall not apply to vehicles owned by a public utility as defined in N.J.S.A. 48:2-13 when such vehicles are being used for work in connection with the furnishing or supplying of the commodity which by law the public utility is authorized to furnish or supply.
D. 
Violations and penalties.
(1) 
Any person, association or corporation who shall violate the provisions of this section shall, upon conviction, be subject to a fine of not less than $100 nor more than $250 or imprisonment for a period not to exceed 30 days, or both, at the discretion of the court. Second and subsequent offenses shall result in a fine of not less than $250.
(2) 
In addition to the above penalties set forth in Subsection D(1), the Township Police Department, after the issuance of a second summons to the same vehicle within a thirty-day period, may cause such vehicle to be towed or otherwise removed from the public street or municipal property with the owner of such vehicle being responsible for the cost of such removal.

A. 
No person shall park a truck, tractor, trailer, semi-trailer or omnibus having a registered gross vehicle weight in excess of 8,000 pounds upon any streets between the hours specified.
B. 
The provisions of this section shall not apply to vehicles owned by a public utility as defined in N.J.S.A. 41:2-13 when such vehicles are being used for work in connection with the furnishing or supplying of the commodity which by law the public utility is authorized to furnish or supply.
C. 
Violations and penalties.
(1) 
Any person, association or corporation who shall violate the provisions of this section shall, upon conviction, be subject to a fine of not less than $100 nor more than $250 or imprisonment for a period not to exceed 30 days, or both, at the discretion of the comport.

(2) 
In addition to the above penalties set forth in Subsection C(1), the Township Police Department, after the issuance of a second summons to the same vehicle in a thirty-day period, may cause the vehicle to be towed or otherwise removed from the public street or municipal property, with the owner of such vehicle being responsible for the cost of such removal.
D.

It shall be unlawful for any person who owns, rents, leases, or otherwise operates a limousine which is under his/her control or possession whether actual or contractual to park said vehicle on any Township street between the hours of 11:00 p.m. and 6:00 a.m.
A. 
Upon the declaration of an emergency, there shall be no parking upon the streets where temporary EMERGENCY NO PARKING signs are displayed. The police chief or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
C. 
The effectiveness of this section is contingent upon the signs being erected as required by law.

A. 
No person shall place, put up, build, or cause to be placed, put up, or built, within or upon any sidewalk, street, or highway any object, personal property, fixture or structure unless a permit is issued by the Township authorizing such placement has been granted and is in full effect. No objects of any kind can be placed on a public street or thoroughfare within the Township to reserve a parking space.
B. 
In addition to the other provisions of this section of the Township Code, any attempt to reserve a parking space or other space on any public street or thoroughfare within the Township by the placement of an object, or by any other means, without first obtaining a permit for such purpose from the Township and readily displaying same is prohibited.
C. 
Any such fixture, structure, or personal property, as referenced herein, that has been placed or left without authorization from the Township in or upon any street, highway, or sidewalk may be moved, removed, or confiscated by or under the direction of the Township Police Department or Department of Public Works at the owner's expense.
D. 
Any person, association or corporation who shall violate these provisions may, upon conviction, be subject to a fine of $35.
E. 
This section shall not apply to the placement of solid waste and recycling containers when does in the manner set forth in Chapter 261 of the Township Code.

B. 
Violations and penalties. Any person violating this section shall be subject to a fine of $54, plus court costs, with no court appearance required.

A. 
The Chief of Police, or his designee, is hereby authorized to suspend parking restrictions temporarily in the Township of Hillside under circumstances, for durations, in areas, and at times as the Chief, or his designee, deems, in his discretion, appropriate and in the interests of public safety or for the good of the community.
B. 
The suspension of the parking restrictions by the Chief of Police or his designee shall not last for a period of time greater than 72 hours.
C. 
This section shall in no way permit the Chief of Police or his designee to lift, suspend, or in any way modify those parking restrictions governed by Title 39 of the New Jersey Statutes Annotated.
D. 
Notice of such suspensions shall be provided to the public.

B. 
Residential parking permit requirements.
(1) 
Residents of any street enumerated in Subsection A shall be entitled to residential parking permits not to exceed the limits set forth above. Said permits shall be issued annually by the Chief of Police and shall expire on December 31 of the calendar year of issue.
(2) 
Residential parking permits for the Bailey Avenue Municipal Lot will be available to residents of the immediate area only. A limit on the number of permits available for this area may be imposed by the Chief of Police. All residential parking permits are issued on a first-come, first-served basis. Residents without access to a private driveway or other off-street parking shall have priority: however, the issuance of a permit does not guarantee a parking space, except that vehicles without a permit shall not park in this lot.
(3) 
Residential parking and guest permits shall be for the exclusive use and convenience of Hillside residents, and their guests, and shall not be transferable or used by other persons Residential parking permits for Woodruff Avenue will be available to residents of Hollywood Avenue residing between S. Long Avenue and Frances Place.
(4) 
Any resident who shall apply for a parking permit as provided by this section shall present to the Chief of Police or his designee the following documents which shall demonstrate proof of residency:
(a) 
New Jersey driver's license.
(b) 
New Jersey Vehicle Registration and Insurance Card.
(c) 
Permit fee as required by Subsection C of this section.
(5) 
Parking permits shall be prominently displayed in the manner prescribed by the Chief of Police on vehicles while parked in the locations enumerated in Subsection A of this section.
C. 
Guest permits.
(1) 
Guest permits shall be available for the use and convenience of any guest of a household located on a street/location enumerated in Subsection A and shall be transferable from vehicle to vehicle. At no time shall a guest permit be displayed on a vehicle owned by or registered to a resident or household member.
(2) 
The Chief of Police shall establish a convenient procedure for residents to obtain guest permits. Said procedure shall not require residents to provide the name, address or other information that would identify their guest(s) to any person; however, all guest permits shall be numbered and prominently displayed in a manner prescribed by the Chief of Police.
(3) 
Nothing contained herein shall be construed to limit the number of guests a resident may invite or suffer in his or her household at any time.
(4) 
Regular guest permits (reusable).
(a) 
Residents of the streets/locations enumerated in Subsection A shall be entitled to obtain not more than one regular guest parking permit per household per year.
(b) 
Regular guest parking permits shall be issued annually by the Chief of Police and shall expire on December 31 of the year issued.
(5) 
Temporary guest permits (nonreusable).
(a) 
Temporary guest parking permits shall be available to residents and members of their households at a cost of $1 per permit and shall be valid for not more than 72 hours. Unless otherwise approved by the Chief of Police or his designee, no resident or household shall be eligible to receive more than three temporary guest permits in a seventy-two-hour period.
(b) 
The Chief of Police shall be authorized to deny or rescind temporary guest parking permits as necessary to keep the peace, prevent crime, facilitate the unrestricted flow of traffic in the Township or for other good cause.
D. 
Permit fees; exemptions.
(1) 
The following fees for parking permits shall become effective on January 1, 2008 or as soon thereafter as this revised section shall become effective:

(2) 
The above fees shall be applied toward the cost of signs, placards and other miscellaneous materials and expenses associated with the administration of this section.
(3) 
With the exception of the fees required for temporary guest permits, the above fees shall not apply to households wherein any member of the household is a member of the Armed Forces of the United States of America or the militia of the State of New Jersey, including but not limited to members of the United States Army, Air Force, Navy, Marines, Coast Guard, or the New Jersey National Guard or Air National Guard. This fee exemption shall also be applicable to members of the Armed Forces who are on inactive or reserve status, and to honorably discharged members of the Armed Forces of the United States who present proof of same along with their application for a parking permit.
(4) 
Active members of the Township of Hillside Auxiliary Police Department and Volunteer Fire Department shall also be exempt from the above fees.
(5) 
Senior citizens age 62 or older shall also be exempt from the above fees.
E. 
Exceptions to permit requirement. Nothing in this section shall be applicable to the following vehicles:
(1) 
Emergency vehicles including but not limited to police, fire and ambulance;
(2) 
Vehicles engaged in the delivery of any public works services, including but not limited to street cleaning, leaf collection, snow removal, garbage removal or other essential services:
(3) 
Clearly marked vehicles owned or operated by a public utility service (electric, gas, cable TV, etc.), provided said vehicle is used in connection with the delivery of service to a Township business or resident and does not block or impede the flow of other parked and moving vehicles;
(4) 
United States Postal Service vehicles or any vehicle used by U.S. Postal Service employees who are engaged in the delivery of the United States Mail, provided said vehicle is clearly identified:
(5) 
Vehicles used by health care professionals including doctors, visiting nurses, private ambulance services, pharmaceutical services or other vehicles used in connection with the delivery of any health care service, medicine or physical rehabilitation equipment while engaged in the actual delivery of professional services, medicines or equipment to a resident or occupant of any building located on the streets/locations enumerated in Subsection A, where there is insufficient space or it is otherwise not feasible to park said vehicle in a private driveway or other suitable off-street parking area:
(6) 
Service vehicles clearly marked and displaying commercial license plates used in connection with the construction, repair or maintenance, including lawn and garden maintenance, of a residence or other property located on any street/location enumerated in Subsection A where there is insufficient space or it is otherwise not feasible to park said vehicle in a private driveway or other off-street parking area and does not block or impede the flow of other parked and moving vehicles:
(7) 
Vehicles used in connection with the delivery of any merchandise, goods or services to residents of the streets/locations enumerated in Subsection A, provided said vehicle is clearly marked, displays commercial license plates, is perked for a period of time not to exceed the time necessary to accomplish the delivery and does not block or impede the flow of other parked and moving vehicles;
(8) 
Vehicles owned and/or operated by employees of New Jersey Transit while engaged in any public transportation service;
(9) 
Limousines, taxicabs, buses and other private coaches hired by a resident or guest of a resident of any street/location enumerated in Subsection A, provided said vehicle is parked for not more than 15 minutes, does not block or impede the flow of other parked and moving vehicles, and the operator remains with the vehicle: and
(10) 
Any vehicle that displays a valid handicapped parking permit or handicapped license plates issued by the Director of the New Jersey Division of Motor Vehicles or a temporary handicapped parking placard issued by the Chief of Police of any municipality or other political subdivision in the State of New Jersey.
F. 
Enforcement; violations and penalties.
(1) 
Any person who shall park a vehicle without a valid parking permit upon any street/location enumerated in Subsection A shall be subject to a fine of $50 for a first offense and $100 per offense for a second or subsequent offense.
(2) 
Any resident of a street/location enumerated in Subsection A who shall display a guest parking permit on his or her own vehicle, or any vehicle owned or registered to a household member while parked on the street, shall be subject to a fine of $50 for a first offense and $100 per offense for second and subsequent offenses. Upon a guilty plea or finding of guilt by the Municipal Court, the Chief of Police shall be authorized to rescind said resident's permit parking privileges for a period of 30 days for a first offense and 60 days for a second or subsequent offense.
(3) 
The Police Department shall be responsible for the enforcement of this section, and members of the Police Department shall be authorized to issue a summons to the owner or operator of any vehicle parked in violation of this section.
(4) 
The Police Department may, at the owner's expense and without his or her consent, remove any vehicle parked in violation of this section not less than eight hours subsequent to the issuance of a summons.
G. 
Miscellaneous provisions.
(1) 
Nothing contained herein shall prohibit the parking of a motor vehicle without a permit in a private driveway or other off-street parking area located on or near the streets/locations enumerated in Subsection A of this section.
(2) 
Nothing contained herein shall be construed to guarantee a public parking space to any person, including persons who have obtained parking permits as provided by this section.
(3) 
No parking permit shall be issued for a truck, bus, taxicab, commercial or other vehicle prohibited from parking overnight by virtue of any Township ordinance, nor shall any vehicle, including vehicles that display parking permits, be parked in a manner that violates Title 39 of the Laws of the State of New Jersey.
(4) 
The Chief of Police or his designee shall be responsible for issuing parking permits and maintaining records, as necessary, to implement this section. He shall, without delay, forward all permit fees to the Chief Financial Officer. Said fees shall be deposited into a dedicated account that will be used for the purchase of the signs, placards and other necessary expenses in connection with the implementation of this section.
(5) 
The Superintendent of Public Works shall be responsible for placing appropriate signs on the streets enumerated in Subsection A of this section, giving clear warning to all persons that parking of vehicles without a permit is unlawful.
(6) 
For the convenience of residents who may host holiday gatherings, this section shall not be effective on the following holidays: New Year's Day, Martin Luther King's Birthday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day.
(7) 
In addition. the Chief of Police shall be authorized to suspend enforcement of this section for good cause and without the prior consent of the Mayor or governing body for a period not to exceed 48 hours. The term "good cause" as used in this section shall include but shall not be limited to events such as funerals, weddings, family reunions and other circumstances that may arise from time to time and do not cause unnecessary inconvenience to the community or disrupt the delivery of essential services as determined by the Chief of Police. In all such cases, residents shall request suspension of enforcement of this section in writing, except in the case of funerals.
No person shall park any truck or vehicle over three tons' gross vehicle weight (GVW), a school bus, any other type of bus, recreational vehicle, camper, boat or trailer between the hours specified upon any of the following streets or parts of streets:

A. 
The time limit hours for use of the parking space located in front of the meter shall be 9:00 a.m. to 6:00 p.m., and a charge of $0.25 per hour will be charged for said use. During the hours of 6:00 p.m. and 9:00 a.m. there shall be no charge.
B. 
As used in this section, the following definitions shall apply:
PARKING METER
Any mechanical device installed or used for the regulation of parking in accordance with the provisions of this section. Each parking meter installed shall indicate a proper legend, the legal parking time established by the Township and when in operation shall indicate the balance of legal parking time and at the expiration of the legal parking time shall indicate illegal or overtime parking.
PARKING METER SPACE
Any space within a parking meter zone adjacent to the parking meter.
C. 
No person shall park a vehicle in any of the parking meter spaces established by this section without depositing one or more appropriate coins of the United States of America at the rate provided for at the parking meter and turning the lever to cause the parking meter to operate and shall not use any slug or deposit a substitute for a United States coin.
D. 
No person shall cause a vehicle to remain in or to be parked in a parking meter space while said parking meter displays a device or signal indicating the period of time for such parking has expired.
E. 
No person shall deface, tamper with, damage, unlawfully open, willfully break, or destroy the usefulness of any parking meter installed under the provisions of this section.
F. 
For any prosecution charging a violation of any of these provisions regulating the standing or parking of a vehicle, proof that the particular vehicle described in the complaint or summons was parked in violation of any such provisions, together with proof identifying its registered owner, shall constitute prima facie proof that the registered owner of such vehicle at the point where, and for the time during which, such violation occurred.
G. 
Fines.
(1) 
Fines for parking violations in accordance with this section are hereby fixed as follows:
(a) 
Overtime parking: $10.
(b) 
Defacing, tampering, damaging: $200, plus cost of repair of parking meter.
(c) 
Other violations: $10.
(2) 
In addition to the foregoing fines, the Municipal Court, in its discretion, may impose court costs consistent with those permissible in Municipal Court, and in addition may impose imprisonment for defacing or tampering as defined in this section.
H. 
An owner or operator of a motor vehicle may, within 24 hours preceding the court date appearance on any summons placed on said vehicle, waive hearing and pay to the Clerk of Hillside Municipal Court the appropriate fine for any overtime parking. All other violations will require a court appearance.
I. 
Any person who does not pay the fine or penalty in accordance with this section shall be subject to procedures and penalties established in accordance with the law including contempt procedures and/or arrest.
J. 
It shall be the duty of the officers and members of the Police Department of the Township of Hillside to enforce the provisions of this section.
K. 
The Township may, at its discretion, establish certain dates such as holidays to allow parking without paying the amount imposed by this section.
L. 
The Township shall also place signs on the parking lot indicated by this section, indicating thereon the hours of operation and the amount necessary to properly park thereon.
M. 
The manner or person to be responsible for collection of the coins deposited shall be designated by the Mayor and Council.
N. 
The parking meter parking lines or markings shall be placed thereon by the Department of Public Works.

A. 
Parking, loading or standing of vehicles is hereby prohibited on front lawns in residential areas as defined in the Land Use Ordinance[1] of the Township.

B. 
Nothing contained herein shall prohibit parking of a motor vehicle on an approved driveway.
C. 
Violations and penalties. Any person violating this section shall be subject to a fine of $150, plus court costs, with no court appearance required, for the first offense, and shall be subject to a fine of $250, plus court costs, with a mandatory court appearance, for each subsequent offense thereafter.

D. 
Nothing in this section shall prohibit towing of said vehicle in the event an emergency situation arises wherein emergency services are being rendered or attempted to be rendered in or about the residential premises.
