shall mean the Municipality of Anchorage Employee Relations Board.
shall mean any member or agent of the board, including any person appointed by the board to conduct hearings or investigations on its behalf.
as used herein shall mean the Anchorage Municipal Code, as amended from time to time.
as used herein, shall have the meanings set forth in section 3.70.010 of the Code.
means a person assigned by the board to hear a case. The hearing officer need not be an attorney or judge, but must have experience conducting hearings on contested matters. The hearing officer shall not have power to decide a case unless that authority is expressly delegated to the hearing officer by the board prior to the hearing, with notice to the parties. Unless such authority is granted, the hearing officer's powers shall be limited to making procedural and evidentiary rulings, and to making recommended decisions on the merits for final action by the board.
as used herein shall mean the municipality, an employee of the municipality, or a current bargaining representative of employees of the municipality. The term "party" also includes any person named or admitted as a party, or properly seeking and entitled as of right to be admitted as a party, in any Board proceeding. This may include any person filing a charge or petition under the Code, any person named as respondent, as employer, or as party to a contract in any proceeding under the Code; but nothing herein shall be construed to prevent the board or its designated agent from limiting any party to participate in the proceedings to the extent of his or her interest only.
as used herein shall mean any "party."
has the same meaning as that term is defined in the common law of Alaska. Probable cause requires an honest and reasonable belief. It does not require the probable cause investigator to conclusively determine an unfair labor practice was committed. To paraphrase the decision of the Alaska Supreme Court in Lord v. Wilcox, 813 P.2d 656, 658 (Alaska 1991), probable cause exists when:
