Except for funeral processions, no person shall knowingly:
A. 
Conduct, join or participate in a parade unless that parade has been authorized by a parade permit issued by the chief of police.
B. 
Conduct, join or participate in a parade except in accordance with a parade permit issued by the chief of police for that parade.

A. 
An application for a parade permit shall be made to the chief of police on a form approved by the chief of police no less than 30 days before the proposed date of the parade. The application shall contain the following information:
1. 
The name of the applicant, the sponsoring organization, the parade leader, and the address and telephone numbers of each;
2. 
The date of the proposed parade, the location of the assembly area and disbanding area, the route to be traveled and the approximate times of day that the parade will assemble, start and terminate;
3. 
A description of the individual floats, marching units, vehicles and bands, including a description of any sound amplification equipment to be used;
4. 
Evidence that the state has approved the parade or that the state's approval is not required;
5. 
Evidence that a municipal noise permit has been obtained or that such a permit is not required;
6. 
Such other information pertaining to the place, duration, time and manner of the parade as the chief of police may deem necessary.
B. 
The chief of police shall grant the application for a parade permit if the chief finds that the application was timely filed, and:
1. 
The time, route, duration, size or nature of the parade will not disrupt unreasonably the movement of other traffic;
2. 
The time, size, route, nature or duration of the parade will not require the diversion of so great a number of police officers to insure the public safety and welfare as to unreasonably burden the municipal police capability;
3. 
The parade will not interfere with another parade for which a permit has already been issued;
4. 
The applicant has obtained necessary state or municipal permits for the parade; and
5. 
The information contained in the application is correct and accurate in all material details.
C. 
The chief of police shall notify the applicant of the decision to grant or deny the application for a parade permit not less than seven days after the application was received by the chief of police. The chief of police shall state in writing the reasons for the decision to deny an application for a parade permit.
D. 
The chief of police may issue a parade permit upon shorter notice than that which is required by subsections A and C of this section upon a finding that the subject matter of the parade is such that its purpose would be frustrated by delay and that the applicant has otherwise met all of the requirements for a parade permit provided by law.

Each parade permit shall state:
A. 
The place and time of assembly before and after the parade;
B. 
The time of assembly and starting and disbanding times of the parade;
C. 
The maximum and minimum speeds of the parade;
D. 
The route of the parade;
E. 
The portions of streets, roadways, highways, alleys and sidewalks to be traversed by the parade;
F. 
The maximum number of parade units and the maximum and minimum space to be maintained between them;
G. 
The maximum length of the parade in miles or fractions of a mile;
H. 
The number of persons to be provided by the permittee to monitor the parade for compliance with the permit;
I. 
The number and type of vehicles to be used in the parade;
J. 
The material and size of any sign, banner, placard or carrying device therefor to be displayed in the parade; and
K. 
Such other requirements relating to time, place and manner of the parade as are found by the chief of police to be reasonably necessary for the protection of persons or property.

Immediately upon the granting of a permit for a parade the chief of police shall send a copy thereof to the following:
A. 
The mayor;
B. 
The chief administrative officer—operations;
C. 
The fire chief;
D. 
The traffic engineer;
E. 
The director of public works; and
F. 
The state traffic engineer, if state highways are involved.

The chief of police may revoke a parade permit upon a finding that:
A. 
Public calamity, disaster, riot or other emergency exists, and a parade would unreasonably threaten the public health, safety or welfare;
B. 
The parade has been conducted in violation of the terms of the parade permit; or
C. 
The information contained in the application is false or incomplete in any material detail.
