"Backyard open burning"
means burning of yard debris, trimmings, and clippings only.
"Burn day"
means a day when the ventilation index exceeds 400, wind is less than 10 miles per hour, there is a minimum danger in burning and Jackson County declares it a legal burn day on the Jackson County Burn Line 541-776-7007.
"Ceremonial fire"
means a fire that is part of a ceremony or ritual that is prescribed by custom, ritual, protocol, or convention.
"Fire chief"
means the chief of Jackson County Fire District No. 1 or his authorized representative.
"Fire hazard"
means the presence or accumulation of combustible material of such a nature and in sufficient quantity that its continued existence constitutes an imminent and substantial danger to life, property, public welfare, or to adjacent lands.
"Open burning"
means burning in burn barrels or incinerators, open outdoor fires, and any other burning not vented through a stack or chimney except outdoor cooking.
"Ventilation index"
means a number calculated by the National Weather Service related to the ability of the atmosphere to disperse pollutants.
"Yard debris"
means wood, needle or leaf materials from trees, shrubs, or plants from real property.

No person shall start or maintain any outdoor fire, except as allowed under this chapter. Nor shall any person in control of any premises cause or knowingly allow any such fire to be started or maintained on any part of such premises. No burning of household garbage, plastic, Styrofoam, commercial waste, industrial waste, land clearing waste, plastic, wire insulation, automobile parts, asphalt, petroleum products, petroleum treated materials, rubber, asbestos, animal remains, animal or vegetable matter, and any material that emits dense smoke or noxious odors shall be allowed at any time of the year, including burning such materials in wood stoves or fireplaces.
A. 
Except as provided herein, no person shall start or maintain any fire outside a building for the purpose of burning any material or cause or participate therein, nor shall any person in control of any premises cause or allow any such fire to be started or maintained on any part of said premises.

This section does not apply to cooking in a barbecue grill or other similar enclosure specifically designed and listed for outdoor cooking. Outdoor cooking in a barbecue or similar enclosure may only occur where the property owner or lawful lessee has provided permission for the outdoor cooking.
2. 
During times of extreme fire danger and/or red flag warning from the National Weather Service, only propane (or other gas or liquid) fueled cooking fires are allowed.
3. 
This section does not apply to the burning of a structure or the other use of fire for training purposes conducted by the fire department.
4. 
Ceremonial open pile fires may be permitted when the following requirements have been met:
a. 
A burn permit has been obtained from Jackson County Fire District No. 1.
b. 
Persons wishing to conduct ceremonial fire operations shall contact Jackson County Burn Line to confirm whether it is a DEQ authorized burn day.
c. 
Persons wishing to conduct a ceremonial fire may only burn within city limits when the wind speed is less than 10 miles per hour.
d. 
Ceremonial fire burning shall only include firewood. The burning of yard debris, trimmings, and clippings is considered to be open burning and covered under subsection (A)(5) or (A)(6) of this section if you are using a burn barrel. Dimensional lumber, trash, or other non-yard debris items cannot be burned at any time. Persons must ensure that combustible material is dried to the best extent possible. This includes covering the combustible material to protect from moisture and loosely stacking the material to eliminate dirt, rocks, or other noncombustible material to promote an adequate air supply within the burning pile.
e. 
Ceremonial fire burning is only allowed during daylight hours.
f. 
The burn will be supervised and constantly attended by an adult.
g. 
Burning will take place only when wind direction will not adversely affect visibility on roadways or downwind from occupancies.
h. 
Vegetation will be cleared a minimum of 15 feet around piles prior to burning.
i. 
No utility lines are located overhead.
j. 
A garden hose is connected to a water supply and readily available to extinguish the fire.
k. 
If the fire is at least 50 feet from any building, combustible fence, or other combustible material the total fuel area may be up to six feet in diameter and three feet in height.
l. 
If the fire is between 25 and 50 feet from any building, combustible fence, or other combustible material the fuel area may be three feet or less in diameter and two feet or less in height.
m. 
No ceremonial fire burning is allowed within 25 feet of any building, combustible fence, or other combustible material.
n. 
During fire season, as determined by Oregon Department of Forestry, open burning, including ceremonial fire burning, is prohibited.
5. 
Backyard open pile burning is permitted when the following requirements have been met:
a. 
A burn permit has been obtained from Jackson County Fire District No. 1.
b.

Persons wishing to conduct burn barrel burning may only burn within city limits when the wind speed is less than 10 miles per hour.
d. 
Burn barrel burning shall only include yard debris, trimmings, and clippings. Dimensional lumber, trash, or other non-yard debris items cannot be burned at any time. Persons must ensure that combustible material is dried to the best extent possible. This includes covering the combustible material to protect from moisture and loosely stacking the material to eliminate dirt, rocks, or other noncombustible material to promote an adequate air supply within the burning barrel.
e. 
Burn barrel burning is only allowed during daylight hours.
f.

Burn barrels must have a heavy mesh top and draft screen with no larger than one-quarter-inch holes. The screen must be in place during use.
l. 
During fire season, as determined by Oregon Department of Forestry, burn barrel burning is prohibited.
7. 
Recreational fire burning, including a protected pit, barbeque pit, fabricated fire pit or chiminea, is permitted when the following requirements have been met:
a. 
A burn permit has been obtained from Jackson County Fire District No. 1.
b. 
Persons wishing to conduct recreational fire burning operations shall contact Jackson County Burn Line to confirm whether it is a DEQ authorized burn day.
c. 
Persons wishing to conduct recreational fire burning may only burn within city limits when the wind speed is less than 10 miles per hour.
d. 
Allowed burning materials may only include charcoal and firewood.
e. 
Recreational fire burning is only allowed during daylight hours.
f. 
The burn will be supervised and constantly attended by an adult.
g. 
Burning will take place only when wind direction will not adversely affect visibility on roadways or downwind from occupancies.
h. 
Vegetation will be cleared a minimum of 15 feet around recreational fire areas prior to burning.
i. 
Recreational fire burning devices must be at least 15 feet from any building.
j. 
A garden hose is connected to a water supply and readily available to extinguish the fire.
k. 
During fire season, as determined by Oregon Department of Forestry, recreational fire burning is prohibited.

A. 
Enforcement. The police chief is charged with the responsibilities and the authority for enforcing the provisions of this chapter.
B. 
Penalties. A violation of a provision of this chapter or any action causing a fire hazard is punishable by a fine not to exceed $500.00. Serious offenses may also be referred to the DEQ or other appropriate agency.
