The purpose of this chapter is to provide minimum standards to safeguard life, health, property and public welfare by regulating the sale of novelty lighters that have features which are attractive to children, including visual effects, flashing lights, musical sounds, or toy-like designs.

"Novelty lighter"
means a lighter which is especially attractive to children 10 years or younger due to a toy-like design or other features such as buttons or devices that initiate visual effects, flashing lights, or musical sounds that might encourage a child to use the lighter.

The retail sale, offer of retail sale, gift or distribution of any novelty lighter within the incorporated city limits of Rogue River is prohibited. This prohibition is inapplicable to:
A. 
Novelty lighters which are being actively transported only through the city limits.
B. 
Novelty lighters located in a warehouse or distribution center closed to the public for purposes of retail sales.

A. 
Enforcement. The provisions of this chapter shall be enforced by any police officer, code enforcement officer, fire marshal and any other city official authorized to enforce any provision of this chapter.
B. 
Penalties. Any person violating any portion of this chapter, or an order issued under authority of this chapter, is punishable by a fine not less than $50.00 and not to exceed $1,000.
