No person under the age of 18 years shall idle, wander, stroll or play in or upon the public streets, sidewalks, parks, playgrounds, or other public places between the hours of 11:00 p.m. and 6:00 a.m., unless said person is in the custody of or accompanied by a parent, guardian, or other person 18 years of age or over and authorized by the parent or by law to have care and custody of the minor, or unless the person under 18 years of age is engaged in legitimate business as directed by an adult person having the care and custody of the person under 18 years of age, or unless the person under 18 years of age is emancipated pursuant to ORS 109.550 through 109.565.

No parent, guardian or person having the care and custody of a person under the age of 18 years shall allow such person to be in or upon any street, sidewalk, park, playground or other public place between the hours specified in RRMC § 9.05.010, nor shall any person 18 years of age or over assist any person under 18 years of age in violating any of the provisions of RRMC § 9.05.010.

Any person who violates any of the terms prescribed in RRMC § 9.05.010 may be referred to the Jackson County juvenile department.
Any person who violates any of the terms prescribed in RRMC § 9.05.020 may, upon conviction thereof, be punished by a fine not to exceed $50.00.

A person commits the violation of failing to supervise a minor if the responsible party is the parent, legal guardian or person with legal responsibility for the safety and welfare of a child under 18 years of age, and the child has been found on private property, or premises open to the public in violation of any provision of any city of Rogue River ordinance.

It shall be a defense to the violation of failing to supervise a minor if the child's violation of any city of Rogue River ordinance occurred in the presence of and on the private property of the responsible party. It shall be a further affirmative defense if that responsible party has reported the act to the appropriate authorities.

In addition to any fine or penalty imposed pursuant to this chapter, the court may order the responsible party to pay any restitution to a victim of the minor's conduct. The amount of the restitution ordered shall not exceed $2,500.

If a child 11 years of age or younger is found violating any city of Rogue River ordinance, any citation issued shall be issued to the responsible party, rather than to the child.
