The Town of Frye Island has a long history with the concept of "quiet hours," beginning with specific language in the Standard Deed from Leisure Living Communities, Inc. However, the concept was never incorporated into an enforceable Town ordinance.
A. 
The Town believes that residents have a reasonable expectation of peaceful and quiet enjoyment of their property. Therefore, no person shall make, continue or cause to be made any profane, boisterous, unnecessary noises, including an excessive volume of noise, as specified in the following sections of this chapter. In addition to the person making or causing the noise, the property owner of any building, dwelling, structure, premises, boat, or conveyance or any part thereof in the Town shall also be responsible for such activity.
(1) 
During nighttime hours, no person shall generate substantial noise that is plainly audible beyond the property line at any other person's residence. For the purposes of this chapter, nighttime hours shall be from 10:00 p.m. to 7:00 a.m. on Monday through Thursday, and from 11:00 p.m. to 7:00 a.m. on Friday, Saturday, Sunday, and major national holidays. The decibel levels of continuous sounds shall not exceed 55 dBC, and impulse sound shall not exceed 80 dBC.
(2) 
The level of noise during daytime hours shall not exceed what is reasonable and consistent with daily living.
B. 
The above provisions shall not apply to fireworks shows, concerts, or any other activity or event approved in advance by the Executive Committee.
C. 
No person shall perform or carry on, or cause to be performed or carried on, any major construction or excavation work during the hours between 8:00 p.m. and 7:00 a.m. that produces noise of a sufficient volume to disturb the occupants of neighboring properties. This subsection shall not apply in the event of an emergency.
A written notice of violation of this chapter may be issued by the Cumberland County Sheriff Department or any other entity authorized by the Town Manager. Persons found to have violated this chapter are subject to a fine of up to $100 for the first violation, $200 for the second violation, and $400 for the third violation.
