The purpose of this article is to authorize the use of videoconferencing by members of the Village of Hempstead Board of Trustees in the manner authorized by and consistent with Public Officers Law § 103-a. The Board of Trustees recognizes the importance of transparency, public participation, and open government. Members are expected to be physically present at meetings. However, in accordance with Public Officers Law § 103-a, members may attend meetings via videoconference in extraordinary circumstances.
Public notice for the meeting shall inform the public:
A. 
That extraordinary circumstances videoconferencing may/will be used.
B. 
Where the public can view and/or participate in such meeting.
C. 
Where required documents and records will be posted or available.
A. 
The public shall have the right to attend meetings at the physical location(s) where members of the public body are present.
B. 
The public shall also be able to view and participate in meetings via videoconference, in real time, in a manner that allows equal participation to those attending in person.
C. 
Meeting notices shall inform the public how to attend and participate both in person and remotely.
A. 
A quorum of the public body must be physically present at the meeting location.
B. 
Members participating by videoconference shall be considered present and may vote, provided a quorum exists at the physical location.
A. 
Minutes of meetings shall identify which members participated remotely.
B. 
Videoconference participation shall be recorded and posted to the Village of Hempstead's website.
C. 
Videoconferencing shall utilize technology to permit access by members of the public with disabilities consistent with the Americans with Disabilities Act.
