A. 
"Utility task vehicle (UTV)"
means a side-by-side motorized vehicle with off-road capabilities, designed for two or more occupants, equipped with a steering wheel, seat belts, roll cage, and cargo area.
B. 
"Golf cart"
means a small motor vehicle originally designed for use on a golf course, with a top speed not exceeding 20 miles per hour.
C. 
"City streets"
means public roads and rights-of-way within the Rainier city limits, not including state highways or private roads unless specifically designated.

A. 
UTVs and golf carts are permitted on Rainier city streets with a posted speed limit of 35 miles per hour or lower.
B. 
Crossing higher-speed roads (such as U.S. Highway 30) is only allowed at controlled intersections with marked crossings.

All UTVs and golf carts operating on city streets must include:
A. 
Functioning headlights, taillights, and brake lights.
B. 
Turn signals or the ability to use hand signals during daylight hours.
C. 
At least one rearview mirror.
D. 
A functioning horn.
E. 
Seat belts for all occupants (UTVs only).
F. 
Rollover protection system (ROPS) for UTVs.

A. 
Operators must:
1. 
Be at least 16 years old.
2. 
Possess a valid Oregon driver's license.
3. 
Carry proof of liability insurance for the vehicle.
4. 
Display the city-issued permit.
B. 
No person shall operate a UTV or golf cart while under the influence of alcohol or controlled substances.
C. 
Passengers must remain seated at all times while the vehicle is in motion.

A. 
All vehicles must be registered with the city of Rainier and display a city-issued permit decal on the rear of the vehicle.
B. 
The permit application must include:
1. 
Completed application form.
2. 
Proof of insurance.
3. 
Copy of valid driver's license.
4. 
Payment of a $100.00 annual fee.
5. 
Safety inspection certification from Rainier police department or a designated inspection officer.
C. 
The permit is valid for two calendar years.

A. 
Violations are punishable by:
1. 
First offense: warning or fine up to $100.00.
2. 
Second offense: fine up to $250.00 and possible permit suspension.
3. 
Third offense: revocation of permit for 12 months.
B. 
Rainier police department shall be responsible for enforcement.
