(1) "Nonpoint source pollution"
means pollution from any source other than from any discernible, confined, and discrete conveyances, and shall include, but not be limited to, pollutants from agricultural, silvicultural, mining, construction, subsurface disposal and urban runoff sources.
(2) "State waters"
means and refers to the public waters and waterways of the United States and of the commonwealth of Virginia.
(3) "Riparian buffer"
means an area of trees, shrubs, grasses, or a combination thereof, that is: (a) at least 50 feet in width, (b) adjacent to wetlands and/or state waters, (c) managed to maintain the integrity of stream channels and shorelines, and (d) reduces the effects of upland sources of pollution through the infiltration of runoff and filtering of pollutants. A managed lawn adjacent to state waters does not constitute a riparian buffer.
(4) "Wetlands"
means areas that are inundated or saturated by surface or groundwater at a frequency and duration to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions, as defined by the U.S. Environmental Protection Agency pursuant to Section 404 of the federal Clean Water Act.
