ACTIVELY CHARGING
An electric vehicle that is physically connected to an EV charging station and drawing current.
ELECTRIC VEHICLE
Any vehicle that is licensed and registered for an operation on public and private highways, roads, and streets; and operated either partially or exclusively using an electric motor powered by an externally charged on-board battery.
ELECTRIC VEHICLE SUPPLY SERVICE EQUIPMENT or EVSE
The equipment, including the cables, cords, conductors, connectors, couplers, enclosure, attachment plugs, power outlets, power electronics, transformer, switchgear, switches and controls, network interfaces, point of sale equipment, and associated apparatus designed and used for the purpose of transferring energy from the electric supply system to a plug-in electric vehicle. "EVSE" may deliver either alternating current or, consistent with fast charging equipment standards, direct current electricity. "EVSE" is synonymous with "electric vehicle charging station."
EV CHARGING STATION
A public parking space that provides electric vehicle supply equipment for charging EVs.
IDLE VEHICLE
A vehicle that is plugged in but no longer drawing a charge.
LEVEL 2 CHARGER
Operates on 40-to-100-AMP breakers on a 208- or 240-volt AC circuit.
MAKE-READY PARKING SPACE
The prewiring of electrical infrastructure at a parking space, or set of parking spaces, to facilitate easy and cost-efficient future installation of electric vehicle supply equipment or electric vehicle service equipment, including, but not limited to, Level Two EVSE and direct current fast chargers. Make-ready includes expenses related to service panels, junction boxes, conduit, wiring, and other components necessary to make a particular location able to accommodate electric vehicle supply equipment or electric vehicle service equipment on a "plug and play" basis. "Make-ready" is synonymous with the term "charger ready," as used in P.L. 2019, c. 362 § 1. § § 1. (C.48:25-1 et al.)
A. 
EV charging stations shall be used only by electric vehicles that are actively charging.
B. 
Non-electric vehicles or EVs not connected to the station shall not occupy EV charging spaces.
A. 
The maximum parking time for a vehicle using a municipal EV charging station shall be six consecutive hours.
B. 
After six hours, vehicles are subject to enforcement action including but not limited to issuance of a summons or towing at the owner's expense.
C. 
EV spaces are for temporary public charging only and shall not be used for overnight.
D. 
No parking is permitted for EV spaces from 12:00 a.m. to 6:00 a.m.
EV charging stations located on City of Burlington property shall impose the following fees:
A. 
Parking fee:
(1) 
First three hours: no parking fee.
(2) 
Hours four through six: $2 per hour.
(3) 
After six hours: $20 per hour.
(4) 
Fees shall be paid via the mobile application or payment method designated at each EV charging location.
B. 
Charging fee (energy use):
(1) 
$0.50 per kilowatt-hour (kWh).
Each EV charging station shall include clearly visible signage indicating:
A. 
Applicable charging and parking fees.
B. 
Maximum parking time (six hours).
C. 
Enforcement and towing policy.
D. 
EV-only restriction.
E. 
Technical support contact information.
A. 
The City may contract with a third-party provider for maintenance, billing, and operations of EV charging infrastructure.
B. 
Fee adjustments may be made by Council resolution to reflect market conditions or provider pricing changes.
Vehicles in violation of this article may be issued a citation in accordance with local traffic enforcement and/or towed per City towing regulations.[1]
