A.
The Upper Southampton Municipal Authority shall have the ability/authority to enforce, implement and manage any and all stormwater management in Upper Southampton Township as required by this Chapter 153, Upper Southampton Township Stormwater Management Ordinance.
B.
In addition, for the purposes of constructing, extending, installing, maintaining, safeguarding, or repairing its stormwater planning, management and implementation, the Upper Southampton Municipal Authority is authorized to enter in, under and upon any and all streets or other ways within this Township now or hereafter in public use; subject, however, to the following conditions:
(1)
That the Upper Southampton Municipal Authority shall comply with such reasonable rules and regulations as the Board of Supervisors may from time to time prescribe and shall cause as little inconvenience to the public in the use of such streets and ways as may be reasonably possible.
(2)
That upon completion of any work in, under and upon such streets and ways, the Upper Southampton Municipal Authority shall restore such streets and ways pursuant to the specifications of the Township Supervisors as directed by the Township Engineer or its authorized agent.
(3)
That the Upper Southampton Municipal Authority shall be responsible for and indemnify the Township and its Board of Supervisors against all loss and expense by reason of injury to persons or damage to property resulting from the operations of the Upper Southampton Municipal Authority or the maintenance of its facilities in, under or upon such streets and ways and, upon request of the Board of Supervisors, shall obtain policies of insurance, in reasonable amounts, covering such risks.
