The board of health shall have responsibilities over all matters pertaining to the preservation of the life and health of the people of Jefferson County and shall:
(1) 
Collect, analyze and disseminate to the community, through the Jefferson County health department, information about community health conditions, risks and resources, and the availability of resources to address identified problems;
(2) 
Enact such rules, regulations and policies as are necessary to preserve, promote and improve the health status of Jefferson County residents, and guide the allocation of appropriate and necessary public health resources;
(3) 
Assure that necessary, high quality, effective public health services are available for the protection of the people of Jefferson County, including the control and prevention of any dangerous, contagious or infectious disease within the county;
(4) 
Provide for the prevention, control and abatement of nuisances detrimental to public health;
(5) 
Enforce, through the health officer, the public health statutes of the state and county;
(6) 
Establish fee schedules for issuing and renewing licenses and permits, or for such other services as are authorized by the law and rules of the State Board of Health;
(7) 
Appoint the members of the Jefferson County substance abuse advisory board; and
(8) 
Coordinate the activities of the clean water district under Chapter 8.65 JCC with other programs and activities which fall under the duties and responsibilities of the board of health.

The board of health shall be composed of seven members. The three elected members of the board of county commissioners shall be members of the board of health. Four members of the board of health shall be appointed by the county commissioners. Appointed members of the board of health shall include one elected official from the city of Port Townsend city council, one Jefferson County Public Hospital District #2 commissioner; and two at-large community representatives.

Appointed members shall serve for three-year terms. The term of office for all appointees shall commence on June 1st in the year in which the term is to commence.

The board of county commissioners shall appoint the members of the board of health. The board of county commissioners shall request that the city of Port Townsend and Jefferson County Public Hospital District #2 each nominate one candidate for appointment to the board of health. The county commissioners shall seek applications from citizens of Jefferson County to fill the at-large membership positions on the board of health.

Vacancies on the board of health shall be filled by appointment by the board of county commissioners. Appointments shall be for the unexpired portion of the term of the position filled.

The board of health shall hold no fewer than one regular meeting in each month of each year; provided, that if no issues over which the board has jurisdiction are pending upon its calendar, a meeting may be canceled. All meetings of the board of health shall be open and public, pursuant to the Open Public Meetings Act, codified at Chapter 42.30 RCW et seq. Meetings shall be held at such times and at such locations as to be convenient for attendance by board of health members and the public, as determined by a resolution passed by a majority of board of health members.

The board of health shall adopt bylaws for the transaction of its business. No actions shall be taken by the board of health unless a majority of members are present, including at least two Jefferson County commissioners. The board of health shall keep a public record of its transactions, findings and decisions.

Appointed members of the board of health shall receive compensation for their service in the amount of $50.00 for attendance at regularly scheduled board meetings. Appointed members may additionally receive reimbursement for approved expenses related to the completion of their responsibilities.

It is the express purpose of this chapter to provide for and promote the health of the general public and not to create or otherwise establish or designate a particular class or group of people who will or should be especially protected by the terms of this chapter.
It is the specific purpose of this chapter to place the obligation of complying with its requirements upon persons, businesses or companies required to meet provisions of the health regulations. Enactment of this chapter and its terms and provisions does not impose any duty upon the Jefferson County public health department or any of its officers or employees unless a duty is imposed on such officers or employees by the express terms of this chapter. Implementation or enforcement of this chapter by county officers or employees shall be discretionary and not mandatory.

This chapter is promulgated under the police power granted to the Jefferson County board of health, including, but not limited to, authority granted to them by Chapters 7.48, 7.80 and 70.05 RCW to protect the public health, safety, and welfare of the people in Jefferson County, including those county residents residing within the city of Port Townsend.

In case of a conflict between this chapter and the chapters of the county code relating to food service sanitation, solid waste and/or on-site sewage, as currently enacted or as may in the future be amended or recodified, the text of those three chapters shall control except that the local health officer shall have discretion to interpret and implement any county code sections enforced by public health (or its successor agency or division) which are at variance with one another in a manner that best protects and furthers public health.

(1) 
Any violation of the laws, regulations and ordinances specified in JCC § 8.01.030, including any future amendments, shall constitute a civil code violation under JCC § 19.10.015(14).
(2) 
The enforcement provisions codified in JCC Title 19, Code Compliance, as currently enacted or as hereafter amended, shall apply to any alleged or found violation of the laws, regulations and ordinances specified in JCC § 8.01.030, including any future amendments.

(1) 
Pursuant to RCW 70.05.060(5), the board of health for Jefferson County declares that all nuisances defined in JCC § 19.10.015(36) and all violations of this chapter are hereby determined to be detrimental to public health and safety and are hereby declared public nuisances.
(2) 
The enforcement provisions codified in JCC Title 19, Code Compliance, as currently enacted or as hereafter amended, shall apply to any alleged or found nuisance, as defined in JCC § 19.10.015(36).

The board of health, or its designated health officer, may authorize the Jefferson County health department director or their designee(s) to serve as an "enforcement officer," duly authorized to enforce this chapter as enforced under JCC Title 19.
