The Borough previously created and hereby codifies the position of Qualified Purchasing Agent, who shall possess all authority and duties set forth in N.J.S.A. 40A:11-9 and act and be designated as a Qualified Purchasing Agent, provided the required certification from the state pursuant to the statutory requirements have been satisfied. In the event the requirements are not satisfied, the position shall be designated as Purchasing Agent.

The Qualified Purchasing Agent shall work with the Borough Administrator, if the positions are separate and shall have the authority, responsibility and accountability for the purchasing activity pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forms and procedures promulgated by state regulatory agencies; and the establishment and enforcement of any and all local purchasing policies adopted by the governing body; and conduct any activities as may be necessary or appropriate to the purchasing function.

A. 
In the event there is a Qualified Purchasing Agent, the Borough shall take advantage of the highest statutory bid threshold established by the state, but the Borough may go to bid at a lower amount to encourage greater competition between vendors.
B. 
The political contribution threshold (pay-to-play) of $17,500 remains in place and all procurement over $17,500 and less than the agency's new, higher bid threshold (window contracts) are subject to those laws, and such threshold shall be raised in the event raised by the state.
