In accordance with the provisions of Revised Code of Washington chapter 41.12, there is created a civil service commission to exercise the powers and to perform the duties established by such state law in connection with the selection, appointment and employment of police in the city.

The appointing authority shall be the mayor for the chief of police; the civil service commission for the secretary/chief examiner; and the chief of police for all other civil service positions within the police department.

A. 
Appointment; Qualifications: The civil service commission shall consist of three (3) members who shall be appointed by the mayor and confirmed by the city council. No person shall be appointed a member who is not a citizen of the United States, a resident of the city for at least three (3) years immediately proceeding such appointment, and an elector of the county.
B. 
Terms: The term of office for such commissioner shall be for six (6) years, except that the first three (3) members of such commission shall be appointed for different terms, as follows: one to serve for a period of two (2) years, one to serve for a period of four (4) years, and one to serve for a period of six (6) years.

Notwithstanding anything to the contrary in Revised Code of Washington chapter 41.12, in addition to any opportunity afforded the appointing authority to exercise a choice in the filling of a vacancy by the terms of said law, whenever requisition is made upon the commission for the names of persons eligible for appointment when a vacancy occurs, including both original appointments and promotions, the commission, instead of furnishing the name of the one person highest on the eligibility list, shall certify to the appointing authority the names of the three (3) persons highest on such eligibility list for such vacancy, if there are three (3) such persons available. The appointing authority shall forthwith appoint one of the certified persons to such vacant position.
