A. 
Provisions Adopted: The "Washington model traffic ordinance" ("MTO"), Chapter 308-330 WAC, as now enacted or hereafter amended, excluding the provisions listed in subsection B of this section and as restricted in subsection C of this section; and RCW 46.04.215, as now enacted or as hereafter amended, are hereby adopted by reference as the traffic ordinance of the city as if set forth in full.
B. 
Provisions Excluded And Substituted: Pursuant to RCW 35.21.180, the following sections of the MTO, Chapter 308-330 WAC and certain sections of Revised Code of Washington are not adopted by reference as part of this section, as set forth in subsection A of this section, and are expressly excluded:

RCW 46.04.197, adopted by reference in WAC 308-330-100. For the purposes of this chapter, "highway" shall be defined as follows:
"Highway" shall mean the entire width between the boundary lines of every way, lane, road, street, boulevard, parking lot, and every way or place in the city, whether publicly or privately maintained, when any part thereof is open at any time to the use of the public for purposes of vehicular traffic; provided, that the definitions in section 7-1-8 shall control in that section.
C. 
Wheeled all-terrain vehicles (WATVs) may be operated according to state regulations within city limits only where the speed limit is thirty-five (35) miles per hour or less on State Route 507 and 288th Street South.

A. 
Revised Code Of Washington 47.50, as now enacted or as hereafter amended, is hereby adopted by reference to provide for the regulation and control of vehicular access and connection points of ingress to, and egress from, the state highway system within the incorporated areas of the city.
B. 
Pursuant to the requirements and authority of Revised Code Of Washington 47.50, there is hereby adopted by reference the provisions of Washington administrative code (WAC) chapters 468-51 and 468-52, as now enacted or as hereafter amended, in order to implement the requirements of Revised Code Of Washington 47.50.

The city has determined on the basis of an engineering and traffic investigation that the maximum speeds permitted under Revised Code Of Washington 46.61 are greater or less than reasonable and safe under the traffic conditions found to exist within the city, and accordingly the speed limits within the city shall be:
A. 
Forty five (45) miles per hour from the northern city limits going south to the intersection of Lyle Street and State Highway 507.
B. 
Thirty (30) miles per hour beginning at the intersection of Lyle Street and State Highway 507 going south to the intersection of 288th Street and State Highway 507.
C. 
Thirty (30) miles per hour from the intersection of 4th Street and State Highway 507 going south to the intersection of 288th Street South and State Highway 507 and forty (40) miles per hour from the intersection of 288th Street and State Highway 507 going south to the intersection of 295th Street South and State Highway 507.
D. 
Twenty five (25) miles per hour on all other accessible streets inside the city limits, unless otherwise posted.

It shall be unlawful for any person to ride a bicycle upon any sidewalk in the city. Any person violating this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in any sum not exceeding twenty five dollars ($25.00) and the cost of proceedings.

Revised Code Of Washington 46.61.295 adopted by reference in the MTO is hereby amended to read as follows:
A. 
The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction unless such movement can be made in safety and without interfering with other traffic; provided, however, that no U-turn shall be permitted on Water Street from Lyle Street to McNaught Street or on McNaught Street from Water Street to Fourth Street.
B. 
No vehicle shall be turned so as to proceed in the opposite direction upon any curve, or upon the approach to or near the crest of a grade, where such vehicle cannot be seen by the driver of any other vehicle approaching from either direction within five hundred feet (500').

The following gross weights are hereby established for the Warren Street Bridge ("the bridge"):
Top truck
15 tons
Middle truck

Bottom truck

as depicted on exhibit A, "Sign R12-5 Modified", "Manual On Uniform Traffic Control Devices For Streets And Highways", which is on file in the city and made a part hereof, and the bridge shall be posted for weight limits using "Sign R12-5 Modified".

A. 
Definitions: For the purposes of this section, the following terms mean:
BRAKE:
Any device used for slowing, halting or stopping the movement of any motor vehicle.
COMPRESSION BRAKE:
A motor vehicle brake which is activated or worked by the compression of the engine of a motor vehicle.
MOTOR VEHICLE:
A motor vehicle as now or hereafter defined in Revised Code Of Washington 46.04.320.
B. 
Use Prohibited: The use within the corporate limits of any motor vehicle brakes which are in any way activated or operated by the compression of the engine of any such motor vehicle or of any unit or part thereof, is prohibited.
C. 
Exemptions: The following shall be exempted from the provisions of subsection B of this section:
1. 
Operation of compression brakes on public safety vehicles, including fire department vehicles;
2. 
Operation of compression brakes in an emergency when necessary for the protection of persons and/or property; and
3. 
When the noise created by the use of compression brakes is effectively muffled.
D. 
Civil Infraction; Penalty: A person who violates subsection B of this section shall be deemed to have committed a civil infraction and shall be subject to penalty as provided in section 1-4-1 of this code unless a greater penalty is provided by state law. The monetary penalty shall be in addition to all statutory assessments and all such assessments shall be collected.

A. 
Purpose: The purpose of this section shall be to protect and preserve identified streets within the city that will otherwise be seriously damaged because of rain, snow or other climatic conditions unless subject to vehicle travel restrictions; further, to protect those identified city streets whose condition is such that continued unrestricted use will result in great damage to those streets. This section shall exempt authorized emergency vehicles, buses, trucks transporting perishable commodities, commodities necessary to the health and welfare of city residents, trucks providing services necessary to the health and welfare of city residents, and local deliveries.
B. 
Scope And Construction Of Terms: Terms used in this chapter shall have that meaning given to them in subsection C of this section and where not defined herein shall have that meaning clearly indicated by the context in which such terms are used.
C. 
Definitions: As used in this section, the following definitions apply:
AUTHORIZED EMERGENCY VEHICLE:
Any vehicle of any fire department, police department, sheriff’s office, coroner, prosecuting attorney, Washington state patrol, ambulance service, public or private, which need not be classified, registered or authorized by the state commission on equipment, including any other vehicle authorized in writing by the state commission on equipment, or deemed by the above named departments, offices and agencies as necessary to assist in the handling of any such emergency.
BUSES:
Every motor vehicle used regularly to transport children to and from school (school buses) or public transit buses used to transport persons to and from businesses, commercial locations and home.
CITY STREET:
Every public street, road, alley and right of way or part thereof, maintained by the city, lying inside the limits of Roy, and which has not been designated as a state highway as that term is defined in Revised Code Of Washington 47.04.010(34) as now or hereafter amended.
CITY STREET USE PERMIT:
That permit issued by the public works director pursuant to this code authorizing certain through hauling that exceeds the load limitation specified by this chapter.
COMMERCIAL COMBINATION:
Any combination consisting of a truck and trailer, tractor and trailer, combination of three (3) vehicles, or combination consisting of a tractor and stinger steered semitrailer combination.
COMMODITY NECESSARY FOR HEALTH AND WELFARE:
A product of agriculture or manufacture, which is necessary to provide essential shelter, food and fuel to people and animals.
CONSTRUCTION AND/OR COMMERCIAL TRUCK:
Any three (3) or greater axle vehicle, any dual axle tandem, dual rear tire vehicle, or vehicle with a manufacturer’s gross vehicle weight rating greater than ten thousand (10,000) (GVW).
LOCAL DELIVERY:
Construction or commercial trucks delivering or receiving goods, material, equipment, or services within the residential and commercial area or along city streets. Local delivery includes, but is not limited to, moving vans, retail delivery trucks, trucks delivering goods or services within the commercial or business district, and private residential services such as lawn care services, construction and landscaping material delivery, and home improvement services.
OVERWEIGHT PERMIT:
The permit issued by the public works director pursuant to this code authorizing travel on city streets by overweight trucks belonging to local businesses that are not making local deliveries.
MOTOR VEHICLE:
Every vehicle or vehicle combination which is self-propelled.
PERISHABLE COMMODITY:
A product of agriculture, aquaculture, or manufacture, which by its nature is subject to destruction, decay, deterioration or spoilage except under proper conditions.
PERSON:
Every natural person, firm, copartnership, corporation, association or organization.
SERVICE NECESSARY TO THE HEALTH AND WELFARE:
Any service provided to the public, which is necessary to maintain essential power, gas, communications, garbage, sewer and water services for the community at large.
THROUGH HAULING:
Vehicle travel through an area without planned stops for the delivery, receiving or exchange of goods, materials or equipment.
TRUCK:
Any motor vehicle designed or used for the transportation of commodities, merchandise, produce, freight, animals or other materials.
VEHICLE:
Every device capable of being moved upon a public highway and in, upon or by which any persons or property is or may be transported or drawn upon a public highway.
WEIGHT LIMIT:
The total vehicle weight limitation allowed on residential and collector streets as defined in this section.
D. 
Vehicle Restrictions:
1. 
Prohibited Gross Weight: No vehicle with a legal gross weight rate designation over twenty four thousand (24,000) shall travel through any city street within the city unless exempted or permitted under this section. This shall be determined by licensed gross weight rate designation or manufacturer gross weight rate designation, whichever is the most restrictive.
2. 
Overweight Permit Required: The public works director or designee, subject to approval by the mayor, is authorized to issue an overweight permit to vehicles belonging to local business that exceed the weight limitations herein. Such "local business" means a company whose principal place of business is within the city limits of Roy, or has a terminal/facility within the city limits of Roy. The permit shall be subject to annual fee which shall be established by resolution of the council. The overweight permit will be issued based on criteria including, but not limited to, the following:
a. 
The vehicle must travel along the designated route represented to the public works director or designee by the local business; and
b. 
The vehicle will be limited to a specific number of round trips on a designated route per day, the excess in pounds over the legal limit must be stated; and
c. 
The vehicle identification number, license plate number, current insurance certificate, current annual inspection certificate if required, current tonnage certificate and any updates if tonnage is purchased monthly and a copy of the valid registration must be provided; and
d. 
The permit must be kept in the truck at all times; and
e. 
Any route must be approved by the public works director or designee before use. The public works director or designee shall take into account traffic flow, safety, road condition, and any other applicable factors when determining if the permit is to be issued. Unless impossible, the route shall make use of the stated designated route. There shall be an annual fee imposed, per the adopted fee schedule, to cover the cost of administering the permit. The public works director, subject to approval by the mayor, is authorized to terminate permits issued under this section for failure to comply with the criteria herein.
3. 
Commercial Combinations Prohibited: Subject to the exemptions under this section, no commercial combination shall be operated on any city street.
E. 
City Street Use Permits: The director of public works may, upon application, and with approval by the mayor, issue a city use permit exempting a construction or commercial truck from the prohibition in this section for a single event or through hauling. The permit shall be subject to a fee which shall be established by resolution of the council.
F. 
Exemptions: When travel restrictions as defined in this chapter are in effect for any city streets, authorized public transportation and school buses, emergency vehicles, buses, motor trucks transporting perishable commodities or commodities necessary for the health and welfare of local residents, local deliveries as defined in this section, public utility companies and associated contracted services, provided that the termination for the trip is within city limits, waste collectors, mail service, and truck tractors when not in combination and driven to a residence or business in the city, provided that the truck tractor shall not be parked or left on the city right of way and shall be parked on private property.
G. 
Violations; Penalty: A violation of this section shall be a traffic infraction with a maximum penalty provided by Revised Code Of Washington 46.44 as now enacted or hereafter amended. Each trip upon city streets shall constitute a separate violation.
H. 
Notice: The travel restriction imposed by this section shall become effective upon the erection and maintenance by city forces of signs designating such limitations at each end of the city limits on Washington Highway 507 and shall remain in full force until such signs are removed by city forces upon legislative action by the Roy city council.
I. 
Imposing Additional Restrictions: Nothing in this chapter shall prohibit the city from imposing additional weight or fixing load limits and/or travel restrictions through the state environmental policy act (SEPA) review process or other city permits. In fixing such load limits, weather conditions, traffic, type and quality of street surfacing, ballast, and dimensions shall be taken into consideration. Such load limit or restrictions shall become effective upon the posting of signs.
