It shall be a violation of this chapter to violate any rule or regulation adopted by the city council for the regulation of the city park.

A.
Reservation Fee: Any person, firm or corporation desiring to reserve a portion of the city park shall make a written application with the city clerk-treasurer and pay a nonrefundable fee in the amount set forth in the City of Roy Fee Schedule.
B.
Deposit: In addition, the applicant shall pay a deposit at the time of application in the amount set forth in the City of Roy Fee Schedule, which shall be used to clean the park and repair any damage which may have occurred, and any portion thereof not used shall be refunded to the applicant.
C.
State Or County Agencies And Nonprofits:
1.
State or county agencies and nonprofits may be allowed to use the park facilities for an exchange of beneficial services or products in lieu of the rental fee.
2.
Said groups shall not be exempt from the responsibilities of damage or cleaning; however, they shall not be required to pay a damage or reservation deposit unless designated by the facilities coordinator based on the nature of the event.
D.
Fourth Of July: The city park shall be open on the Fourth of July. The city shall not accept individual or group reservations for that day.

A.
Placement Of Signs, Other Structures: It is unlawful to use, place, or erect any signboard, sign, billboard, bulletin board, post, pole or device of any kind for advertising within the city park, or on the public right of way attached thereto, or to attach any notice, bill, poster, sign, wire, rod or cord to any tree, shrub, railing, post or structure within the city park, or on the public right of way attached thereto, except as expressly allowed by permit from the city council, or to place or erect in the city park a structure of any kind; provided, that the city council may permit the erection of temporary directional signs or decorations on occasions of public celebration and picnics.
B.
Removal Or Destruction Of Property: It is unlawful to remove, destroy, mutilate or deface any structure, building, monument, statue, vase, fountain, wall, fence, railing, vehicle, bench, shrub, tree, fern, plant, flower, lighting system, or sprinkling system or any permanent work in the city park.
C.
Animal Restrictions: It is unlawful to allow or permit any animal to run at large in the city park, or enter any lake, pond, fountain or stream therein. All dogs must be on a leash no longer than eight feet (8').
D.
Fireworks, Lighted Material, Firearms And Weapons: It is unlawful to shoot, fire or explode any fireworks, firecrackers, torpedoes or explosive of any kind, any firearms, air gun, bow and arrows, or BB gun, or to use any slingshot in the city park unless a written permit has been obtained from the city council. It is unlawful for any person to throw any lighted tobacco, cigars, cigarettes, matches, firecrackers, or other lighted material on or within the city park, including, without limitation, any shelters or other structures located in the park; provided, a person may dispose of smoking materials in a receptacle designed for such purpose if such item is placed within the park.
E.
Interference With Wildlife: It is unlawful in any manner to tease, annoy, disturb, molest, catch, injure or kill, or to throw any stone or missile of any kind at or strike with any stick or weapon any animal, bird or fowl in the city park, or to feed any fowl in the park, except at areas designated by the city council.
F.
Circuses And Exhibitions: It is unlawful to hold, operate, or conduct a circus, carnival, or traveling exhibition in the city park, except such activities as may be a regular part of the parks and recreation program conducted by the city, or as expressly allowed under permit by the city clerk-treasurer.
G.
Sales; Permission Required: It is unlawful to sell refreshments or merchandise in the city park without first obtaining a permit from the city clerk-treasurer or a concession contract with the city.
H.
Meetings And Literature Distribution: It is unlawful to hold or participate in any religious or political meeting or other assembly, or to distribute literature in any park without first obtaining a permit from the city council.
I.
Vehicles And Horses: It is unlawful to ride or drive any motor vehicle through the city park, except in areas that are designated by the city. It is unlawful to ride or lead horses in any areas of the city park, except in areas designated by the city for such purposes and so designated by signs.
J.
Camping: It is unlawful to camp in the city park, except in places set aside for such purposes by the city and so designated by signs, or by permit from the city council.
K.
Sports Events: It is unlawful to practice or play golf, baseball, cricket, lacrosse, polo, archery, hockey, or other games of like character or to hurl or propel any airborne or other missile or to fly any model airplane in the city park, except at places set apart for such purposes by the city and so designated by signs.
L.
Littering: It is unlawful to throw any refuse, litter, broken glass, crockery, nails, shrubbery, trimmings, junk or advertising matter in the city park or to deposit any such material therein, except in designated receptacles.
M.
Refuse Restrictions: It is unlawful to deposit any refuse, not generated in the city park, in designated receptacles.
N.
Fires: It is unlawful to build any fires in the city park, except in areas designated by the city.
O.
Disorderly Conduct: It is unlawful to conduct oneself in a disorderly manner in the city park. Any of the following acts shall constitute an act of disorderly conduct:
1.
Challenging or enticing another person to fight, or fighting by agreement; except as a part of an organized athletic event.
2.
Use of profane, abusive or offensive language directed at other park attendees in a manner that disrupts their right to enjoy the park.
3.
All noise disturbances as defined in section 6-2-2 of this code are prohibited at all times. The content of the sound will not be considered in determining a violation. The following acts are considered to be noise disturbances, if the noise is clearly audible in the park at a distance of thirty feet (30') including across a park boundary:
a.
Using, operating or playing, or permitting the use, operating or playing of, any audio equipment, television set, musical instrument and similar device, or other improvised materials, whether portable or stationary or mounted on or within a motor vehicle that is audible at a distance over thirty feet (30') therefrom, except pursuant to a permit issued by the city council;
b.
Creating loud and raucous, and frequent, repetitive, or continuous sounds with the human voice;
4.
Intentionally disturbing any lawful assembly or meeting of persons without lawful authority.
5.
Intentionally obstructing pedestrian traffic without lawful authority.
6.
Throwing objects at any structure, building, vehicle or person with an intent to annoy, intimidate, harass or disturb any person.
P.
Remaining After Closing Hour: It is unlawful to remain in the city park after the posted closing time; provided, however, that in the event the park is rented, then the renter may remain in the park according to the hours specified in the rental agreement.
Q.
Climbing Trees: Climbing of trees, fences, poles or backstops is prohibited.
R.
Liquor: Except as permitted by this code, no person shall open a package containing liquor or shall consume liquor in the park. The city council may approve exceptions to this prohibition pursuant to subsection S of this section. Liquor shall be defined pursuant to Revised Code Of Washington 66.04.010.
S.
Permits Granted By City Council: The city council shall employ the following factors in determining whether to grant permits allowed by this section and in determining the permit fee to be set: the effect of the use on the park grounds and facilities, ability of the permittee to take appropriate steps to manage its stay and clear away its trash, the overall condition of the park, the duration of the stay, the number of requested visitors, the effect on other members of the public and users of the park, location of the proposed use, size of the proposed use, noise level involved and any other factor relevant to the preservation of public property, health and safety.

Any person violating any of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be subject to penalty as provided in section 1-4-1 of this code.
