A.
Every person convicted of a gross misdemeanor for which no punishment is fixed by ordinance in force at the time of conviction and sentence shall be punished by imprisonment for a maximum term fixed by the court of not more than one year, or by a fine in an amount fixed by the court of not more than $5,000, or by both such imprisonment and fine.
B.
Every person convicted of a misdemeanor for which no punishment is fixed by ordinance in force at the time of conviction and sentence shall be punished by imprisonment for a maximum term fixed by the court of not more than 90 days, or by a fine in an amount fixed by the court of not more than $1,000, or by both such imprisonment and fine.
C.
Every person found to have committed a civil infraction for which no penalty is fixed by ordinance in force at the time of finding and imposition of penalty, shall pay a monetary penalty fixed by the court according to the number of times such person is found to have committed the same infraction within a three-year period as follows:

All fines and penalties received by the city shall be placed in the general fund, unless otherwise required by state law.
