A. 
The city of Snoqualmie has selected the 800 mHz standard for public safety radio communications.
B. 
The reliability of 800 mHz radio communications may be impaired by certain construction techniques and materials in commercial or institutional buildings, unless appropriate provision is made during construction.
C. 
It is imperative to protect the lives and safety of firefighters, police officers and other personnel who may be called upon to enter commercial or institutional buildings that 800 mHz radios operate properly inside such buildings within the city.
D. 
In the event the owner, occupant or other person in possession or control of any commercial or institutional building or portion thereof within the city does not ensure that 800 mHz radios operate properly within such building, it would be unreasonably dangerous to require firefighters, police officers or other emergency personnel to enter such building.

A. 
The responsibility to provide for the proper operation of 800 mHz radios within any commercial or institutional building or premises or portion thereof shall rest with the owner, occupant or other person in possession or control of such building or premises; provided, this chapter shall not be deemed to authorize any condition of any building permit or certificate of occupancy except to obtain a test.
B. 
No firefighter, police officer or other emergency personnel shall be requested or directed to enter any commercial or institutional building which either has not been tested for the proper operation of 800 mHz radios pursuant to this chapter, or within which the most recent test discloses that 800 mHz radios do not operate properly.
C. 
The city of Snoqualmie shall not be liable for any damages which may result from the refusal of any firefighter, police officer or other emergency personnel to enter any commercial or institutional building or premises or portion thereof due to failure of the owner to provide for assurance of the proper operation of 800 mHz radios within such building or premises.

A. 
Prior to occupancy of any new or altered commercial or institutional building or any portion thereof within the city for which a certificate of occupancy is required, the building official shall request the chief of police or his designee to conduct a test to determine whether 800 mHz radio communications operate properly within such building.
B. 
Each owner, occupant or other person in possession and control of any commercial or institutional building or premises or any portion thereof may request the chief of police or his designee to conduct a test to ascertain whether 800 mHz radios operate properly within existing or planned commercial or institutional buildings or premises.
C. 
The results of all tests shall be reported in writing, and a record thereof maintained by the building official, the police department and the fire department. A copy thereof shall also be furnished to the owner, occupant or other person in possession or control of such building or premises.
D. 
Tests conducted under this section shall be without charge.

The police department shall maintain a list of known sources of technical information relating to techniques and/or equipment for providing for the proper operation of 800 mHz radios within buildings or premises, and shall upon request provide such list to the owner, occupant or person in possession or control of any building or premises or portion thereof within the city.
