ELECTRIC BICYCLE OR E-BIKE
A bicycle weighing no more than 100 pounds equipped with fully operable pedals, a saddle or seat for the rider, wheels not less than 11 inches in diameter, an electric motor of less than 750 watts, and meets the requirements of either of these two classes:
A. 
"Class 1 Electric Bicycle" shall mean an electric bicycle equipped with a motor that only provides power when the rider is pedaling, and which motor is not capable of exceeding a speed of 20 miles per hour on a level surface.
B. 
"Class 2 Electric Bicycle" shall mean an electric bicycle equipped with a motor that may be used exclusively to propel the bicycle, and which motor is not capable of exceeding a speed of 20 miles per hour of a level surface.
ELECTRIC SCOOTER OR E-SCOOTER
A device with one or more wheels and a standing platform that is powered by an electric motor and designed to transport one person standing. This definition excludes mobility scooters and seated scooters, but includes Segways, powered (electric) skateboards, and powered (electric) unicycles.
A. 
A rider of an Electric Bicycle shall have the same rights and responsibilities provided for bicycle riders in the Pennsylvania Vehicle Code, 75 Pa. C.S.A. § 3501 et seq.
B. 
Electric Bicycles shall be allowed in the same areas as non-motorized bicycles, such as streets, highways, and bicycle lanes. Riders under the age of 16, however, are not permitted to ride E-Bikes on streets, highways and bicycle lanes.
C. 
Electric Scooters are only permitted to be operated on private property.
D. 
The rider of any device regulated in this article shall follow all applicable provisions of the traffic and parking regulations in this chapter, as well as the applicable provisions of the Pennsylvania Vehicle Code, 75 Pa. C.S.A. § 101 et seq.
A. 
Electric Bicycles are prohibited on all Township Property, which includes the Radnor Trail System, Township Parks, the Township Skate Park, and all other similar properties owned and/or controlled by Radnor Township except when visiting the Township Municipal building or other Township buildings.
B. 
Electric Scooters are prohibited on all public streets, highways, trails, and sidewalks, and all Township Property, which includes the Radnor Trail System, Township Parks, the Township Skate Park, and all other similar properties owned and/or controlled by Radnor Township.
C. 
Any electric motorized bicycle that does not meet this article's definition of an Electric Bicycle is prohibited on all public streets, highways, trails, and sidewalks, and all Township Property, which includes the Radnor Trail System, Township Parks, the Township Skate Park, and all other similar properties owned and/or controlled by Radnor Township.
A. 
Every device or vehicle regulated under this article must be equipped with a speedometer that displays the device's speed in miles per hour.
B. 
Every device or vehicle regulated under this article shall operate in a manner so that the electric motor is disengaged or ceases to function when the rider stops pedaling or when the brakes are applied.
C. 
A person shall not tamper with or modify any device or vehicle regulated under this article in a manner that increases risk to any person or changes the device's motor powered speed capability or motor engagement.
D. 
An Electric Bicycle shall comply with the equipment and manufacturing requirements for bicycles adopted by the United States Consumer Product Safety Commission, 16 CFR Part 1512.
No person under the age of 16 shall operate any Electric Bicycle or Electric Scooter on any public street, highway, trail, or sidewalk or within the parks of Radnor Township.
A. 
All operators and passengers of Electric Bicycles and Electric Scooters shall wear a properly fitted and fastened bicycle helmet that meets the standards provided by either the United States Consumer Product Safety Commission or the American Society for Testing and Materials, or standards subsequently established by those entities.
B. 
No more than one person may ride or otherwise occupy any Electric Scooter at one time.
C. 
No more than one person may ride or otherwise occupy any Electric Bicycle designed for a single rider at one time.
D. 
All riders/operators of Electric Bicycles shall comply with the following:
(1) 
Know the type and specifications of the device/vehicle they are riding and where they can ride it.
(2) 
Maintain safe speeds at all times, considering road and weather conditions.
(3) 
Be cognizant of all other drivers and riders.
(4) 
Stay to the right, pass on the left, and maintain single file when passing or being passed.
(5) 
Obey all road signs.
(6) 
Slow down in congested areas.
(7) 
Yield to pedestrians.
A. 
Notice. Whenever an officer determines that there has been a violation of this article or has reasonable grounds to believe that a violation has occurred by a person, a written notice of the violation shall be given to such person. Such a notice shall be served upon such person via personal service or through the mails. The notice shall contain instructions on how and when to pay the fine, a warning concerning late fees, and directions regarding how to appeal said notice.
B. 
Fine. Any person who violates any provision of this article shall, upon conviction, be sentenced to pay a fine, penalty, and/or late fee of not more than that specified in the most current Consolidated Fee Schedule, as enacted and ordained by the Radnor Township Board of Commissioners. Said fines, penalties, and fees may be changed from time to time by resolution of the Board.
C. 
Payment procedure. Any person who receives a notice in accordance with this section shall pay the penalty imposed for such violation within 10 days of the date of issuance of such notice. Payment for violations shall be made by mailing the notice along with a check or money order in the amount specified on the notice or payment may be made at the Radnor Township Municipal Building.
D. 
Late fee procedure. If Radnor Township has not received payment for a violation within 10 days of the date of issuance of the notice, a late fee of $25 will be assessed in addition to the fine.
E. 
Failure to pay. Failure by the violator to pay this fine and/or late fee within 30 days of the date of issuance of the notice will result in the issuance of a non- traffic citation against the violator and prosecution of the violator before the appropriate Magisterial District Judge in accordance with Subsection G below.
F. 
Procedure to contest violation. Any person who wishes to contest a violation under this article shall appeal the notice to the appropriate Magisterial District Judge within 30 days of the violation. If said appeal is denied, the Court may impose a fine in accordance with Subsection G below.
G. 
In addition to the notification process set forth above:
(1) 
Any violation of a provision of this article may hereinafter be enforced by the Township by filing a non-traffic citation against the violator(s) with the Magisterial District Judge having jurisdiction or any other court of competent jurisdiction, at the Township's discretion. Notice of such enforcement proceeding shall be made in accordance with the applicable Pennsylvania Rules of Civil Procedure. If a defendant neither pays nor timely appeals any resulting judgment, the township may enforce the judgment pursuant to the applicable Rule of Civil Procedure.
(2) 
Any person who violates any provision of this article shall, upon conviction before the Magisterial District Judge or other court of competent jurisdiction, be sentenced to pay a fine of not more than $1,000 plus the costs of prosecution, including, but not limited to, all court costs and reasonable attorney fees incurred by the Township in enforcing the violation. Each day a violation continues shall constitute a separate offense, and each provision violated shall constitute a separate offense.
H. 
The parent, guardian, or individual with express authority to supervise a minor child may also be charged for violating this article for repeated offenses by such minor child.
