Except as otherwise provided in this title or unless the context clearly indicates otherwise, the definitions of words and phrases in AS 11.81.900, AS 28.90.990, other sections in Title 28 of the Alaska Statutes, the Alaska Administrative Code in 2 AAC chapters 90 and 92, 13 AAC chapters 02 and 04, and 13 AAC 40.010 shall be the definitions of those same words and phrases used in this title.

The following words, terms and phrases, when used in this title, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning.
means a street the primary use of which is to provide access to the rear or side lots of buildings in urban districts and not for the purpose of through vehicular traffic.
is parking where the longitudinal axes of vehicles form an angle with the alignment of the roadway so that the vehicles are facing the curb or side of the roadway.
means a municipal or state owned street or portion thereof properly designated as such by the official streets and highways plan as a part of the arterial system of streets.
means vehicles of the fire department, police vehicles, and such ambulances and emergency vehicles of municipal departments or corporations which are designated or authorized by the chief of police of the municipality.
means any person who is directing or regulating traffic as required by statute, regulation or ordinance, or by contract or agreement, and who is wearing and equipped with the approved warning devices set out in the Alaska Traffic Manual, published by the state of Alaska Department of Transportation and Public Facilities, or other standards municipalities are required to comply with under AS 28.01.010.
means the common axis of rotation of two or more wheels, whether power driven or freely rotating, constructed in one or more segments.
means an assemblage of two or more consecutive axles considered together in determining the effect of their combined load effect on a bridge or pavement structure.
is where the longitudinal axes of vehicles form an angle with the alignment of the roadway so that the vehicles are facing the center of the roadway.
means an electric-assisted bicycle, an electric-assisted scooter, or any device propelled solely by human power upon which any person may ride, having at least two tandem wheels either of which is more than 14 inches in diameter.
means a portion of a roadway, that has been designated by pavement markings and/or signs for preferential or exclusive use by vulnerable road users, not including pedestrians. Bicycle lanes include, but are not limited to, the following:
"Protected bicycle lane"
means a bicycle lane guarded from the encroachment of motor vehicle traffic by a physical barrier, such as bollards, medians, raised curbs. Protected bicycle lanes may also be installed temporarily or seasonally via the use of relocatable barriers, planters and landscaping, trees in fish totes, removable bollards, etc. Parking lanes can also be used as a means of physical protection if there is a buffer space between the bicycle lane and the parking lane.
"Buffered bicycle lane"
means a bicycle lane paired with a designated buffer space that uses pavement markings but no physical barriers to separate the bicycle lane from the adjacent motor vehicle travel lane and/or curbside parking lane.
"Cycle track"
means an on-street protected bicycle lane that is physically separated from motor vehicle travel lanes, parking lanes, and sidewalks. In situations where on-street parking is allowed cycle tracks are located to the curb-side of the parking. Cycle tracks may be one-way or two-way, and may be at street level, at sidewalk level, or at an intermediate level. If at sidewalk level, a curb or median separates them from motor traffic, while different pavement color or texture or reflective markings differentiates the cycle track from the sidewalk. If at street level, cycle tracks may be separated from motor vehicle traffic by raised medians, on-street parking, or bollards. They are meant to provide a high level of security and comfort for vulnerable road users.
means every motor vehicle designed for carrying more than ten passengers and used for the transportation of persons, and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensation.
means any vehicle used to transport passengers for hire by the municipality's mass transit system.
means the territory contiguous to and including the street when, within any 600 feet along such street, there are buildings in use for business or industrial purposes, including but not limited to hotels, banks, office buildings, railroad stations and public buildings, which occupy at least 300 feet of frontage on one side or 300 feet collectively on both sides of the street. See also "central business traffic district", or any other area defined and designated by the assembly.
means a structure built or adapted to be placed upon a vehicle and used for living quarters for recreational use, whether or not such camper is installed upon a vehicle.
means the center lane of a roadway having three or more lanes whenever such center lane is designated for left turns from the roadway. A center turn lane may be designated by appropriate markings on the surface of the roadway, by signs along the roadway, or by a combination thereof.
means a line marked or unmarked, parallel to and approximately equidistant from the sides of a roadway or street, or a plainly marked dividing line on a roadway, between lanes of traffic traveling in opposite directions, which may or may not be equidistant from the sides of a roadway or street.
means all streets and portions of streets within the area described as follows: all that area bounded on the south by Ninth Avenue, on the north by Third Avenue, on the west by L Street and on the east by Gambell Street.
means a self-propelled or towed vehicle, used upon a highway or vehicular way to transport passengers or property for commercial purposes, and:
Has a gross vehicle weight rating or gross combination weight rating greater than 10,000 pounds; or
Is designed to transport more than 15 passengers, including the driver; or
However, the following vehicles are not commercial motor vehicles for purposes of this title:
Emergency or fire equipment necessary to the preservation of life or property;
School buses;
Vehicles and trailers used to transport horses, sled dogs, or other large domestic animals for recreational, sport or personal use; and
Vehicles used exclusively for non-commercial purposes.
means any sedan type vehicle meeting the classification in 40 CFR Section 600.315-82, and listed by the manufacturer as a compact car.
means every street, highway or roadway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the street, highway or roadway, except at such points only and in such manner as may be determined by the public authority having jurisdiction over such street, highway or roadway.
means:
The portion of a roadway at an intersection included within the connection of the lateral lines of the sidewalks on opposite sides of the street measured from the curbs, or, in the absence of curbs, from the edges of the traversable roadway and, in the absence of a sidewalk on one side of the roadway, the portion of a roadway included within the extension of the lateral lines of the sidewalk at right angles to the centerline.
Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface. The pedestrian crossing may be supplemented by contrasting pavement texture, style or color.
means a street with only one inlet/outlet, with provision for a turnaround at its termination.
means a vehicle whose body and frame were manufactured before 1949 or a replica thereof and that has been modified for safe road use. For purposes of this definition, the term "modified" includes a material alteration of the drive train, suspension brake system or body dimensions.
See "separate roadway".
means every person who drives or is in actual physical control of a vehicle.
means an access constructed across a public way which connects a street, roadway, sidewalk or recreational trail to adjacent property so no portion of the public way is blocked after access has been gained to the adjacent property.
means that degree of care which an ordinarily prudent person would have exercised in under the same or similar circumstances.
means consideration in a degree appropriate to the demands of the particular case.
means a bicycle or tricycle equipped with fully operable pedals and an electric motor of no more than 750 watts; that can safely share a bicycle transportation facility with other users of such facility; and meets the requirements of one of the following classifications:
Class 1 electric-assisted bicycle means a bicycle equipped with an electric motor that provides assistance only when the rider is pedaling and ceases to provide assistance when the speed of the bicycle reaches or exceeds 20 miles per hour.
Class 2 electric-assisted bicycle means a bicycle equipped with an electric motor that may be used exclusively to propel the bicycle and is not capable of providing assistance when the speed of the bicycle reaches or exceeds 20 miles per hour.
Class 3 electric-assisted bicycle means a bicycle equipped with an electric motor that provides assistance only when the rider is pedaling and ceases to provide assistance when the speed of the bicycle reaches or exceeds 28 miles per hour.
means a two-wheeled device that is operable from a standing position; that has handlebars and a floorboard; and is powered by an electric motor that has a power output of not more than 500 watts that: a) is incapable of propelling the device at a speed of more than 20 miles per hour; and b) disengages or ceases to function when the device's brakes are applied. For the purposes of this title, an electric-assisted scooter is considered a bicycle.
means an electric personal assistive mobility device that is a self-balancing vehicle with two nontandem wheels, designed to transport only one person, has an electric propulsion system, and has a maximum speed of not more than 15 miles an hour.
means the municipal fire department.
means a vehicle other than a pole trailer, designed for carrying persons or property by being drawn by a motor vehicle and which is constructed or equipped with axles arranged so that no part of the vehicle or the weight of a load carried by the vehicle rests upon or is carried by another vehicle.
means the total weight of a vehicle, including the load.
means the value specified by the manufacturer as the loaded weight of a single vehicle.
means the total vertical dimension of any vehicle above the roadway surface, including any load and load-holding device thereon.
means the entire width between the boundary lines of every way that is publicly maintained when a part of it is open to the public for purposes of vehicular travel, including but not limited to every street but excluding vehicular ways or areas.
means the hours from one-half hour after sunset to one-half hour before sunrise, and any other time when persons or objects may not be clearly discernible at a distance of 1,000 feet.
means a trailer designed and built or adapted for the purpose of being a residence or office and for being drawn by a motor vehicle.
means:
The area embraced within the prolongation or connection of the lateral curb lines or, if none, within the lateral boundary lines of the roadways of two highways joining one another at, or approximately at, right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come into conflict.
The junction of an alley or driveway with a roadway or highway is not an intersection.
means a vertical metal pin which is used to join the body of a semitrailer to another vehicle for the purposes of drawing the semitrailer and acting as a pivot.
means a roadway which is divided into two or more clearly marked lanes for vehicular traffic.
means any driver's license or any other license or permit to operate a motor vehicle issued under or granted by the laws of this state or this municipality, including:
means designated spaces adjacent to a curb used for various purposes including, but not limited to, freight loading, hotel loading, curb loading zones, passenger loading, tour bus, or taxi loading.
Freight curb loading zones means space adjacent to a curb for the exclusive use of vehicles during the loading and unloading of freight.
Hotel loading zone means space adjacent to curbs outside of facilities offering overnight accommodations and subject to the hotel-motel tax in chapter 12.20.
Curb loading zone means space adjacent to a curb used by vehicles during the loading and unloading of freight or by vehicles during the loading or unloading of passengers.
Passenger curb loading zone means space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.
Tour bus loading zone means space adjacent to a curb outside facilities offering tourist attractions.
Taxi loading zone means space adjacent to a curb reserved for the exclusive use of taxicabs for the loading and unloading of passengers.
means every tire or wheel having a bearing surface in contact with the roadway which is wholly or partly of metal or other hard, nonresilient material, but does not include a pneumatic tire manufactured with metal studs attached to the bearing surface to improve traction on ice or snow, provided the metal in contact with the roadway does not exceed three percent of the total tire area in contact with the roadway.
means raised circular islands constructed in the center of residential or minor street intersections (generally not intended for use when one or both streets are arterial streets), used to reduce vehicle speeds by forcing motorists to maneuver around them.
means every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor and snowmobile. A motorcycle may have four wheels in contact with the ground provided two of the wheels are a functioning part of a side car.
means any motorcycle, motor scooter (not to include electric-assisted scooters), moped or bicycle with a 50cc or smaller engine displacement motor attached or producing less than five brake horsepower, or any moped, dirt bike, or bicycle equipped with an electric motor that does not meet the definition of an electric-assisted bicycle.
means a motor vehicle that has been designed and built or adapted to a truck, bus or other motor vehicle chassis to serve as living quarters for recreational purposes.
means every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. For purposes of this title, low-speed electric bicycles are not motor vehicles.
Whenever certain hours are named in this title they mean the standard time or daylight saving time as may be in current use in the municipality.
means a person, other than a lienholder, having the property in or title to a vehicle. The term includes a person entitled to the use and possession of a vehicle subject to a security interest in another person, but excludes a lessee under a lease not intended as security.
means any march, procession or other activity consisting of people, animals, vehicles or other conveyances or any combination thereof, except a funeral procession, upon any public street, roadway, sidewalk or alley, which requires abnormal or unusual traffic regulations or controls.
mean the standing of a vehicle, regardless of whether the vehicle is running or occupied.
means a timing device, either adjacent to or located on the same block as a parking space, to show the length of time a vehicle may occupy that parking space.
means motor vehicles designed to carry no more than ten passengers, including pickup trucks but excluding motorcycles and motor-driven cycles.
means a public way for purposes of travel by authorized users outside the traveled way and physically separated from the roadway by an open space or barrier and either within the highway right-of-way or within an independent alignment, including shared-use paths but not including sidewalks.
means painted markings on highways providing guidance and information for the road user. Major marking colors are yellow and white, and may be either solid or dashed. Some major marking types, with general use and meaning include, but are not limited to:
Solid yellow indicates a restriction against passing on the left or delineates the left edge of pavement on a divided street or highway, where there is inadequate clearance to the left of the line for making emergency stops.
Two solid yellow lines delineate the separation between travel paths in opposite directions where passing is prohibited in both directions. Two sets of the two solid yellow lines are used to identify a painted median or the approach to obstructions such as a raised island. Crossing these markings is done as part of a left-turn movement.
Broken yellow line delineates the left edge of travel path, where travel on the other side of the line is in the opposite direction. Typical application is as the center line of a two-lane, two-way road, where passing and overtaking is permitted.
Broken yellow line with solid yellow line delineates a separation between travel paths in opposite directions, where passing and overtaking is permitted for traffic adjacent to the broken yellow line and is prohibited for traffic adjacent to the solid yellow line. This marking is used to regulate passing. The broken yellow line with solid yellow line is also used on each side of a two-way left-turn lane to delineate the edges of a lane used by traffic in either direction for part of a left-turn maneuver.
Broken white line delineates the edge of a travel path where travel is permitted in the same direction on both sides of the line. It is most frequently used as a lane line.
Solid white line delineates the edge of a travel path where travel in the same direction is permitted on both sides of the line but crossing the line is discouraged. A wide solid white line is used for emphasis, where the crossing requires unusual care. This marking is often used as a line to delineate left or right turn lanes. The solid white line is also used as a pavement edge marking.
Double solid white parallel white lines delineate a travel path where travel in the same direction is permitted on both sides of the line and indicates a prohibition for crossing the double white line in order to change lanes.
Dotted line, a short dashed line, delineates the extension of a line through an intersection or interchange area. The marking has the same color as the line it extends. One typical use of the dotted line is as a guide through an intersection for traffic turning in a dual left turn.
Green pavement markings may supplement solid white lines or dotted white lines in delineating the edge of a bicycle lane designated under section 9.16.095.
means any person afoot, or any handicapped person who is operating a mechanical device which affords mobility similar to a person afoot, including but not limited to wheelchairs and walkers, or who is using a means of conveyance propelled by human power other than a bicycle.
means the area or space officially set apart within a roadway for the exclusive use of pedestrians, protected or so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a pedestrian zone.
means every natural person, firm, corporation, company, partnership, association, organization, business, trust or society.
means every tire designed to use compressed air to support a load.
means every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach or pole, or by being boomed or otherwise secured to the towing vehicle, and ordinarily used for transporting long or irregularly shaped loads such as poles, pipes or structural members capable, generally, of sustaining themselves as beams between the supporting connections.
means every officer of the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
means every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner but not by other persons.
means New Year's Day, Dr. Martin Luther King Day, President's Day, Seward's Day, Memorial Day, Independence Day, Labor Day, Veteran's Day, Thanksgiving Day and Christmas Day, and those holidays which are designated by the state or by the municipality.
means a structure or an open area, other than a street, alley or other right-of-way, used for hourly or daily parking of automobiles and available for public use, whether free, for compensation, or as an accommodation for clients or customers.
means public or private property open to the public by right, either express, implied or by custom, for purposes of travel.
means a carrier of persons or property upon cars operating upon stationary rails.
means any sign, signal or device erected by authority of a public body or official or by a railroad and intended to give notice of the presence of railroad tracks or the approach of a railroad train.
means a steam, electric, diesel or other locomotive, with or without cars coupled thereto, which is operated upon rails.
means any area that is not part of a roadway, lies inside or outside of a park and has been designated by the traffic engineer for joint use by pedestrians, skiers, equestrians or bicyclists.
means the territory contiguous to and including a street not comprising a business district when the property on such a street for a distance of 300 feet or more is in the main improved with residences or with residences and buildings in use for business.
means any street designed to provide access to abutting residential property. Residential, or local, streets can be determined by referencing the Official Streets and Highways Plan.
means the right of one vehicle, bicyclist or pedestrian to proceed in preference to another vehicle, bicyclist or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.
means that portion of a street that is improved, designed or ordinarily used for vehicular travel, exclusive of the curb, berm or shoulder. If a street includes two or more separate roadways, the term "roadway" shall refer to any such roadway separately, but not to all such roadways collectively.
means a circular intersection with yield control of all entering traffic, channelized approaches, counter-clockwise circulation, and appropriate geometric curvature.
means the area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone.
means every motor vehicle that complies with the color and identification requirements set forth in the edition of Minimum Standards for School Buses and Minimum Standards for Alaska School Buses which is in effect on the effective date of the ordinance from which this section is derived, and is used to transport children to or from school or in connection with school activities. The term does not include buses operated by common carriers for the urban transportation of schoolchildren.
means a person employed by the municipality to direct traffic at crosswalks used by children going to and from school.
means a school zone with flashing yellow beacons that, when operating, require drivers to proceed through the school zone at the designated speed.
means that territory, including streets, adjacent to a public or private school or school grounds, or any other area so designated by the traffic engineer.
means every vehicle, other than a pole trailer, designed for carrying persons or property by being drawn by a motor vehicle attached by a king pin and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
means a street divided into two or more roadways by leaving an intervening space, or a physical barrier, or a clearly indicated dividing section. A roadway with four or more lanes plus a center turn lane is considered a separate roadway.
means an electric-assisted bicycle, electric-assisted scooter, or bicycle owned and offered for rent to the public by a shared micro-mobility program service provider.
means a system of electric-assisted bicycles, electric-assisted scooters, bicycles, or any combination thereof, staged in the public right-of-way, for self-service hire and use through a mobile application or phone-based accessibility option, operated by a shared micro-mobility program service provider, which does not require a docking station, rack, or other object.
means a person who owns, manages, operates, or acts on behalf of a share micro-mobility program, including third-party subcontractors.
means that portion of a street between the curblines, or the lateral lines of a roadway, and the adjacent property lines, intended for the use of pedestrians.
means the total weight transmitted to the roadway by the wheels of a single axle.
means a self-propelled motor vehicle primarily designed or altered for travel on snow or ice when supported in part by skis, belts, or cleats; "snowmobile" does not include machinery used strictly for the grooming of snowmobile trails or ski slopes, and expressly includes devices known as snowmobiles, skimobiles, snowmachines or snow vehicles.
means every tire of rubber or other resilient material which does not depend upon compressed air for the support of the load.
means every vehicle designed or used primarily for the transportation of persons or property and only incidentally operated or moved over a street, including but not limited to ditch digging apparatus, well boring apparatus and road construction and maintenance machinery such as asphalt spreaders, bituminous mixers, bucket loaders, tractors other than truck tractors, ditchers, leveling graders, finishing machines, motor graders, road rollers, scrapers, power shovels and draglines, and self-propelled cranes and earth moving equipment. The term does not include house trailers, dump trucks, truck-mounted transit mixers, cranes or shovels or other vehicles designed for the transportation of persons or property to which machinery has been attached.
mean the halting of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in receiving or discharging passengers.
when required, means complete cessation from movement.
when prohibited, mean any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer, firefighter or traffic control sign or signal.
means the entire width between the boundary lines of every way open to the use of the public for purposes of vehicular travel.
means any vehicle used to provide maintenance, administrative or other direct support to the delivery of municipal transportation services.
means an axle group of two or more consecutive axles whose centers are not less than 40 inches but not more than 96 inches apart, attached to the vehicle by means of a common attachment, including a connecting mechanism designed to distribute the vehicle load at this point equally between the axles.
means the total weight transmitted to the roadway by a tandem axle group.
means every motor vehicle having a seating capacity of nine passengers or less, as per the manufacturer's rating, used for the transportation of passengers for hire, and not operated over a fixed and definite route.
means a period of time not to exceed five minutes, or as otherwise posted.
means every street or portion thereof on which vehicular traffic is given preferential right-of-way, and at the entrance to which vehicular traffic from intersecting streets is required by law to yield right-of-way to vehicles on such through streets in obedience to stop sign, yield sign or other official traffic control devices, when such signs or devices are erected as provided in this title.
means pedestrians, ridden or herded animals, vehicles and other conveyances, either singly or together, while using any street, alley, vehicular way, or area, or private or public way open to public access for purposes of travel.
means alterations to the roadway involving horizontal and/or vertical changes in street alignment, installation of barriers and other physical measures to reduce traffic speeds and/or cut-through volumes, in the interest of pedestrian and street safety, livability and other public purposes.
means a sign, signal, marking, or other device used to regulate, warn, or guide traffic, placed on, over, or adjacent to a street, highway, pedestrian facility, or shared use path by authority of a public agency with jurisdiction.
means any device, whether manually, electrically or mechanically operated, where traffic is alternately directed to stop and permitted to proceed.
means a system that uses infrared light or other technology on a motor vehicle to transmit a signal to a receiver connected to a traffic light or other traffic control device for the purpose of giving the vehicle transmitting the signal the right-of-way by changing the traffic light or control device.
means a portion of a highway where signs are erected designating that portion as a traffic safety corridor or safety zone under AS 19.10.075.
means the traffic unit of the municipal police department, or, in the event a traffic unit is not established, then the term shall be deemed to refer to the municipal police department.
means every vehicle other than a pole trailer, designed for carrying persons or property by being drawn by another vehicle and constructed so that some part of its weight and that of its load rests upon or is carried by another vehicle.
means an enclosed trailer designed and built or adapted to serve as living quarters for recreational purposes, and which is drawn by a motor vehicle.
means a tandem axle group consisting of three consecutive axles.
means a motorized vehicle designed, used or maintained primarily for the movement of a load, and includes a vehicle for pulling trailers or semitrailers.
means every motor vehicle designed and used primarily for drawing other vehicles and not constructed to carry a load thereon other than a part of the weight of the vehicle and load so drawn.
means turning a vehicle on an arc of approximately 180 degrees to travel in the opposite direction on the same roadway.
means every device in, upon or by which any person or property is or may be transported or drawn upon or immediately over a street or vehicular way or area, except devices moved solely by any one or combination of human muscular power, wind or gravity, or used exclusively upon stationary rails or tracks.
means a truck tractor and semitrailer with or without a full trailer, or a truck with one or more full trailers.
means a way, path, or area, other than a highway or private property, designated by official traffic control devices or customary usage, open to the public for purposes of pedestrian or vehicular travel, and that may be restricted in use to pedestrians, bicycles, or other specific types of vehicles as determined by the traffic engineer or designee, the State of Alaska Department of Public Safety, or other agency with jurisdiction over the way, path, or area.
means a person on a public roadway not using a motor vehicle. For the purposes of this title vulnerable road users include:
