The director of the public transportation department may adopt regulations pursuant to chapter 3.40 to help provide an efficient and safe public transit system. To the extent that the regulations utilize administrative adjudication, the director may exercise adjudicatory powers over violations of the regulations. The director may delegate the adjudicatory powers to an administrative hearing officer designated by the director of the public transportation department.

For the purposes of this chapter:
"Day pass"
means a pass that entitles bearer to unlimited rides on a calendar day.
"Half fare"
means the Federal Transit Administration (FTA) requirement to offer a half fare for seniors, people with disabilities that meet eligibility criteria, and Medicare Card holders (49 CFR Part 609 "Transportation for Elderly and Handicapped Persons"). Half fare also includes youth and veterans in this Code.
"Passenger vehicle"
means any vehicle provided, used, or under contract to transport passengers by the municipality's public transportation system.
"Premium surcharge"
means the surcharge that applies to any Municipal funded AnchorRIDES trip with an origin or destination outside of ¾ mile of the fixed route service.
"Senior"
means any person age 60 or over.
"Service animal"
means any guide dog, signal dog, or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability as defined in 28 CFR 36.104.
"Small animal"
means an animal, including a mammal, insect, bird, fish, or reptile that may be carried on to a passenger vehicle by one person and will fit on the lap of the passenger.
"Traffic preemption device"
means a system using infrared light or other technology on a motor vehicle to transmit a signal to a receiver connected to a traffic light or other traffic control device for the purpose of giving the vehicle transmitting the signal the right-of-way by changing the traffic light or control device.
"Veteran"
means any person actively serving or who has served in the United States Military.
"Youth"
means any person age 0—18.

Public transportation buses operated by the municipal public transportation department are authorized to possess and use traffic preemption devices in the municipality pursuant to AS 11.56.825.

A. 
It is unlawful for any person while at a public transportation department facility, bus stop, or aboard a passenger vehicle within the limits of the Municipality of Anchorage to:
1. 
Smoke, vape, consume, or use a lighted or smoldering pipe, cigar, cigarette, electronic smoking device, any other tobacco product, marijuana, or any illegal substance;
2. 
Drink or consume alcohol or transport open alcohol containers;
3. 
Disturb, harass, or assault public transit workers or other passengers;
4. 
Discard, dispose, place, throw, or drop any litter, food or drink in or from a passenger vehicle, except into receptacles designated for that purpose;
5. 
Play any radio, MP3 player, boom box, cassette record, musical instrument or other such device, unless it is connected to an earphone that limits the sound to the individual user;
6. 
Carry any live animals except:
a. 
Properly contained small animals; or
b. 
A service animal accompanied by a passenger with a disability or a trainer;
7. 
Stand in front of the white/yellow line marked on the forward end of the floor of any passenger vehicle or otherwise conduct himself or herself in such a manner as to obstruct the vision of the passenger vehicle operator;
8. 
Knowingly fail or refuse to pay the applicable fare for transportation on the passenger vehicle in cash, credit card, or by mobile ticketing in the required manner;
9. 
Present a pass, badge or other fare medium when the person presenting such fare knows that the pass, badge or other fare medium is not valid;
10. 
Violate indecent exposure or exhibition laws as defined in section 8.10.080;
11. 
Willfully obstruct, impede, hinder, interfere with or otherwise disrupt the safe and efficient operation of a public transportation department facility, bus stop, passenger vehicle, or any public transit worker in the performance of his or her duties;
12. 
Distribute handbills or flyers on any topic or solicit or panhandle from passengers;
13. 
Use abusive language, insulting threats, or any other type of obscenity or physical abuse upon a public transit worker or another passenger;
14. 
Steal, vandalize, or destroy any portion of a public transportation department asset;
15. 
Deposit bodily fluids such as spit, urine, feces, vomit or blood in a passenger vehicle;
16. 
Carry any flammable or combustible liquids, explosives, acids or any other item inherently dangerous or offense to others;
17. 
Conduct cell phone conversations on speaker phone;
18. 
Hang on to or otherwise attach oneself at anytime to the exterior of a passenger vehicle;
19. 
Fail to follow applicable local, state, or federal public health orders or mandates;
20. 
Enter or remain at a public transportation department facility, bus stop, or on a passenger vehicle after at a time when the person's riding privileges are suspended and the person has been notified of the ban;
21. 
Refuse to leave a public transportation department facility, bus stop, or passenger vehicle at the request of a public transit worker.
B. 
Any person who engages in the prohibited acts identified in section 11.70.030A may be subject to penalties ranging from a written warning letter to a lifetime ban revoking access to all public transportation department facilities, bus stops, or passenger vehicles. The public transportation department may only impose an administrative penalty under this section pursuant to a published policy, developed in consultation with the department of law. A final decision of the public transportation department suspending a person's riding privileges for any period of time may be appealed to the administrative hearing officer established by title 14. The hearing officer shall review the matter under the procedures of chapter 3.60 and render a final decision. A hearing officer's final decision may be appealed to the superior court pursuant to section 3.60.080.
C. 
In addition to the administrative procedures of subsection B, any person convicted of assaulting a public transit worker under section 8.10.010D shall be automatically banned from the public transit system for a period of one year, beginning on the date of sentencing for a conviction. A ban under this subsection cannot be appealed to the administrative hearing officer.

The public transportation department shall require the conspicuous display, within each passenger vehicle, of a sign clearly setting forth all of the prohibitions of this chapter.
